Remarks:
I reviewed the Majestic Spruce Lot 1 on November 11, 2010. Both Lots 1 and
2 have a Wetland Buffer Establishment and Management Plan that is dated
October 10, 2008 (attached). This management plan was prepared on behalf
of the owners by Anderson Engineering of Minnesota, LLC to meet the
requirements of the City's wetland code at the time of the lot split.
There is a house being constructed on Lot 1. Existing Trees and Shrubs within
the wetland buffer that were to remain per the approved management plan
have been removed. Most of the wetland buffer vegetation has been removed
and sod has recently been planted in the buffer.
In order to be in compliance with the City's wetland code they need to remove
the turf within the buffer and follow the portion of the approved Wetland
Buffer Establishment and Management Plan that applies to their lot. This
includes:
1. Complete site prep and installation of native seed mix (BWSR U8).
2. Complete vegetative maintenance for 3 years
An escrow amount for $ 6,000 is recommended to cover the cost of buffer
development if not completed by the applicant and compliance checks.

understanding that we likely have two separate escraws fa each lot lot I should have a$1,800 escrow and Lot

At this point most of the required work hu been completed by the awner for Lot 2 (see photo documenration).
This indudes:
I. Moving the pasture fence to the upslope edge of the buffer of We�and A
2. Seeding the buffer of Wedand B
3. Creating storm pond per watershed requirements
There is still this�e that needs to be removed within the Buffer of Wedand A. This is required as part of the Gty
Wetland Lode and was listed as an activity on the approved Wedand B�ffer Management Plan submitted by the
landowner. I talked to the landowner for Lot 2 and he understands that the thisde will need to be removed prior
to the City being able to rewrn the $6,000 escrow. Once this is completed he will contact the City and we can
check to see if the work has been completed.
During a previous site visit the buffer of We�and B on Lot I wac converted to turf and mowed by the landowner
or builder. The builder was notified that this was not allowed. The mowing has �ased within the buffer. This
buffer has this�e that will need to be removed pria to the escrow being returned (see photo documentauon). I did
not get a chance to talk to the landowner of this lot

On April 27, 2011, John Sonnek signed a temporary Certificate of Occupancy escrow agreement and
deposited $10,000 with the City on your behatf. We have since issued the final certificate of occupancy
and as a result I began my research into the refunding of the temporary certificate of occupancy
escrow. My research found there is still an outstanding issue with the wetland buffer. I understand
from John Sonnek all the thistle had been removed, but since an inspection was not requested or
conducted at the time, we must wait until we are into the growing season to confirm compliance. As a
result, unfortunately, we are only able to refund $8,700 of the temporary certificate of occupancy
escrow to Charles Cudd, LLC. The remaining $1,300 is held to cover the outstanding wetland
compliance.
Please sign the modified escrow agreement showing the amount remaining in escrow ($1,300) to be
held in conjunction with building permit 2009-00803 and return it to us as soon as possible. The $1,300
will be added to the existing $500 escrow for a total wetland compliance escrow of$1,800.
After May 15 or when this seasons growth is 12 inches a wetland buffer inspection can be requested.
After our wetland specialist visits the site to verify compliance, and I verify pass-through bills have been
paid, the escrows can be refunded.

I have verified with our engineer and it appears each of the remaining engineering concerns have been
addressed; thank you.
John Smyth, our wetland specialist, visited the site in August of 2011 at which time he noted thistles within the
buffer. According to Permit No. 2009-00803, the City will not grant a CO until the wetland buffer has been
inspected (and approved) a copy of the permit is attached. The thistles are the remaining wetland buffer item
to be resolved. One of the recommended control methods for Canada thistle is the combination of mowing
(one time in June) and spot spraying in late fall or early next spring. According to this, the thistle eradication will
take a growing season and can be verified as early as late Fall or early Spring of 2013.
We currently hold a $500 escrow for wetland buffer improvements. In order to refund the temporary CO escrow
we will require an additional $1,300 from the property owner to be held for the thistle removal (buffer
improvements) for a total of$1,800 until the buffer is in compliance. Additionally, a revised wetland buffer
escrow agreement will need to be signed by the property owners.
With the revised escrow requirement we can either release the difference of the TCO escrow ($8,700) or the
property owners can submit a check for the $1,300 balance separately. Let me know how you want to proceed
and if you have any questions. If there is an alternative thistle removal/eradication method you suggest please
let me know so we can discuss.

Canada thistle(Cirsium arvense)thrives in sunny,disturbed sites.It can invade upland habitats such as prairies and
savannas as well as wetland habitats such as sedge meadows and wet prairies.Seed of this thistle are dispersed by
wind and can remain viable in the soil up to�0 years.Once established,the plants spread rapidly by rhizomes or root
segments.Mechanical and chemical control strategies are often used in combination for Canada thistle control. Con-
ducting late spring burns is beneficial during the first three years of the control effort.Canada thistle can be treated
with Transline,Stinger or Milestone herbicide in mid-June prior to flowering.
Canada thistle is a perennial,while plumeless and bull thistles are biennials.The biennial thistles can also be treated
with Transline,Stinger or Milestone or they can be cut or clipped.These biennials normally produce only rosettes
(no flowering)the first year and then flower the second year.Clipping the buds off just as flowers begin to open the
second year should prevent them from going to seed.Over time biennials will be out-competed by upland grassland
species.Unless patches are very large,it is recommended that herbicide be applied selectively with back-pack spray-
ers,becauseTransline and Stinger affect composites and legumes,both of which are components of upland prairie
and woodland edge plantings.
Mechanical Control-Hand pulling or cutting only work well if done frequently during the summer months.It is best
if cutting/pulling occurs at least three times in the summer;once in June,once in August,and again in September.
Due to persistence of seed bank in heavily populated areas,pulling or cutting alone may not be entirely effective.
Chemical measures or burning may be required during subsequent springs,depending on quality of habitat and
nature of site.Another alternative,in sites that are larger and fairly disturbed,is to mow as close to the ground as pos-
sible while the plant is in full bloom(June through late August).Mowing should be done at least once a year and will
have to be repeated for several years thereafter.Some evidence has shown that mowing alone may be effective in the
northern part of the state but mowing and chemical treatment is generally needed further south.
Chemical Control-Chemical controls are not recommended in high quality habitats as damage to native plants
can be worse than damage to thistle.If absolutely necessary,chemical control methods are effective only if done at
the proper time.Chlopyralid or Aminopyralid herbicides are typically used for Canada thistle control. In high quality
habitats that have a substantial infestation,careful wick or spot spray application of a Clopyralid formulation is recom-
mended. Chemical control is often conducted in restored sites in combination with mowing.See the discussion of
"Combination Methods"below for specific recommendations.
Prescribed Burns-Fire is best when used in late spring(early May to early June).If the burn is done too early it may
actually promote growth of Canada thistle and other invasives.Burns should be once a year for at least three years to
see significant reductions in dense populations. The impact on other species should be assessed for spring burns that
will be conducted during subsequent years.
Combi�ation of Methods-Whenever possible,spot treatment of thistle is recommended to minimize impact on
native forbs.In situations where thistle covers large areas or stands are comprised of native grasses,a combination of
mowing and herbicide application can be used.Mowing is conducted in early June when thistle is in the bud stage.
Mowing at this time of year will reduce the plants energy reserves.Herbicide treatment is conducted in the fall after
the second hard frost,commonly with Aminopyralid(Milestone)herbicide at a rate of S-7 oz.per acre.Waiting until

after frost allows some native species to go dormant minimizing impact to native forbs to some extent.This technique
should not be conducted until after the second year of establishment. It can be helpful to conduct a fall burn a couple
of weeks after the herbicide application followed by seeding with native forbs.Having native grasses and fast grow-
ing forbs in the mix will help to out-compete any returning thistle the following spring.Additional treatments may be
needed in subsequent years.

Crown vetch(Coronilla varia)was initially introduced as an erosion control plant for road sides and waterways.It is still
being sold as a green fertilizer crop and easily moves into adjacent areas that have been disturbed.Crown vetch can
be found in disturbed prairie remnants,woodland edges,and other disturbed edges of roads and waterways.Piant
spreads vigorously by rhizome and seed.
Bird's-foot trefoil(Lotus corniculatus)is very similar to Crown vetch in that it was used for erosion control.It,too,in-
vades disturbed sites and edges through seed and root systems,but can also spread by above-ground runners.Bird's-
foot trefoil is also tolerant of a wider range of soils and precipitation conditions.
The below control methods apply to both Crown vetch and Bird's-foot trefoil.
Mechanical Control-Smaller populations can be controlled by repeated hand pulling in sandy or moist soils.Larger

Melanie I talked with John Smyth on Tuesday about what was done in the wetland buffer .
To stabilize the soil we first used no mow fescue grass and then seeded in the buffer seed mix
(BWSR U8 ) . He was ok with that as a first step, what we will do to follow is put up 3 buffer
signs, then we will have a bag of seed mix kept at the house for reseeding in the spring and fall ,
and the homeowner will have their lawn service pick the weeds in the buffer area so the seed will
flourish. I am attaching the as-built survey, a blow up of the area, and some pictures. Please

In November prior to the heavy snowfall, city staff performed an inspection to finalize the Majestic Spruce plat
wetland buffer compliance component. Staff observed the wetland buffer improvements as required with the plat
of Majestic Spruce had not been completed. Majestic Spruce plat is the subdivision application which created the
separate lots at 2400 Fox Street and 505 Willow Drive South.
Lot 1 (2400 Fox Street) contains a manage 2 classification wetland which requires a 25' buffer. The plat triggered
the buffer improvement requirement in Orono's wetland regulations. As part of the plat approval a Wetland Buffer I
Establishment and Management Plan was submitted and approved. As part of this Plan existing trees and shrubs
located within the 25' buffer were to remain. Upon inspection it appears that the trees and shrubs have been I
removed and replaced with turf grass or sod. In order to bring the property into compliance with the wetland I
buffer requirements the turf grass must be removed from within the required buffer areas and re-vegetated with a �
native seed mix(BWSR U8) according to the approved Plan and City Code section 78-1605(3).
This letter is your notification that your property must be brought into compliance with the approved Plan and City
wetland regulations. Please submit a planting plan which conforms to the approved Plan for review and approval. '
This plan should be submitted by January 28, 2011. Please be advised, if you fail to comply with the wetland
buffer requirements, the City will enter the property and fulfill the requirements. The City continues to hold the
escrow deposit associated with the Majestic Spruce project. Any costs to bring the property into compliance in ,'
excess of the escrow will be assessed to your property.
I have attached copies of the Majestic Spruce final plat resolution, memos from John Smyth, the City's wetland ,
specialist and the wetland buffer conservation easement and covenant documents, as well as the relevant ,
wetland code sections for your reference. �

Buffer�ondition and Aequirements
The plan indicates seeding o( the buffer o(Wetland B but not the buffer of Wetland A. The years o(grazing have I

Aestriction and Covenant for Wetland and Buffer II
Per Section 18-161I of the wetland ordinance the owner shall record Restriction and Covenants over the wetland
and buffer with the property chain of title. A form with the language for the Restriction and Covenants is �
available from the City. '

Wetland Bufier Markers
formal bufier marlcers are not required for the proposed activity under the Ordinance, however it is recommended i
that the bu(fer is marlced by the applicant so they can be avoided tluring native vegetation development and for
review during the vegetation establishment period (approx. 2 years).
Wetiand Water Quality Treatment Requirements
A pond has been added along with the buffer. This meets the water quality requirements for the property.
Recammendations
It is recommended that this application be approved with the condition that Wetland A be seeded with the same
mix and follow the same establishment and maintenance procedures as the buffer of Wetland B. An escrow
amount for $ 6,000 is recommended to cover the cost of buffer development if not completed by the applicant and
compliance checics.

I reviewed the Majestic Spruce Lot 1 on November 11, 2010. Both Lots 1 and I

In November prior to the heavy snowfall, city staff performed an inspection to finalize the Majestic Spruce plat
wetland buffer compliance component. Staff observed the wetland buffer improvements as required with the plat
of Majestic Spruce had not been completed. Majestic Spruce plat is the subdivision application which created the
separate lots at 2400 Fox Street and 505 Willow Drive South.
Lot 1 (2400 Fox Street) contains a manage 2 classification wetiand which requires a 25' buffer. The plat triggered
� the buffer improvement requirement in Orono's wetland regulations. As part of the plat approval a Wetland Buffer
Establishment and Management Plan was submitted and approved. As part of this Plan existing trees and shrubs
� located within the 25' buffer were to remain. Upon inspection it appears that the trees and shrubs have been
' removed and replaced with turf grass or sod. In order to bring the property into compliance with the wetland
buffer requirements the turf grass must be removed from within the required buffer areas and re-vegetated with a
native seed mix(BWSR U8) according to the approved Plan and City Code section 78-1605(3).
This letter is your notification that your property must be brought into compliance with the approved Plan and City
wetland regulations. Please submit a planting plan which conforms to the approved Plan for review and approval.
This plan should be submitted by January 28, 2011. Please be advised, if you fail to comply with the wetland
buffer requirements, the City will enter the property and fulfill the requirements. The City continues to hold the
escrow deposit associated with the Majestic Spruce project. Any costs to bring the property into compliance in
excess of the escrow will be assessed to your property.
I have attached copies of the Majestic Spruce final plat resolution, memos from John Smyth, the City's wetland
specialist and the wetla�d buffer conservation easement and covenant documents, as well as the relevant
wetland code sections for your reference.

Remarks:
I have received and reviewed the plan dated October 14, 2008 for 505 Willow Drive and this memo represents an
updated memo based on those plans.
Buffer Condition and Requirements
The plan indicates seeding of the bu(fer of Wetland B but not the buffer of Wetland A. The years of grazing have
impacted the vegetation of the buffer of Wetland A and it should be seeded with the same mix and follow the
same establishment and maintenance procedures as the buffer of Wetland B.
The proposed seed mix and buffer establishment and maintenance plan meets the requirements of the Wetland
Ordinance.
Survey Requirements
Requirements have been met.
Restriction and Covenant for Wetland and Buffer
Per Sectiod 78-I61 I of the wetland ordinance the owner shall record Restriction and Lovenants over the wetland
and buffer with the property chain of title. A form with the language for the Restriction and Covenants is
available from the City.
Wetland Buffer Markers
formal buffer markers are not required for the proposed activity under the Ordinance, however it is recommended
that the buffer is marked by the applicant so they can be avoided during native vegetation development and for
review during the vegetation establishment period (approx. Z years).
Wetland Water Quality Treatment Requirements
A pond has been added along with the buffer. This meets the water quality requirements for the property.
Recommendations
It is recommended that this application be approved with the condition that Wetland A be seeded with the same
mix and follow the same establishment and maintenance procedures as the buffer of Wetland B. An escrow
amount for $ 6,000 is recommended to cover the cost of buffer development if not completed by the applicant and
compliance checks.

Sec. 78-1605.Wetland buffer areas.
(a) This subsection establishes requirements for wetland buffer areas around protected wetlands.
Buffer areas are necessary and beneficial to maintain the health of wetlands. Buffer areas protect
the edge of wetlands from erosion while filtering sediment, chemicals and other nutrients from
runoff that drains into wetiands. Buffer areas can improve the biological diversity and health of a
wetland environment while reducing the adverse impacts of human activities.
(b) Buffer areas regulated by this section are areas of vegetative cover that are upland of the wetland
edge, and that occur in a natural condition or through restoration. Buffer areas consist of
shrubbery and trees, native grasses and/or forbs that are not mowed, fertilized or manicured in
any manner. Mowing, fertilizing, manicuring, or vegetation removal within a buffer area is not
allowed unless the city has issued a permit for such activity in conjunction with an approved
buffer management plan.
(1) Acceptable buffer areas shall have the foliowing qualities:
a. A continuous dense layer of perennial grasses that have been uncultivated or
unbroken for at least ten consecutive years, or
b. An over story of trees and/or shrubs with at least 80 percent canopy closure that
have been uncultivated or unbroken for at least ten consecutive years, or
c. A mixture of the plant communities described in a. and b. above, which have
been uncultivated or unbroken for at least ten consecutive years.
(2) Unacceptable buffer areas have the following qualities, including but not limited to:
a. Undesirable plant species (inciuding but not limited to reed canary grass,
common buckthorn, purpie loosestrife, leafy spurge and noxious weeds), or
b. Lacking a layer of organic thatch or duff, or
c. Topography which tends to channelize the flow of surface runoff, or
d. Is characteristically unlikely to retain nutrients and sediment.
(3) Buffer areas which have been broken or cultivated within the past ten consecutive years
must be restored to a condition consistent with an acceptable buffer area defined in
section 78-1605(b)(1), a restoration or landscape plan must be submitted to the planning
director, which restoration shall include, replanting and maintaining according to each of
the following guidelines:
a. Buffer areas shall be pianted with a seed mix containing 100 percent perennial
native plant species, except for a one-time planting of an annual nurse or cover
crop such as oats or rye.
b. The seed mix to be used shall consist of at least 12 pounds pure live seed (PLS)
per acre of native prairie grass seed and five pounds PLS per acre of native
forbs. Native prairie grass and native forb mixes shall contain no fewer than four
and five species respectively.
c. The annual nurse or cover crop shall be applied at a rate of 20 pounds per acre.
d. Native shrubs and or trees may be used in addition to forbs and grasses. Shrubs
shall be distributed so as to provide a natural appearance and shall not be
planted in rows.
e. Native prairie grasses and forbs shall be planted by a qualified contractor.

f. No fertilizer shali be used in establishing new buffer zones, except on highiy
disturbed sites when deemed necessary to establish acceptable buffer
vegetation and then limited to amounts indicated by an accredited soil testing
laboratory.
g. All seeded areas shall be mulched immediately with clean straw at a rate of one
and one-half tons per acre. Mulch shall be anchored with a disk or tackifier.
h. Buffer areas (both natural and created), shall be protected by silt fence during
construction and the fence shali remain in place until the area crop is
established, and at that time the fence shall be removed.
(c) Buffer area widths will be based on the wetland protection strategies estabiished in the Orono
Surface Water Management Plan (SWMP) (December 2002). A protection classification has been
assigned to each wetland in Orono based on the stormwater susceptibility and functional
assessment for each wetland. The four protection classifications are described as follows:

The protection classification for each wetland will be found on the "Wetland Management Classification Map &
List" which is hereby adopted by reference, a copy of which shall be kept on file in the office of the city clerk and
shall be available for public review during all normal office hours. The following are the required buffer area widths
for each protection classification:

(d) In cases of new development or redevelopment the city shall require that vegetation in the
wetland buffer be installed prior to the issuance of the certificate of occupancy. The city may
waive this requirement in lieu of a cash escrow or letter of credit equal to 150 percent of the cost
to install the required buffer.
(e) The city may allow the disturbance of an existing buffer area during the course of construction
activity. This disturbance must be kept to a minimum, soils must be decompacted to a level that
will accommodate root growth, and the buffer area must be re-established as required by the city.
The city will determine the amount of allowable disturbance. The city may require a cash escrow
or letter of credit equal to 150 percent of the cost to re-establish the buffer to its original condition.
(� The city may require buffer area planting and maintenance when the city determines that there is
inadequate vegetation in the buffer area to meet the intent of this section. The city may require a
cash escrow or letter of credit equal to 150 percent of the estimated cost of the vegetation and
installation. The escrow or letter of credit must be valid for up to two years and may be used by
the city to replace any vegetation that dies.
(g) The affected property owner or homeowner association that is responsible for the maintenance
must:
(1) Maintain and repair damage to buffer areas from such activities as mowing, cutting,
grading or other prohibited activities, unless mowing is approved by the city as a buffer
management plan. Permission must be obtained from the city before implementing buffer
management plans, which may include mowing, burning, and the use of herbicides.
(2) Maintain only the permitted vegetation in the buffer area and must remove all noxious
weeds and invasive, non-native species such as European buckthorn, upon obtaining a
vegetation removal permit from the city in conjunction with an approved buffer
management plan.
(3) Ensure that all soil surfaces in the buffer area are planted with the permitted vegetation
and that there is no open soil surface that may result in erosion.
(4) Ensure that livestock or other domesticated animals which have the potential to
permanently disturb the buffer area by compaction or vegetation removal be kept from
entering the buffer area and wetland by a fence or other suitable means.
(h) The final upslope edge of the buffer shall be provided to the city in a hard copy and in a CAD or
GIS format in Hennepin County coordinates.
(i) Golf course partial exemption. Pubiic and private golf courses existing and in operation on the
date of adoption of this article shall be aliowed a partial exemption from buffer creation and
maintenance requirements with regards to mowing or cutting buffer vegetation in areas subject to
golf play, subject to the following:
(1) At such time that this article requires establishment of a buffer, applicant shall submit a
certificate of survey identifying the location, size and type of the wetland for which buffer
exemption is requested.
(2) Applicant shall submit a buffer management plan for city council approval, identifying
those areas where exemption is requested and providing for alternative methods of
wetland protection equivalent to an unmowed buffer.
