During our review of the application, the Building Official noted that the septic system is non-conforming. City Ordinances require that a non-conformin� septic system must be repaired at a minimum any time a building permit is issued (Code Sections enclosed).The septic system was found to be non-conforming during a bi- annual inspection in 1994 due to less than 3 foot separation between the drainfield and the seasonal water table as required by Minnesota Rules, Chapter 7080. Repair of the system was required by December 31, 1996 or at any time a permit is required for the property. The City requires complete soil testing and septic system design approved by the septic inspector to accompany the permit application alonj with a letter of credit from a local bank in the amount of 150% of the estimated cost of the system (usually $15,000) and a letter from the property owner agreeing that the septic system will be "repaired to meet City and State standards by July 31, 1996". At this time of the year soil testing is extremely difficult and in this case we believe that sufficient area is available to find a suitable septic site, so the soil testing will not be required at this time, but will be necessary before any repairs can be made.
