Subject: 2920 Fox Permit Applications — Pool House, Pool and Retaining Walls
Please review the grading plan and the retaining walls. Attached are:
1. The survey from the building permit. The house is under construction.
2. A large plan showing the proposed grading for the Pool House and Pool as well
as the proposed retaining wall locations and heights.
3. Copies of permit applications with the engineer's report attached to the retaining
wall application.
4. Pool house plans as it sits in the slope.
The wetland on the property is a Manage 3. The pool and walls trigger the buffer
requirement. Please review the proposal for compliance with those regulations.
Willie says the buffer area is intact and protected by silt fence. They were told they
could not grade into the buffer but they didn't read. I think they will need a retaining
wall — if they do, put it in your comments. Before I have them make that correction
I would like your comments. I also see a couple of rocks in the buffer that can't be
there. I have a call in to the designer to find out the size and type of tree to be
removed from the buffer and the type to be planted. I will pass that information on
to you when I get it.

Re: Buffer Ordinance Compliance
Remarks:
Per Division 1. Sec. 78-1601 of the Wetland Protection Ordinance, the proposed construction on this lot
trigger's the ordinance due to the following proposed work:
o Disturbed property drains towards the wetland.
o Grading exceeds 50 cubic yards.
o Net increase in the square footage of impervious surface area.
The following is a summary of the issues that exist with the current plan submitted to the City, and the
requirements per the Wetland Protection Ordinance to be in compliance.
1. Currently some locations of the proposed slopes of the buffer adjacent to the wetland
are approximately 1.5:1 to 2:1, which result in the buffer having reduced
effectiveness to retain nutrients and sediments. The current design does not meet
the requirements of Division 3. Buffer Areas. Sec 78-1605. (2).
Requirement: A reconfiguration, reduction or slope modification to create slopes of
4:1 or flatter within the buffer.
2. Currently the plan shows grading within the buffer, and a portion of the buffer may be
turf area, which is not acceptable per Sec. 78-1605 (1) Acceptable buffer areas.
Requirement: A landscaping plan needs to be submitted to the city for the
buffer area. It should meet the minimal standards provided in Division 3. Sec
78-1605 (3).
3. There are several area drains provided for the new impervious surface being created
as part of the project. Depending on discharge locations this may not be in
compliance with Division 5. Sec. 78-1608 of the Wetland Protection Ordinance.
Requirement: The applicant should provide the location of the discharge points for
the area drains so it can be determined if any additional treatment will be required.

Re: Abraham Residence comments
In response to your remarks:
• Wetland Boundary shown on our revised plans is of the delineation that was
performed when the land was re-platted. I have enclosed that delineation report to
document this delineation.
� All proposed 3:1 slopes are outside the buffer zone. Based on previous comments, it
was our understanding that maYimum 4:l slopes were allowed within the buffer, and
steeper slopes were allo�r�ed outside of that zone. We are not plannin�T to do any
additional grading within the buffer zone, and any previously disturbed areas will be
seeded with a native seed and forb mix.
• All drainpipe outlet areas �cill be monitored for erosion after installation. If there
appears to be any erosion, the grade will be restored and rip-rap will be installed to
stabilize the affected areas.
• I have enclosed a seed list that will be applied in any disturbed area within the
wetland buffer zone. This mix has PLS rates of 16 lbs. per acre of native grasses and
6 lbs. per acre of nati�-e forbs. This mix will be prepared by Twin City Seed
Company in Edina, MN.

Before the building official review building plans planning staff reviews building permit
applications for zoning code compliance. We are unable to complete this review for
these permits the following reasons:
1. The "survey" submitted with the pool house application has been altered. The
pool house, pool, retaining wall and associated grading were not done by the
surveyor. Please submit a survey (done by a surveyor) that shows the house,
well, and grades as they currently exist. The survey should show the pool
house and pool as proposed, with the setbacks to property lines and the
wetland indicated. A grading plan must be done by the appropriate
professional. If the surveyor does this plan it can be on the survey. If
somebody else does it should be submitted separately. The grading plan
should show existing and proposed contours as well as the location and height
of any retaining walls. A copy of the new survey should also be submitted to be
part of the pool permit application.
2. If any of the retaining walls are over four feet high a building permit is required.
The plans for the walls must be signed by a registered engineer. These plans
��v should be submitted at this time even if the permit will not be requested until
� �p�7 later.
3. There is a 16.5 foot buffer required from the wetland. There can be no grading
within this buffer area. This buffer area should be protected during construction.
There is a 20 foot setback from the buffer for any buildings. Retaining walls
may be constructed in the buffer setback.
4. Slopes should not exceed 3:1.
