Re: Unpermitted Land Alterations,Tree Removals, Fencing
3865 Bayside Road/ PID 05-117-23-23-0010
The City received an inquiry regarding land alterations, tree cutting and other miscellaneous work
on the property at 3865 Bayside Road, specifically on the southerly portion of PID 05-117-23-23-
0010. Staff conducted a site visit on October 7th and observed the following:
1. Tree Removal. According to a submitted Tree Log dated 5-19-16 approximately 8 trees
were removed and other vegetation clear cut from the property,some of which were within
the protected area 75 feet from the OHWL. Tree removal was verified by a site inspection.
According to City Code Section 78-1285 trees 6-inches in diameter or greater within 75 feet
of the lake are protected and a permit is required from the City for removal. I have attached
the received Tree Log for your reference.
2. Grading and Filling Activity. It appears there has been recent grading and filling activity
within the 10-foot lake access easement on the southern 10 feet of your property. This is
the easement area we discussed previously in our office. Some of the grading and filling
occurred within 75 feet of the lake and within 5 feet of the southerly lot line requiring City
approvals.According to City Code Sections 78-967 and 78-1286 a permit is required for this
activity. Please complete and submit the attached Zoning Permit application with a survey
and grading plan detailing the recent activity. Please provide a cubic yard calculation(please
separate into a total calculation and a calculation within the 75-foot setback).
3. Erosion Control. During the site inspection we observed areas of erosion and un-stabilized
soil. We also observed a small amount of seed germinating but was inadequate to protect
and stabilize the soil. The exposed areas must be immediately seeded and the slopes
covered with an erosion blanket or other similar method.
4. Fencing. Fence posts and welded wire fencing have been installed the �ength of the
property, I assume to define the 10 foot lake access easement area. The fence posts extend
to the lake. Additionally, there are four PVC posts which appear to also have been recently
installed within the 75-foot setback from the lake. According to City Code Section 78-1279
fencing within 75-feet of the lake is prohibited, and must be removed. Posts do constitute
"fencing".

*Conditions would include complete removal of tree and stump from proerty, by a qualified and insured contractor.
