The council waived the connection change for the property as the applicant has to pay an equivalent amount to extend
the sewer main to near his property so he can connect.
We have an escrow for the project but that is it so far.

The state of Minnesota, on behalf of its citizens through the Minnesota Pollution Control Agency (MPCA), authorizes
the Permittee to construct and operate a sanitary sewer disposal system at the facilities named above in accordance
with the requirements of this permit.
The goal of this permit is to protect water quality in accordance with the U.S. Clean Water Act, Minnesota statutes
and rules, and federal laws and regulations.
This permit is effective on the issuance date identified above.

The following General Conditions are applicable for all projects that require a Sanitary Sewer Extension Permit issued
by the Minnesota Pollution Control Agency (MPCA).These General Conditions, as well as any Special Conditions listed
above, must be followed.

1. This permit authorizes the Permittee to perform the activities described herein under the conditions set
forth. In issuing this permit,the State/MPCA assumes no responsibility for any damage to permits, property
or the environment caused by the activities of the Permittee in the conduct of its actions, including those
activities authorized, directed or undertaken pursuant to this permit.To the extent the State/MPCA may
have any liability for the activities of its employees that liability is explicitly limited to that provided in the
Torts Claims Act, Minn. Stat. §3.736.
2. In addition to this permit,the Permittee may be required to obtain a National Pollutant Discharge Elimination
System (NPDES) Permit to discharge stormwater associated with construction activity. Construction activity
includes clearing,grading, and excavation. Additional information can be found at

3. If an effluent will result from the project,the Contractor shall submit to the MPCA plans,for approval,to
provide for the following:
a. Water from dewatering operations including effluents from construction activities shall only be
discharged when the effluent complies with the applicable water quality and effluent standards.
Dewatering shall be performed using well points when feasible and practical. All other dewatering shall
be performed so as not to result in increased turbidity in the receiving water.This may require the use of
desilting ponds to reduce suspended solids. When the MPCA requires, permits must be obtained.
b. A Disposal System Permit shall be obtained by the Contractor from the MPCA prior to any hydraulic
dredging,tunneling, or other activity including an effluent which may contain potential pollutants.
4. This permit shall not release the Permittee from any liability or obligation imposed by Minnesota or Federal
statutes or local ordinances and shall remain in force subject to all conditions and limitations now or
hereafter imposed by law.The permit shall be permissive only and shall not be construed as stopping or
limiting any claims against the Permittee for damage or injury to persons or property, or any waters of the
State resulting from any acts, operations or omissions of the Permittee, its agents, contractors or assigns for
damages to State property, or for any violation of the terms or conditions of this permit.
5. No major alterations or additions to the disposal system shall be made without the written consent of the
M PCA.
6. The use of the disposal system shall be limited to the treatment and/or disposal of the sewage, industrial
waste, other wastes or substances described in the plans and/or permit application and associated material
filed with the MPCA.The MPCA may modify,suspend, or revoke in whole or in part,this permit by taking
direct enforcement action,for any just cause including failure: (a)to comply with the terms stated herein;or
(b)to comply with MPCA water quality regulations and standards presently in force. Nothing herein shall
prohibit the MPCA from exercising its emergency powers.
7. The Permittee acknowledges that nothing contained herein shall prevent the future adoption by the MPCA or
its predecessors of any pollution control regulations, standards, orders or statutes more stringent than those
now in existence or prevent the enforcement and application of such regulations,standards, orders or
statutes to the Permittee.
8. The MPCA, its officers, employees and agency review and comment upon engineering reports and
construction plans and specifications solely for the limited purpose of determining whether such report,
plans and specifications will enable the facilities to reasonably comply with the regulations and criteria of the
M P CA.
9. This permit has not been reviewed by the U.S. Environmental Protection Agency and is not issued pursuant
to Section 402 of the Federal Water Pollution Control Act Amendments of 1972.

10. The review of plans and specifications and permit applications is made in accordance with Minn. Stat. §
115.07. Approval of plans and permits is based upon the assumption that the information provided by the
applicant is correct and that all necessary legal requirements have been or will be satisfied.
Permit applications are examined with regard to the design features that apply to the operation and
maintenance of, the degree of treatment to be provided,the effectiveness and reliability of the system, and
compliance of the existing treatment and disposal system.The basis for design review is the most current
editions of the following:
• Recommended Standards for Wastewater Facilities, Great Lakes-Upper Mississippi River Board of
State and Provincial Public Health and Environmental Managers.
• Standard Utility Specifications, City Engineers Association of Minnesota.
• Standard Specifications for Construction, Minnesota Department of Transportation.
• Other accepted engineering references for sewer design and construction.
11. Permit applications are recommended for approval on the basis that the system is to collect only domestic
sewage and such industrial or other waste as may have been provided for in the design. Sump pumps,
foundation drains, or footing drains to collect groundwater and roof drains or other surface water conduits
should not be connected to the sanitary sewer system.
12. Adequate field supervision and inspection by a qualified representative of the owner should be provided at
all times during construction to assure that the project is constructed in compliance with the approved plans
and specifications.
13. The MPCA assumes no responsibility for the integrity of structures or physical features, or for the reliability,
durability or efficiency of specific items of propriety equipment or material. All applicable federal,state and
local laws, regulations or ordinances must be followed in the design, location and construction of proposed
sewer systems or treatment works.The MPCA reserves the right to withdraw its approval of this permit if
construction is not undertaken within a reasonable period after issuance.
14. The Permittee shall comply with all rules, regulations,and requirements of the Minnesota Environmental
Quality Board prior to construction of the proposed project.This permit is not effective until the Permittee
completes all applicable environmental review (Environmental Assessment Worksheet or Environmental
Impact Statement)which may be required for the project.

Definitions
I 1. UTILITY. Under this order"Utility"shall mean and include all privately, publicly or co-operatively �,I
owned communication lines and facilities, any systems, lines and facilities for the distribution and I
i transmission of electrical energy, oil, gas, water, sewer, steam and other pipe lines, railways, ditches,
ilumes or other structures which under the laws of this State or the Ordinance of any County or City
may be constructed, placed or maintained across, along or on County Highway Right-of-Way.
� Dependent upon the meaning intended in the context, "utility" shall also mean the Utility Company,
; inclusive of any wholly owned subsidiary.

General
�I 1. 1. Except as otherwise permitted, utility construction and relocation on County Highway Right-of-Way
shall not be commenced until an application for a Permit has been made and such Permit granted.
The Permit sketch shall show the location of the proposed utility with reference to County Highway
I Centerline. A copy of the sketch shall be provided for each copy of such Permit.

� 2. Inclement weather shall be reason for delay of the project start or suspension of the project as
�� determined by Hennepin County.
3. Safety vests shall be worn by ANYONE occupying County right-of-way. �
� 4. Permit on Job- Permits or copies shall be kept on the work site, while work is in progress, in the i
��Icustody of the individual in charge, and shall be exhibited upon request by any county official.
, 5. Provisions and Specifications-These general permit requirements and specifications shall be
'I considered as forming an integral part of each and every permit issued for operations on county
; roadways. The work authorized by this permit shall be done at such time and in such manner as
i shall be consistent with the safety of the public and shall conform to all requirements and standards
� of the County of Hennepin as herein specified. If at any time, it shall be found by Hennepin County I
i that the work is not being, or has not been, properly performed, the Permittee, upon being notified, �
shall immediately take the necessary sters, at their own expense, to place the work in conformance
' to said requirements or standards. �
�� 6. Annulment- In the event of failure or neglect, will or not, by said Permittee or Permittee's
; employees, to perform and comply with the prescribed conditions, restrictions and regulations, the
Transportation Department may revoke and annul this permit and order said Permittee to
Iimmediately remove any and all structures or property belonging to said Permittee from the legal
I limits of the roadway or county property.
! 7. Private Property-The Permit as issued does not in any way imply an easement on private property
or grant a right to encroach on private property.
�, 8. Driving Limitations-No driving onto highway from ditch or driving on shoulders or over curbs where
� damage will occur. �
� 9. Lugs on Equipment-No lugs shall be used on equipment traversing Hennepin County roadways.
j 10. Insurance-The Permittee shall have in force during the operation of Permittee's vehicles and

� equipment over and/or adjacent to Minnesota roadways, (1) Commercial General Liability Insurance �
�� with each occurrence of$1,500,000 and general aggregate limits of$2,000,000, and (2)Automobile
Liability Insurance with combined single limit each occurrence coverage for bodily injury and property
i damage limits of$1,500,000. These are minimum insurance requirements. It is the sole responsibility
; of the Permittee to determine the need for and to procure additional insurance which may be needed �
i in connection with this Permit. If requested, a Certificate of Insurance must be provided naming I
� Hennepin county as certificate holder and as an additional insured for the Commercial General
Liability coverage with respect to operations covered under this Permit.
2. TRAFFIC CONTROL:
� I
� 1. All warning devices and barricades shall conform to the Minnesota Manual on Uniform Traffic
i Control Devices, current edition, and any and all updates or supplements thereto.
% 2. All warning devices, barricades, flagmen and equipment shall be provided by parties or
! organizations performing the work. Said devices shall be removed from the job site promptly upon
completion of work.
� 3. Standard warning devices and barricades and safety vests shall be kept clean and in good repair
� at all times. �

� 4. Detour on a County roadway requires ten (10)working days advance notice to the Permit Office. i
5. Execution: The Permittee shall use due diligence in the execution of the work authorized under �
I
this permit in order not to endanger or unnecessarily obstruct travel along the said highway. i
Operations shall be so conducted at all times as to permit safe and reasonably free travel over the �I
roads within the limits of the work herein prescribed. All safety measures for the free movement of
traffic shall be provided by the Permittee at its own cost.
3. GENERAL CONSTRUCTION I
', 1. Conformity to Laws-The installation shall be made in conformity with all applicable laws,
', regulations and codes covering said installations. All installations shall be made inconformity with
, regulations of governmental agencies for the protection of the public.
i 2. Americans with Disabilities Act-Any work in the County's rights-of-way that impacts any
! pedestrian facilities requires that the restoration of the pedestrian facilities impacted be restored to
I conform to current ADA requirements and standards.

' 3. Removal- If at any time the permitted structure of facility shall fail from any cause whatsoever, the
�� Permittee shall have the same removed or repaired immediately upon receipt of written notice to do
i �

'� 4. Existing Facilities-Applicant must protect all existing installations.
5. Cutting Trees-The permission herein granted does not confer upon the Permittee the right to cut, ,
iremove or destroy trees or shrubbery within the legal limits of the roadway or relieve Permittee from i
' obtaining any consent otherwise required from the owner of the property adjacent thereto.
6. Drainage-The existing drainage patterns shall not be altered unless approved by Hennepin County li
; Watershed District approval and drainage calculations are required if plan alters existing drainage I
�I patterns. �
� 7. Clean-Up- Street surface and roadside shall be kept clean, neat and presentable throughout
construction as determined by the Hennepin County Transportation Department. �
', 8. Dust Control-Shall be provided upon request of the Hennepin County Transportation Department. i
9. Trees and Vegetation- Burning or disking operations and or the use of chemicals to control or kill
j trees, brush and other vegetation is prohibited without Hennepin County approval.
� 10. Restoration- It shall be further understood that the Permittee will be responsible for maintenance
� or repair of any and all failures due to settlement, erosion, lack of vegetation growth, rutting or other
job related problems for a period of two (2)years after project completion and Notice of Work

�� Completion form has been received by Hennepin County. Permittee shall perform all said
� maintenance immediately after it has been notified of said deficiency. Permittee shall be responsible
for all costs and expenses related to said maintenance. Permittee's failure to perform said
' maintenance immediately will result in Hennepin Count, through its own forces or its contractors,
� performing said maintenance and billing Permittee for all costs and expenses related thereto. �
� Permittee shall make payment to Hennepin County within fifteen (15) days of receipt of said bill. ,

11. Permanent restoration plans must be submitted to the Permits Office prior to starting construction
for temporary restoration/winter stabilization for work occurring between November 1 st and April
30th.

I 4. RESTORATION
� 1. Damage to Roadway- If pavement, roadway or right-of way is damaged; same shall be restored, in
i a timely manner to its original or a better condition, at the sole expense of the Permittee. Permittee's
failure to correct such damage in a timely manner will result in Hennepin County, through its own
�'I forces or contractors, making said repairs and billing Permittee for all costs and expenses related

', 1. 1. Excavations shall be cribbed, sheeted and/or fenced when necessary, or as required by Hennepin �,

�, 2. Boring or Jacking- Installation of pipe under roadways and driveways, shall be jacked or bored as II
; designated by the Hennepin County Transportation Department. No road or driveway, including field
� accesses, may be crossed with a vibratory plow.
3. Liner or Casing Pipe-Shall be required for instailations exceeding 4 inches in diameter.
i 4. All crossings under a Hennepin County Road shall be a minimum of 60"deep unless prior
ipermission to cross at a shallower depth is received from Hennepin County.
5. Pressure Grouting-Shall be required as designated by Hennepin County Transportation
I Department. �
; 6. Manholes-All manhole covers, valve covers, etc. shall be placed one half inch lower than finished
igrade.
�� 7. The use of flow-able fill as a backfilling material is prohibited.
