Mark Chapin, County Auditor and Treasurer Deputy 8 Pkg ID 1186114M Doc Name: Resolution Document Recording Fee $46.00 Document Total $46.00 Existing Certs 1325863 This cover sheet is now a permanent part of the recorded document. , /�2 v`�'(��i' . � ,�Q�O � C ITY OF ORONO � � RESOLUTION OF THE CITY COUNCIL y�, � , `' No. � 4 �=a �J �"�KFs xo��' A RESOLUTION APPROVING A SUBDIVISION OF A LOT LINE REARRANGEMENT FILE NO. 14-3692 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of Oronc (hereinafter "City Council") has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, Anthony Sarenpa and Nicole Sarenpa a married couple, (hereinafter the "Owners of 2630") are the owners of the property located at 2630 Fox Street within the City of Orono (hereinafter"City") and legally described as follows: Tract C, RLS No. 1249, Hennepin County, Minnesota (hereinafter the "Sarenpa Property"); and WHEREAS, Draper Jaffray and Molfy Jaffray, husband and wife, (hereinafter the "Owners of 2620") are the owners of the property located at 2620 Fox Street within the City of Orono (hereinafter "City") and legally described as: Tract D, RLS No. 1249, Hennepin County, Minnesota (hereinafter the "Jaffray Property"); and WHEREAS, the Owners of 2630 and the Owners of 2620 have collectively made application to the City for approval of a lot line rearrangpment which would relocate the lot boundary line between the properties; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on the lot line rearrangement on October 20, 2014 at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the Orono City Council reviewed the proposed lot line rearrangement at a regular meeting held on October 13, 2014 and makes the following findings with regards to the proposed lot line rearrangement: FINDINGS 1. The Sarenpa Property contains 3.42 acres in area, approximately 414 feet in width and currently contains a single family home and a small accessory structure. 3. The Jaffray Property contains 4.10 acres, and has approximately 559 feet in width and contains a single family home and accessory structures. 4. The Sarenpa Property and the Jaffray Property are both served by private wells and conforming private septic systems. 5. This appiication contemplates a lot iine rearrangement to transfer a 64 foot wide, 0.47 acre portion of the Jaffray Properly to the Sarenpa Property. The 0.47 acre portion of property to be exchanged contains no improvements. 6. Foliowing the lot line rearrangement the Sarenpa Property will contain 3.89 acres in area and approximately 478 feet of width; and the Jaffray Property will contain 3.63 acres in area and approximately 495 feet of width. 7. The lot line rearrangement will not result in the creation of a nonconformity. 8. The 0.47 acre portion of the Jaffray Property to be transferred to the Sarenpa Property is not intended to be a standalone building lot. Because this is a lot line rearrangement which results in no additional lots, no park fee or stormwater trunk fee will be required. CONCLUSIONS, ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVEQ, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby grants the lot line rearrangement of the above referenced properties based on the lot line rearrangement survey dated 09/15/14 by Mark Gronberg of Gronberg & Associates, attached as Exhibit A; subject to the following conditions: 1. The 0.47 acre portion of the Jaffray Property to be transferred shall not be considered a standalone buildable lot, and shall be legally combined with the revised Sarenpa property. 2. The Owners shall file the appropriate deeds reflecting the new legal descriptions (subject to City Attorney approval) with the Hennepin County Recorder's Office and/or Registrar of Titles Office on or before November 10, 2015, or the approval granted by this resolution shall expire.
