Re: 2555 Fox Street - Septic System Setback Variances
Dear Mr. Rirkpatrick:
This letter is tv confirm that the City wil 1 grant variances to
a 1 low the septic system drainf ie ld at the above referenced
address to be located 55' from the wetland and 10' from the west
lot line.
Justification for the granting of these variances from the septic
code requirements are as follows:
l. While the City requires a 75' setback from wetlands,
there are no state regulations for such a setback.
Since the system is proposed to be 10' or more above
the wetland elevation, and given the loam soils present
at the proposed trench bottoms, this system should have
no effect on the wetland nor be affected by the
wetland.
2. City of Orono ordinances require 20' from drainfield
trenches to lot lines. The state code only requires a
10' setback. Because the surface slope is towards the
subject property rather than towards the neighboring
property, and since no water supply wells are nearby,
there is no impact on the neighboring property owner.
The only condition attached to this variance would be
that any surface runoff from the neighboring property
must be diverted around your drainfie ld system rather
than over it, by a swale to be graded during system
construction.
