During our conversation on Thursday, August 18, 2013 regarding the status of the retaining wall,you mentioned the
retaining wall now no longer exceeds 4' and does not require a permit. All retaining walls require permits. A retaining
wall under 4' requires a zoning permit. Attached is a copy of the zoning permit application. Please complete the zoning
permit application and return with all the required submittals as soon as possible.

We have received the additional $7500 for a total of$10,000 escrow for the Temporary Certificate of Occupancy (TCO)
for the new home at 1860 Fox Street. As you are aware, the City may issue TCOs in situations where weather conditions
prevent the finalization of exterior site improvements and other extreme extenuating circumstances. Typically a TCO is
not issued as a convenience or during months/weather when the exterior improvements can reasonably be completed...
We will issue the TCO, however, there is one issue which must be resolved prior to doing so. We have been working with
the retaining wall contractor for the past few months in an attempt to get a plan for the wall(s) so that the retaining walls
can be approved and finally constructed. We are still waiting for submittal of a plan that meets our requirements and is
shown properly on the survey. During recent discussions with the retaining wall contractor we were told that the wall
would be constructed as shown on the original building permit survey dated 11/27/12; we were also told in the same
conversation that the wall would be up to 6 feet in height. This dimension is inconsistent with that shown on the
aforementioned survey. In short, we are confused and require clarification before we will release the TCO.

Per our telephone conversation, attached is a copy of the engineering and survey for the retaining wall at 1860
Fox Street. As you can see by the highlighted areas, the TW/BW elevations do not match the wall that is
shown. Also, the copy we have is hard to read, please submit two originals, so the elevations are ciearly called
out and easy to read.
Also, retaining walls greater than 4 feet in height require a building permit. Attached is a copy of the building
permit application . Please complete the application and return with the updated engineering/survey.

I have reviewed the application for the proposed retaining walls and have the following comments:
• The walls wiil need to be placed on a survey by a registered surveyor.
• The survey will also have to show the proposed grading impacts. The hand written sheet shows significant
grading will be needed to match back into existing grade.

This letter serves to follow up our telephone conversation regarding the new home being constructed by
Swanson Homes (Curt Swanson) at 1860 Fox Street. The City of Orono has issued a building permit,
however Swanson Homes started construction without the necessary permits from the Minnehaha
Creek Watershed District (MCWD); a MCWD stop work order has been issued.
The City of Orono holds a $2500 escrow in conjunction with the building permit for the new home. An
approved as-built survey is required prior to issuance of the Certificate of Occupancy (CO) for this
project. As a cooperative effort, if the MCWD chooses to lift your stop work order prior to receiving all
of your permit info, etc, we will hold issuance of the CO. The City of Orono will not to issue a CO for the
new home (temporary or final) until the issues regarding the wetland and wetland buffer are resolved to
the MCWD's satisfaction. We will require the builder provide to the City a letter or other documentation
indicating compliance with the all of the MCWD's permitting requirements prior to issuance of a CO in
order to resolve this issue to the satisfaction of all parties.

On April 30, 2013 the City received a building permit application for a retaining wall greater than 4 feet in height.
Upon our preliminary review we determined your application is incomplete.
The following items must be submitted or revised in order for your application to be considered complete and for
the plan review to continue:
1. Certificate of Survey. Please provide 2 copies of an updated, full size certificate of survey which meets
all of the City's survey standards (enclosed) indicating the location of the proposed retaining wall (and any
proposed grading) as well as all existing buildings, structures and landscaping. City Engineer, Jesse
Struve, reviewed the submitted documents; his comments are attached.
2. Zoning Permit Application. Grading, filling or excavating requires a zoning permit. Attached is a zoning
permit application. It is unknown at this time, if the activity qualifies as a major or minor land alteration.
Your surveyor should show the existing topography and proposed grading on the revised survey as well
as calculate the amount of earth movement. Any disturbance or grading activity in excess of 500 cy
requires a city council approved conditional use permit(CUP).
3. Minnehaha Creek Watershed District (MCWD) Permits. Please contact the MCWD regarding your
proposed project to determine if your project triggers any of the MCWD permitting requirements. The City
of Orono will not issue a building permit without a copy of the permit from the MCWD or written
documentation stating the proposed project does not trigger any MCWD permitting requirements.
4. Escrow� Escrow Agreement. The city currently holds a $2,500 escrow agreement for the construction
of the new home. If a major land alteration permit (CUP) is required, additional escrow monies may be
required.

An as-built survey dated 8-27-13 was submitted to the city on September 23, 2013. The retaining walls installed are not
the same as the retaining wall proposed. Although two separate applications were submitted for retaining walls, none
were issued due to lack of documentation for us to review. A zoning permit application was submitted on 9-23-2013
with the as-built survey.
We have reviewed the as-built survey and retaining walls and approve; however, before we can refund the escrow and
issue a final certificate of occupancy, a zoning permit fee of$100 must be received. ($50 for the permit and an after-
the-fact(double)fee of$50).
