We have reviewed the plans for the proposed new home construction at 2400 Fox Street. The
plans are dated 12-2-09. We have the following comments with regards to engineering matters:
• It is our understanding that the retaining wall extending northerly from the east wali of
the house will be integral to the foundation and be under the review of the building
official. This foundation wall will provide soil support perpendicular to the tiered
retaining walis.
• It is our understanding that double silt fence is already installed around the wetland
buffer area.
• The plans appear acceptable from an engineering standpoint.

In Darren's comment letter the words "culvert under" are missing from the 4th bullet point. We will have public
works inspect it right away so the City's work can coordinate with yours.
Here's the code section referenced in the 5th bullet point:
(2) For all subdivisions and commercial or industrial sites in which land disturbance activities will impact one
or more acres; or fill or excavate over 100 cubic yards, whichever is more restrictive; or any other site if
determined appropriate by the city Engineer due to potential impacts to wetlands, lakes, or sensitive receiving
waters.
a. Grading plan. A grading plan shall be provided that clearly indicates the proposed land disturbance
activities. Both existing and proposed topography shall be shown and have a maximum contour interval
of two feet. Drainage patterns shall be clearly shown using arrows depicting direction of flow. Other
information shall be shown as required by the city based on specific project characteristics.
b. Phasing plan. A phasing plan shall be provided that clearly indicates the areas in the order they are
to be disturbed and restored. The phasing plan shall consider minimization of area and duration of
exposed soil and unstable conditions, minimization of the disturbance of natural soil cover and
vegetation, erosion and sediment control measure installation, weather conditions and the schedule for
temporary and permanent restoration. The area and duration of each phase shall be indicated on the
plan.
c. Pond defail sheet. A pond detail sheet shall be provided for each proposed stormwater pond that
shows detailed pond design including normal water level, high water level, aquatic bench, maintenance
bench, outlet structures, emergency overflow locations and other project specific data required by the
city.
d. Standard detail sheet. A standard detail sheet shall be provided that consists of applicable
construction details for approved erosion and sediment control measures as developed by the city.
Other techniques may be used upon prior approval by the city with details provided by the designer.
e. Specifications. Written specifications for land disturbance activities such as product descriptions,
installation and maintenance procedures required by the applicant to carry out the project in
accordance with this chapter.
f. Stormwater pollution prevention plan as required under the NPDES stormwater permit issued by the
MPCA. The stormwater pollution prevention plan shall consist of three components:
(i) Temporary erosion and sediment control plan: Indicate the location of perimeter controls,
construction fence, temporary sedimentation basins, inlet protection, areas to be seeded, areas
to be mulched or blanketed, location of construction waste control (dumpsters, chemical
storage, concrete washout, portable restroom facilities, etc.) and all other required temporary
erosion and sediment control measures as described in section 79-9. This plan shall also
indicate staging of temporary erosion control measures.
(ii) Permanent erosion and sediment control plan: Indicates areas to be seeded and sodded,
sediment ponds, storm sewer systems and all other required permanent erosion and sediment
control measures. Permanent stormwater pollution controls including, but not limited to ponds,
vegetated buffers and structural measures shall be designed and constructed in accordance
with other chapters of the city Code and requirements of other agencies having jurisdiction.
(iii) Narrative: Describes, at a minimum, the nature of construction activity, person(s)
responsible for inspection and maintenance of site erosion and sediment control including

contact information, project phasing, schedules, along with the timing, installation and
, maintenance of erosion and sediment control measures and specifications necessary to carry
out the project.
(3) NPDES permit documentation: The property owner owner's agent shall apply for and be issued a
National Pollution Discharge Elimination System (NPDES) general stormwater permit from the
Minnesota Pollution Control Agency (MPCA); and shall submit to the city a copy of the MPCA
Certificate of Permit Coverage.
I have a copy of the wetland buffer plan for the subdivision. It shows the grading but does not include all the
grading specifications. Plus I'm not sure if it is what the MCWD approved. It would probably be for the best if
you obtained a copy from the engineer — Mike Brandvold at Anderson Engineering 763-412-4000 (13605 1St
Avenue North, Plymouth).
What may complicate matters is that the grading is for the MCWD. They seem to require a 35 foot buffer. I
don't know what they want/don't want in the buffer. The City requires a 25 foot buffer. We don't want horses in
the buffer; that's the reason the horse fence has to be moved.
I'll put the plan up front with your name on it. It will be in the "general paperwork to be picked up" drawer if I'm
not around.

Dear Melanie:
We have reviewed the plans for a proposed new home construction at 2400 Fox Street. The
plans are dated 11-10-09 with an emailed updated version received 1i-20-09. We have the
following comments with regards to engineering matters:
• It appears that the proposed retaining walls on the east side of the house are
approximately 10 feet high and the retaining walls on the west side are 7 feet high.
Engineered design and details should be submitted for review and approval for all
retaining walls over four in height, and for all tiered walls with a separation of less than
two times the wall height.
• The proposed grades between the driveway and Fox Street exceed the maximum
allowable 3:1. This must be revised.
• The proposed driveway connects to Fox Street at a low point where an existing culvert
crosses Fox Street. It appears the intent is to have a split driveway with two new
culverts under each leg of the driveway. The existing Fox Street culvert would be
between the split. We recommend a single driveway access point with a storm manhole
connecting the existing culvert to two new culverts extending to each side of the
driveway.
• We recommend that public works inspect the condition of the Fox Street and consider its
replacement if the driveway is constructed over it.
• This project will disturb more than 100 CY of material. Sediment and erosion control
information meeting the requirements of Orono's City Code 79-7(c)(2) must be
submitted. The minimum $2000 sediment and erosion control financial securiry should
be required of the owner for this permit.

I see from the table you emailed me that you haven't checked the buffer of these lots. I
doubt any work has been done. (Mr. Robinson really didn't want to have to move his horse
fence.) They are requesting a building permit on the vacant lot. I intend to require the
owners of this lot to escrow for the small buffer area on that lot. How much should this be?
(We have $6,000 from Mr. Robinson and I'm inclined to hold all of that to make sure we
have enough money to do the buffers if we have to.)
