Subject: Temporary Property Viewing Stand—Vacant Lot 3Z�� f� O�
In response to a realtor's request for construction of a temporary viewing stand to allow
potential purchasers to see the views from the level of an upper story on a vacant
residential lakeshore lot that is being marketed:
City Attorney Tom Barrett has advised that City sanctioning of such a structure under the
existing ordinances would put the "no accessory structure without a principal structure"
ordinance at risk, and he advises against issuing a permit for such structure. Such a
structure would be considered similar to a seasonal dock under the current ordinance. If
the City wants to allow such "temporary viewing" or"marketing" structures, an
ordinance amendment would be needed to make an exception for such structures, and a
variety of conditions regarding their use, construction, longevity, etc. would have to be
established.
At this point I think we have no need to consider such an ordinance revision. The realtor
should be advised that the City codes do not allow for such a structure, and that other
methods for gaining such a view be employed, such as a mobile lift, or video-camera on
an extendable tripod...
