It has also come to our attention that you are operating a business on the property refurbishing vans. This letter is to notify you that you are in violation of Orono City ordinances. The vehicle storage is a violation of Orono Municipal Code Section 9.50 and the home occupation is a violation of Section 5.40. Therefore the City must require you to eliminate these violations. A deadline of April 29, 1996 has beeil establislied. If this deadline is not met, tlie City niay initiate legal action. I will first address the alleged home occupation violation. Mr. Ebbecke does not refurbish vans on his property and denies the allegation. Therefore, there is nothing for him to place into compliance. With regard to the inoperable vehicle violation, Mr. Ebbecke has a Ford Ranchero for which he indicated did not have current tabs. I instructed him to obtain current license tabs which he is in the process of doing. That vehicle is in running condition. He also had another brand new van on his property which was licensed under a 21 day permit. Previously, there was a partially damaged van on the property which has been removed. Ebbecke 2180 Fox Street Wayzata, MN 55391 Dear Mr. Ebbecke: It has come to the attention of this department that you are in violation of the Orono Municipal Codes. First, several vehicles on the property appear to be unlicensed and/ar inoperable which still remain on the property. We appreciate that two vehicles were brought into compliance last summer, but there are other vehicles that need to be verified as operational and/or licensed (Section 9.50). Please contact me at the City Offices to arrange a site inspection to discuss options for remedying this problem. The second issue is the storage of work vehicles on private property. The storage of non-passenger vehicles is not allowed on residential property (Section 10.61 of the Orono Municipal Code). Also, the storage of the commercial vehicles on the property is considered evidence that a buisiness is operated within a residential property regardless of whether an office exists within the dwelling (Section 5.40 of the Orono Municipal Code). For these reasons, the vehicles must be removed from the property at 2180 Fox Street. These violations must be eliminated by March 10, 1997. All vehicles on my client's property are operable and licensed with the exception of a van which is snowed and iced in. That vehicle is a virtually new vehicle which is the subject of a dispute between the two corporate entities (one of which is Ge1co) which claim ownership to it. My client will voluntarily agree to get it off of his property. My client brought this van to his property from its point of origination out of state as is part of his profession. My client is not operating a home occupation where he fixes or rehabs vans or vehicles on his premises. (Please see my letter of April 29, 1996) . Ebbecke's property, 2180 Fox Street Dear Mr. Vande Vegte: A site inspection was performed on March 31, 1997 to determine which unlicensed or inoperable vehicles remain on the property. Mr. Ebbecke was home and accompanied me on the inspect�on. the inspection revealed that three unlicensed/inoperable vehicles are on the property rather than four as indicated in my last letter. The Ford car was originally thought to be unlicensed as the license - plate attached to the car bumper has expired (The collector plate located in the topper window is current, but its placement is not legal for street use). The City will allow extra time to remove the unlicensed commercial van and license or remove the Ford truck and Cadillac car. The van is located just off of the driveway and the ground is too soft to move the vehicle now. The Ford truck and Cadillac car are located at least forty feet from the driveway and are not removable now without destroying the yard. The Ford truck and the Cadillac car must be licensed or removed from the property by May 5, 1997 and the commercial van must be removed by the March 5, 1997 deadline. Please contact me if any of the vehicle's do not meet the five ton axle limit on Fox Street or spring rains prohibit their removal. Ebbecke's property, 2180 Fox Street Dear Mr. Vande Vegte: In response to your letter dated March 4, 1997, a site inspection performed on March 7, 1997 revealed that four vehicles on the property did not have current license tabs. This information was verified by the Orono Police Department. The site inspection also confirmed that two of the delivery vans had been removed. We do appreciate your efforts to remove these vehicles. The remaining unlicensed/inoperable vehicles on the property that are unlicensed and/or inoperable are surrounded by a substantial quantity of snow and the City is willing to allow extra time for the removal of these vehicles. The Ford truck and the automobile with license plate BK 5316 will be allowed to remain until summer as heavy snow cover, steep slopes and distance from the driveway will make their removal very difficult. These vehicles must be removed by June 1, 1997. The Ford El Camino and the delivery van must be removed by March 24, 1997. The two week extension should be sufficient for snow melt to make the removal of these vehicles viable. If significant snowfall occurs prior to the deadline date, the City may grant an additional extension. Regarding the use of the residence for business purposes, as long as commercial vehicles are not stored on the property and no evidence of business activities is apparent, the City will not pursue a home occupation violation.
