On May 26, 1995 Mr. Kelly filed a subdivision application with the City to divide his property into two lots. Orono Municipal Code Section requires property owners to hire a certified septic site evaluator to do testing and identify two suitable septic sites for each property, a primary site to be used now and an alternative site to be used some time in the future. Mr. Kelly contracted with Koch's Soil Testing to do the work. When Mr. Koch tested the area around the existing system, it was found to be non-conforming. The soil contained mottling at approximately 2' below the surface. State code requires a minimum of 2' separation between the bottom of the treatment area and mottled soil. The 2' minimum is required to provide adequate treatment of the effluent before it reaches the mottled soil. Mottled soil is an indication of where the water table is in wet seasons. The lack of separation means the ground water is being contaminated by untreated effluent. Mr. Kelly's subdivision was approved by Resolution #3660 based on certain conditions, one of which was listed at No. 2 which states: "Prior to the City issuing a Certificate of Occupancy for the new residence on Lot 2, the existing non-conforming septic system must be abandoned that currently serves the residence on Lot 1. The subdivider and future owner of Lot 1 are hereby advised that a new septic system must be installed to serve the existing residence on Lot 1 prior to occupancy." See attached Resolution. DESCRIBE HOW During routine inspections. MATTER CAME TO ATTENTION: DATES AT SITE: 9/24/96, 9/26/96. ADMISSIONS: Left attached note near building inspection cards on site. Admitted to Mike Gaffron he had installed the septic system without a permit (see attached Mike Gaffron memo). DESCRIPTION: See attached. WITNESSES: Bruce Vang, Steve Weckman, Jeanne A. Mabusth DESCRIBE SIMI- Mr. Kelly admitted to installing a septic system without a permit in the past. LAR VIOLA- See attached memo from Mike Gaffron. TIONS OR CONTACTS ACTION TAKEN: Referred to City Attorney for formal complaint on October 1, 1996. ch On September 24, 1996 I joined Steve Weckman on an inspection of a septic system on 2340 Fox Street (Mr. Kelly's existing house property). During this inspection we noted white pipes protruding from the ground at 2620 Fox Street (Mr. Kelly's new home site). These pipes were between the new home and the existing septic system and all were connected by disturbed earth. It was apparent that the new house was connected to septic tanks below the pipes and to the existing non-conforming septic system. On October 25, 1996 I wrote a letter (attached) to Mr. Kelly informing him of our concerns and notified him that the City will not issue a certificate of occupancy until the property meets all current code requirements. On September 26, 1996 Bruce Vang, Field Inspector, was called to the site for a final plumbing � inspection. After completing the inspection he found a note (attached) posted with the building permit inspection cards stating "To Whom It May Concern: I gave Bruce Kelly permission to build this system according to his specifications and their agenda" signed by the Governor of the State of Anarchy. I joined Bruce Vang at the site and posted a "Stop Work Order" and sent away all persons working on the property. On September 30, 1996 Bruce Vang visited the site and found Mr. Kelly had removed the stop work order and moved into the house. Mr. Kelly is in violation of the following: 1) Connecting a new dwelling to a non-conforming septic system, violation of Orono Municipal Code Section 12.30, Subd. 4(A). 2) Installation of portions of a septic system without a permit, violation of Orono Municipal Code Section 12.08, Subd. 1 and without required inspections, Section 12.08, Subd. 3. 3) Noncompliance with conditions of Resolution#3660, violation of Orono Municipal Code Section 4) Removal stop work order, violation of Orono Municipal Code Section 5) Occupancy of building without Certificate of Occupancy, violation of Uniform Building Code Section 109.1 and Orono Municipal Code Section 12.08, Subd. 8. The City's objective is to require Mr. Kelly to: 1) Obtain a permit and install a complying septic system. 2) Arrange a final inspection, comply with any corrections and obtain a Certificate of Occupancy. 3) Assess a fine to help cover court costs.
