APPROVING THE PLAT QF
MAJESTIC SPRUCE ADDITION
�ILE NO. 08-3385 •
WKEREAS,the City of Orona is a municipal corparation ar�anized and existing
under the�aws of the State of Minnesot�; ar►d
WHEREAS, the Ciry Counci3 of the City of Orona (hcreinaftcr "City Council")
has adopted subdivision and land development regulations for th� orderly, economic and safe
development of land within the City; and
WHEREAS, the City Council has considered the appiication by WiIliam G.
Robinson (hereinaftcr thc "Subdivider") for subdivision of property located at SQS Willow Drive
South and legaliy described as:Lot S Auditor's Subdivision No. 229,Hennepin County,Minnesota
(hereinafter"the Property"); and -
WHEREAS, on Sept-mber 22, 2008, the City Couneil adopted Resolutian 130.
5771 �antinb preliminary ptat appraval for the propased two lot residential subdivision; and
V1'I�iEREAS, the Subdivider has completed thc following requirements of the
p�atting reb laEivns of the City;
1. Payment ta the City of nnal p:at review fees and l�gat re�riew and filing fees. i
2. Provtsion to the City of a title opinion for the Property and certified copies of atl record�d
easements currentty afr'ecting the Property.

3. Inclusion on the plat of Drainage, and Drainage and Utility Eas�nents and right of way for
Fox Street as required in Resoyution No. 5771 . I

WHER�AS,the Subdivider has agreed to comp}ete the foliowing requirernents of ;

2. Payment of a Storm Watcr Trunk and Drainage fee of�25,60Q.

Wetland Bafier for tne wetland and wetland buffer within.
4. Providing an esGrow a�eement and �6,000 escrow to guarantee improvement of the
wetland bu�er areas on L.at 2.
� 5. Execation of a Pratective Cavenant ior Drainfield Sites.

i6. Providing an escrow ageernent and an escrow equal to 150%of the estima.ted cost or 110%
of the contracted cost to guarantee replaeerrtent of the septic system on Lot 2.

; Maj-stic Spruce Additian, a copy of which is attached as Exhibit A, subjcct to the foltowing ,
I conri'rtions:
I� 1. The City C}er�:shall rclease the pfat documents for filing onjy npon certincation by the City
Attarne Ci Pianner and Cit En 'neer that all
i Y, t}' y � requirements of fne platting regulations ,
' have been satisfied and that thc Nfinnchaha Creek VJatershed District has �anted �
con�itional approval of any required permit(s).
� 2. Thc aforesaid plat shall be filed with I�rnnepin County on o:before 4pril 2Q,2009 together
I with a certified original copy of this resolution and execated copies af the easement and
covenants pe�rtin�t thereto.

The approval granted by this Resolution sha11 expire if the condi#ions of this
; Resolution havc nat been met or the plat has not been filed by the date specined above. In tha? '
