Permit Conditions: Initials
Erosion control mechanisms must be installed and inspected by the City prior to any land
disturbing activities. The contractor must provide a minimum of a 24 hour notice prior to
inspection.
Erosion control shall be installed and maintained throughout the entire project and must
remain until vegetation has been established.
A haul route shall be submitted to the City Engineer for approval and inspection prior to
commencement of hauling from the site.The property owner shall be responsible for cleaning
and repair of roadways for any adverse impacts.
Prior to the release of escrow money an as-built survey and hardcover calculations must be
submitted and approved.
Advisory Comments
Any changes to the exterior/landscaping improvements, i.e. patios,grading, sidewalks, retaining
walls, etc. not currently shown on the approved survey and landscaping plan will require a
separate Zoning Permit application to be submitted and approved prior to the work
commencing.
Any retaining walls that are over 4-feet in height or tiered walls not separated by twice of the
height of the lower wall require engineered plans and a building permit to be submitted and
approved prior to construction.

We have received and reviewed the updated survey and hardcover calculations submitted and have the following
questions:
• Survey. The survey dated 10-10-2016 shows a gravel area in front of the proposed addition within the 75'
setback area, a partial copy of the survey is attached. Please clarify if the gravel area existing or proposed?
• Hardcover calculations. The hardcover calculations appear to be updated however:
o the date is shown at 28-Ju1-15.
o An exclusion of 100 sf was shown on the hardcover calculation without an explanation as to where the
credit is from.
o The retaining walls and decorative walls can be excluded from the hardcover calculations, attached is
copy of the modified hardcover calculation worksheet. I realize the proposed hardcover is not close to
the allowed 25% however accurate information is important.
o The gravel area is within the 75' setback, if existing should be included in the hardcover calculation
worksheet. If the gravel area is proposed, hardcover is not allowed within 75' of the Ordinary High
Water Level (OHWL) without a variance. Please provide clarification.
o Attached is a copy of our Hardcover Information Packet.

On September 15, 2016 the City received a building permit application for an addition to the lakeside of the house.
Staff conducted a preliminary review based on the information provided and recommends the following items be
submitted or revised in order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. A survey dated 9-10-2015 was provided. The project does not qualify for the survey
exemptions in City Code Section 86-68 (copy attached). The survey from 2015 does not meet the City's survey
requirements for new structures or expansions of an existing structure.
a. Because a new house is being constructed at 1220 Bracketts Point Road the average lakeshore setback
is not shown correctly. Please revise.
b. There are proposed landings which appear to be within the 75' setback which are not shown on the
survey. Hardcover is not permitted within the 75' setback.
c. The addition and all changes/improvements must be shown, including grading.
Please provide two copies of an updated, full-size certificate of survey which meets all of the City's survey
standards (enclosed) indicating the location of the proposed addition and any proposed grading. Please note,
our engineer has not reviewed the survey,so additional comments may be forthcoming.
2. Landscape Plan. Will there be any changes to the landscaping with the proposed screened porch addition? If
so, the City requires a landscape plan be submitted showing all the proposed exterior/landscaping
improvements, i.e. patios, grading, sidewalks, retaining walls, etc. The plan should include the name of the
individual perForming the work. Any proposed patios, grading, sidewalks, retaining walls shown on the
landscape plan should also be reflected on the survey.
3. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District which
allows 25% of the gross area of the lat to be covered in hardcover. Existing and proposed hardcover
calculations from 28-Ju1-15 were submitted. Please have the surveyor prepare updated hardcover calculations
for the project. Enclosed is a copy of the City's hardcover information packet.
4. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow
amount for this project is$2,500. Please note,we acknowledge the receipt of$2,500 from Charles Cudd Co
LLC for the escrow, but be aware per the Cit�s policy the money will be refunded to the property owner.

5. Minnehaha Creek Watershed District (MCWD). Your project may trigger the Minnehaha Creek Watershed
District's (MCWDs) permitting requirements; please contact the MCWD directly at 952-471-0590 regarding
your project. Please note,the City of Orono will not issue a building permit without a copy of the MCWD permit
or documentation stating the proposed project does not trigger any of their perrnitting requirements.

Sec. 86-68. - Permit application; information required.
(a) The application for a construction permit or land alteration permit sha II include such
information as may be required by the city, which may vary between types of construction
projects.
(b) Surveys required:
(1) lnitialsurveyorsite plan. Any building, zoning or general permit application for
construction of a new structure, or expansion of an existing structure or land alteration
shall be accompanied by a certificate of survey or site plan drawn to scale prepared by a
person registered by the Minnesota Board of Architecture, Engineering, Land Surveying,
Landscape Architecture, and Interior Design. A certificate of survey or site plan shall
conform to the City of Orono Survey and Site Plan Requirements.
a. The certification of the plan by a licensed professional may be exempted by the city
engineer if the project meets all of the following:
1. An existing survey accurately describes existing property conditions;
2. Proposed project exceeds the setback requirements by 150%;
3. Proposed project footprint does not exceed 200 square feet;
4. Evidence that the Average Lake Shore setback is met is provided, and
5. Information necessary to ensure the project conforms to city codes and
ordinances, including hardcover, grading, and landscaping requirements is
provided.
(2) Foundation survey. A foundation survey shall be submitted to the city for review and
approval, unless exempted by the building official, upon completion of the foundation
work for all buildings and all additions to buildings. The foundation survey, prepared by a
Minnesota Registered Land Surveyor, shall certify the lot dimensions; front, side, rear,
lakeshore, and wetland setbacks; and foundation elevation. A foundation survey must be
submitted before proceeding with framing or further construction. In lieu of a survey a
letter prepared by a Minnesota Registered Land Surveyor containing the same
information as a foundation survey may be submitted.
(3) As-builtsurvey.An as-built survey, prepared by a Minnesota Registered Land Surveyor,
shall be submitted to the city for review and approval upon the completion of all
buildings and all additions to buildings, unless exempted by the building official. The as-
built survey shall certify the final topography of the site; verify drainage patterns; and
provide hardcover calculations for lots in the Shoreland Overlay District. An as-built

survey must be approved before the issuance of a certificate of occupancy. In the event
that weather or other conditions prevent the completion of an as-built survey at the time
the certificate of occupancy is requested, applicant shall provide a sufficient financial
