The hot tub or pool basin must be at least 10 feet from the house (including a deck) and 10 feet from any other
structure. It may not be placed in a drainage, utility or similar easement.

Along with my previous email and the engineering comments, the following items must be submitted or revised in order for
your application to be considered complete and for the plan review to continue:
1. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of an
escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-
pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City
Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is $2,500.
The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a check for
$2,500.
2. Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please contact
the MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will not issue a building
permit without a copy of MCWD permits or documentation from the MCWD stating the proposed project does not
trigger any of their permitting requirements. The above information is required in order for the plan review to

I reviewed the application for a proposed pool at 2690 Fox St and have the following comments:
1. The survey is not to scale.
2. Is the patio existing?Or proposed? The survey should reflect the status of the patio. Currently the patio is
shown approximately 2 feet higher than the pool deck. Any raised portion of the patio must measure 10 feet
from the edge of the pool.
3. There is a retaining wall called out on the SW corner of the pool deck. Is this a proposed retaining wall or an
existing wall? If it is being proposed, the top of wall (TW) and bottom of wall (BW) should be shown. Any wall
over 4' in height and not separated by 2x the height of the upper wall (as measured from the face of the upper
wall to the back of the lower wall), will need to be designed by a registered professional engineer. If when I
perform my as-built site review it does not meet the requirements, the applicant will be required to have an
engineer sign off on the construction after-the-fact.
4. The survey should show the location of the silt fence.
5. The survey also show the alternate location of the septic system.

I reviewed the application for a proposed pool at 2690 Fox St and have the following comments:
1. The survey is not to scale.
2. Is the patio existing?Or proposed? The survey should reflect the status of the patio. Currently the patio is
shown approximately 2 feet higher than the pool deck. Any raised portion of the patio must measure 10 feet
from the edge of the pool.
3. There is a retaining wall called out on the SW corner of the pool deck. Is this a proposed retaining wall or an
existing wall? If it is being proposed, the top of wall (TW) and bottom of wall (BW) should be shown. Any wall
over 4' in height and not separated by 2x the height of the upper wall (as measured from the face of the upper
wall to the back of the fower wall), will need to be designed by a registered professional engineer. If when I

perform my as-built site review it does not meet the requirements,the applicant will be required to have an
engineer sign off on the construction after-the-fact.

BUILDING PERMIT ESCROW AGREEMENT
Orono Building Permit#2014-00298
AGREEMENT made this�day of , 20�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") Mike Jacobs ("Owners").
Recitals
1. A building permit application has been filed for an in-ground pool and deck located at
2690 Fox Street the ("Subject Property"), legally described as Lot 21 and the West 264 feet of Lot 18 also the
west 264 feet of that part of Lot 16 lying south of Lot 19 extended easterly, and subdivrsion number 229,
Hennepin County, Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner estabiishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or wili incur in reviewing the plan. Eligible expenses shail be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Poliution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may aiso be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2014-00298 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsibie for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay
all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
sub�,er�-praper�y pursuant to Minn. Stat. §§415.01 and 366.012.
