Melanie,
I have reviewed the application for the proposed addition on the house and have the following comments:
• There is a wetland classified as "Preserve" which covers the northern portion of the property. This project will
disturb more than 50 cubic yards of material and will trigger Orono's wetland buffer requirements. Therefore,
the applicant will need to get a wetland delineation performed and approved by the City's consulting engineer
Bolton & Menk.
• With a preserve wetland,there is a required 50' buffer and 20' structure setback(70'total from edge of
delineated wetland boundary). The applicant will either need to plant a new buffer zone or have the existing
buffer(if there is one) inspected and approved by Bolton & Menk. The survey needs to be updated to reflect
the buffer and structure setbacks.
• The current retaining wall plan does not show walls which exceed 4' in height. If changes are made and the wall
exceed 4' in height or if tiered walls exceed 4' in height and are not separated by more than 2x the height of the
walls (measured from the face of the upper wall to the back of the lower wall), the applicant will be required to
have the walls designed by a registered professional engineer.
• The survey should show the erosion control and there will be a $2,000 escrow associated with the erosion
control.

Hi Mark,
Please perform a site visit at 2280 Fox Street for permit#2012-00728. The addition to the principal structure is
over 200' from the wetland, but still triggers our wetland buffer improvement requirements. Please review the
wetland and wetland buffer and submit a report to me regarding the location of the staked boundary, the
condition of the buffer vegetation and if improvements are necessary as well as an escrow amount (if
necessary) by August 28th if possible. The wetland edge will be staked today by the surveyor please indicate if
you agree with this boundary. We will require the property owner to show the edge of the wetland and the
buffer on an as-built survey. Please tell me when you will be able to visit the site so I am aware; thank you.

Per our conversation, attached is a copy of the correct building permit application for the project at 2280 Fox
Street. Please complete and return at your earliest convenience.
Also, built into the building permit fee is a $500 credit for engineering review. If engineering costs exceed
$500, the cost is passed through to the property owner to pay. To ensure all pass-through bills are paid, we
require an escrow agreement to be signed and submitted with a $2,500 check. The escrow is also held during
the building permit process to ensure erosion control is in properly established on site at all times.
Attached is the building permit escrow agreement. Please have the property owner sign and return with a
check for $2,500. We will need this agreement and funds before our wetland specialist will be able to perform
a site inspection. Once the project is complete and all requirements have been meet, the escrow money is
returned in its entirety.

Dear Ashley:
As requested, we designed new structural members for the above referenced project. We have designed the
new members using a roof and floor dead load of 15 psf, a roof snow load 35 psf, and a 40 psf floor live load
in accordance with the Minnesota State Building Code. Our work only includes designing the new members
as shown at the above reference project and is based on drawings provided by you.
Attached are 6 framing sheets with annotated framing notes and 1 detail sheet showing the new members
and connections. All framing shall be shored and temporarily braced as required by the contractor and all
minimum nailing shall be in accordance with IRC Table R602.3(1). Lumber shall be minimum #2 SPF with
treated lumber to be #2 S. Pine and engineered lumber to have Fb = 2600 psi with E = 1.9. Our calculations
assume all lumber is of good quality and does not have large splits and checks and shall be visually
inspected by the contractor at the time of construction. All fasteners in contact with treated lumber shall be
G185 hot dipped galvanized or equal. Steel wide flange beams shall meet ASTM A992 and rebar shall be
grade 60.
Concrete used for footings (4"slump) and masonry core grout (8" slump) shall have a 28 day compressive
strength of 3000 psi. The new footings have been designed as a typical spread footing based on a
presumptive load-bearing value of 2000 psf in accordance with Table R401.4.1 of the IRC. The existing
footings have been assumed to be typical spread footings on good soils that are assumed to be performing
adequately. The contractor shall also verify the condition of structural members and foundations affected by
the remodeling. Exterior grade shall slope away from the building and gutters with long downspouts should
be used whenever possible. Foundation backfill shall be granular and the foundation system is assumed to
have drain tile.

When installed as indicated above, the new framing members and foundations shown on the attached sheets
shail support the loads as required in accordance with the Minnesota State Building Code. If you have any

BUILDING PERMIT ESCROW AGREEMENT

AGREEMENT made this Z� day of , 20�r, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City")and Lynn & ders Myhran ("Owners").
Recitals
1. A building permit application has been filed for an addition to the principal structure located at
2280 Fox Street the ("Subject Property"), legally described as Lot 2, Block 1, Bill Kelley's Land First Division,
Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2012-00728 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Ow P$, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to ertify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work

Recitals
1. A building permit application has been filed for an additionlremodel at 2280 Fox Street the
("Subject Property"), legally described as Lot 2, Block 1, Bill Kelley's Land First Division, Hennepin County,
Minnesota.
2. The City has reviewed and approved this application.
3. The scope of the project which is the subject of building permit #2012-00728 triggers the
application of the City's wetland buffer requirement as established by City Zoning Code Article XI Wetlands
Protection will commence its review of the application and incur costs associated with said review only 'rf the
Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:

3. MONTHLY BILLING. As the City receives consuftant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.

In order to expedite the issuing of the building permit for 2280 Fox Street, the contractor,
Kuhl Design+Build, LLC paid a $5,000 wetland buffer establishment escrow. Mark Perry's
report dated August 30, 2012 states the cost to cover the buffer development is $1,000.
Please refund $4,000 to Kuhl Design+Build, LLC.

Dear Christine:
As requested,we have reviewed the wetland boundary and buffer area at 2280 Fox Street. We offer the
following observations, comments and recommendations for your consideration.
1. I reviewed the wetland boundary in the field on August 22,2012 and agree with most of the wetland
boundary as marked. One of the flags near the east end of the boundary line appeared to be off by just
a few feet. However,this will not impact the wetland buffer zone in relation to the project. Refer to
the attached GIS map showing my determination of the wetland edge.
2. An"as-built"survey of the project, indicating the wetland edge and the buffer edge,will suffice for
City records.
3. This wetland is listed as a"preserve"wetland in the MCWD inventory, which requires a 50 foot buffer
per City code. The buffer was not marked in the field, so I examined the entire area between the
wetland edge and the existing fence(about 100 feet apart). A good stand of native vegetation
dominated by Green Ash, Sumac,Canada Golden Rod and Raspberry exists in this area. I also
observed a very small percentage of Canada thistle,which will need to be controlled.
4. The proposed addition has the potential to adversely impact the wetland which will trigger the wetland
protection ordinance requirements. Therefore,the following should be considered:
a. The wetland will require a 50 foot buffer.
b. Canada thistle was found in the wetland buffer area and is considered to be an undesirable
plant species. A plan including methods for removal and control of the Canada thistle should
be submitted far review.
c. Wetland Buffer markers should be placed at the upland boundary of the buffer edge located at
lot lines and changes of buffer edge direction and spaced a maximum 200 feet apart.
d. A $1,000 escrow should be submitted by the Owner to cover the cost of buffer development if
not completed by the applicant.

WETLAND BUFFER ESTABLISHMENT ESCROW AGREEMENT

AGREEMENT made this Z� day of , 20�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Lynn &Anders Myhran ("Owners").
Recitals
1. A building permit application has been filed for an addition/remodel at 2280 Fox Street the
("Subject Property"), legally described as Lot 2, Block 1, Bill Kelley's Land First Division, Hennepin County,
Minnesota.
2. The City has reviewed and approved this application.
3. The scope of the project which is the subject of building permit #2012-00728 triggers the
application of the City's wetland buffer requirement as established by City Zoning Code Article XI Wetlands
Protection will commence its review of the application and incur costs associated with said review only if the
Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$5,000 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee the establishment and
development of the required native wetland buffer and to reimburse the City for all out-of-pocket costs the City
has incurred (including planning, engineering or legal consultant review) or will incur in reviewing the plan. Eligible
expenses shall be consistent with expenses the Owners would be responsible for as part of the establishment of
the wetland buffer. The escrow will atso guarantee reimbursement to the City for all out-of-pocket costs the City
has incurred associated with permit #2012-00728 if compliance with the wetland buffer establishment is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed, the native wetland buffer established and written notification is
received from the Owners requesting the funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by ers, or if the eligible expenses
incurr he City exceed the amount in escrow, the City shall have the righ o oertify the unpaid balance to the
su �ect prop rty pursuant to Minn. Stat. §§415.01 and 366.012.

While closing out opening escrow agreements I noticed the City holds escrow money for a building permit
($2,500)and wetland buffer establishment($1,000)for a total of$3,500 pertaining to your property. Our
records indicated Kuhl Design & Build paid the escrow money; however the agreement is between the
City and Lynn & Anders Myhran, therefore the money is being refunded to you. Please note, all
expenditures, including escrow refunds, require Council approval. The next council meeting is Monday,
February 8th. The check will be mailed following the meeting.
