A. Constructing, installing, or maintaining anything made by man, including but not

clothes Iine poles,playground equipment,roads,hardcover of any kind,
underground utility lines anci distribution equipment,light poles,traffic signals,
traffic regulatory signs, mailboxes;except: 1) €eeders,bird houses,and other
devices intended ta foster witdlife; and 2} docks or boartiwalks when allowed by
City ordinance and under a valid Ciry petmit.

� � 3. Establ'sshrnent and Maintenance of Wetland Buffer. The wetland buffer, as shown in
� F.xhibit A, shail be established and impmved when required by City Ordinances to
become an"acccptable buffer area"as described wit�in City Ordinances, arsd shall
� thereafter be�naintained hy Grantor in perprtuity free from mowing or oiher vegetative
disturbance,fertilizer application,yard ar other waste disposat,thc placement of
structures or any ather alteration that impedes the function of ttze buffer irc protecting the
quality of water in the wetlarid or buffering flows into the wetland.
4. Crrantor for himself, his heirs,successars and assigns,furth�r grants the City the afiimza�ve
right,bnt not the obligation to do the f�ltowing on the easement premises:
A. Preserve, impmve, and enhance the slo�,trees, vegetation,and aatura�habitat by
altering, ctearing, and removing trees or ather vegetation, by changing the contour
�I of the land,and by planting trees or ather vegetation.
� B. Enter upon the easement premises at any time to enforce eocnpliance��ith the
terms of this instrument.
j 5. Grantor reserves for hirnself and far his heirs, successors and assigns and his invitees,the
i right to enter upon the easement premises and to do and perfarm on the easement
premises such ac�as are not inconsistent with the easement rights granted to the City '
', herein. Such uses shall be deemed to include,but not be Iimited to plattting af trees,
flowers, and other vegetation consistent wiih a conservation easement; wal�:ing alang ,
� trai�s and paths; bird watching; the study of natwe; and ai1 other acts of a similaz nature ;
or purpose. �

6. Grantor hereby grants, gifts, qt�it claims and conveys to the city , a g�rpetual flowage I
� easement and right a.nd privilege to trespass with water over and upon any or all of th�
Easement Premises. �
7. Grantor herein does hereby remiss,release, acquit and forever discharge, forever, the City I'�
