Along the way the permit valuation changed to$3,250,000 per the contractor. The new plan review fee would have been $9,721.89 (See Exhibit B). Since this plan review was already entered and issued back in November when the permit was dropped off, they were only picking up and paying for the permit itself. This permit was entered in the computer correctly based off the new valuation. However, it wasn't adjusted to reflect the difference they had already paid, on the plan review. We adjusted the $130.00 difference on the base permit fee. They already had a check made out in the wrong amount, check #7818, on Receipt No. 3.001869 dated 12/15/09. Since the amount was such a big difference we are requesting the difference of$130.00 be mailed to the applicant. At the request of Charles Cudd Denova, I have prepared the HydroCAD report to verify the adequate sizing of the storm sewer constructed for the new home. The report shows for a back to back 100 year storm event, the 12" storm sewer and catch basin can handle the runoff from sub catchment area 1 S (3450 SF). The elevation of the window adjacent to this area is 960.9. Based on these calculations , the maximum elevation the water will raise during a back to back 100 year storm event is 960.32' (0.58 feet below the window opening). This does not account for the infiltration that will occur do to the rock placed around the storm inlet, so this calculation is a conservative analysis. I also based the calculation on a curve number of 98 —full impervious surface - for a conservative result. The report indicates the peak flow into the pipe is 0.55 cfs—but the pipe itself can handle up to 4.51 cfs. SCOPE OF WORK • CSG shall provide construction shop drawinas of the retainin�wall desibn for Client's submission to the engineer/architect of record. Three(3)sets of 11"x 17"size drawings are typically provided unless special arrangements are made. • CSG shall provide design calculations for the retaining wall design based upon the site infonnation furnished by the Client using standard design procedures and consistent with the standard skill and care of an engineer practicing in this profession. D. CLIENT RESPONSIBIILITY • Client shall provide CSG with full information regardina the project's desi�n requirements including but not limited to project plans and specifications, site topography data, special structural or loading requirements, geotechnical report and soil boring data, hydrological and flood plain data,and any special owner/governing agency requirements. CHANGES • Client assumes full responsibility and shall hold CSG harmless against any claims arising from any clianges made to the plans or specifications by the Client or person other than CSG unless Client has given CSG prior notice and has received written consent for such changes. • Changes requested after dra�ving and design preparation has been substantially completed may require additional compensation at the sole detennination of CSG. EXCLUSIONS • CSG shall not have control over or be held responsible for site inspection, testing, construction methods and procedures, or for safety precautions or prob ams in connection with the work. • CSG shall have no responsibility for any site or soil investigation required to determine the suitability of the adjacent or underlying material to support the retaining wall structure unless specifically otherwise provided in the scope of work. • CSG shall have no responsibility for structural design or detailing of items not directly related to the retaining structure unless otherwise provided in the scope of work. These items may include but are not limited to guardrails, light pole foundations, utilities,and storm drainage. G. TERMS • CSG shall invoice the Client for engineering services upon completion and submittal of the documents. Payment of each invoice is due and payable by Client within ten(10) days of receipt of invoice. Amounts unpaid thirty(30)days after invoice shall bear interest charges of one and one half(1'/z)percent per month. • In the event litigation of collection actions are necessary to enforce this agreement,then the prevailing party shall be entitles to recover its attorney's fees and court costs. TERMS • CSG Engineering shall not be held responsible for any damages or be held in default due to acts of God, war, riots, fire, flood, or other delays unavoidable or beyond CSG's reasonable control, delays caused by failure of Client or Owner's agents to furnish information or to approve or disapprove CSG's work promptly,or due to late, slo�v or fauity performance by Client,other contractors or engineers,or government agencies, the performance of those�vork is precedent to or concurrent with completion of CSG's work. • Due to disproportionate amount of risk involved as compared to the fee charbed, Client agrees to limit CSG's liability for any damages on account of error, omission,or other professional negligence to a sum not to exceed$50,000 or the fee, whichever is the greater. • Pre-Lien Notice: CSG is required by law to provide you the followin�notice: A. BUFFER IMPROVEMENT ESCROW AGREEMENT AGREEMENT made this ' S� day of December, 2009, by and between the CITY OF ORONO, a Minnesota municipal corporation("City") and Chad M. and Julie A. Lindbloom ("Owners"). Recitals A. The Owners are having a new house constructed at 2400 Fox Street in Orono (Lot 1 Block 1 Majestic Spruce Addition, Hennepin County, Minnesota). B. The construction of the house triggers the requirement that the buffer for the wetland in the northwest corner of the property be improved. The plan for this improvement was approved as part of the approval of the Majestic Spruce Addition. Owners may change this plan, subject to approval by the City's wetland consultant. C. City is requiring a security agreement to guarantee the required improvement of the buffer is successful. D. Owners agree to complete the buffer improvement in a timely fashion. Owners agree to provide financial security for this work by entering into this Escrow Agreement. E. The City has determined that this Escrow Agreement constitutes adequate assurances from Owners, sufficient to protect the City from potential damages and noncompliance with the Cit��Code. NOW,THEREFORE,THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the issuance of this the building permit, the Depositor shall deposit $500.00 with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee that the improvement of the buffer required as part of permit number 2009-00803 is completed properly and that any vegetation that does not establish successfully is replaced. A planting is deemed successful if there is at least one native plant from the seed mix per square foot in the seeded area. Areas where the planting is not successful shall be reseeded by the end of the growing season. The funds shall be spent by the City if Owners for any reason are unable or unwilling to honor the requirements of the City Code. Construction costs may also include engineering estimates and plans as well as labor and materials for any repairs or matters completed. 3. REQUIRED IMPROVEMENTS. The rec�uired improvement described on the Wetland Buffer Establishment and Management Plan dated September 24, 2008, drawn by Mike Brandvold of Anderson Engineering of Minnesota, as they pertain to Lot 1 Block 1 Maj estic Spruce. 4. DISBURSEMENT FROM ESCROW ACCOUNT. If the City suspects or knows of any matter cited above that is not completed correctly and in a timely fashion, it shall first make demand of the Owners to make any necessary repairs or to take other prudent remedial measures within a 5 day time period. If the Owners are unwilling or unable to honor its agreement as determined by the City, the City may draw from the Escrow Account, as necessary. The remedies afforded to the City under this agreement shall be in addition to any other remedies which the City may be entitled by law or equity or other agreement. 5. CLOSING ESCROW. The escrow, less any eligible expenses, shall be returned to the Owners two growing seasons after planting if the planting is successfuL If substantial portions of the plantings are not successful after one planting season the City may hold the escrow for an additional planting season. If substantial portions of the plantings are not successful after two planting seasons the City may hold the escrow for two additional planting seasons. 6. ACCESS TO PROPERTY. The owners of have granted to the City, its agents and its employees, the right to enter on the Property for the specific purpose of inspecting or completing the improvement of the buffer should the Owners not complete the work by the specified dates.
