; WHEREAS, the City of Orono is a rnunicipal corporation organized and existing
� under the laws of the State of Minnesota; and

I WHEREAS, the City Council of Orono (hereinafter "City Council") has adopted
� subdivision regulations for the orderly, economic and safe development of land within the City;
' and

WHEREAS, Craigbank Holdings, LLC (hereinafter "Craigbank") is the owner of
, the property located at 1700 Fox Street within the City of Orono (hereinafter "City") and legally
described as follows:

Exhibit A (attached) (hereinafter the South Parcel ); and
� WHEREAS, Longridge Associates (hereinafter"Longridge") is the owner of the
', property within the City located directly north of the South Parcel and legally described as
� follows:
! Outlot A, MACMILLAN ADDITION, Hennepin County, Minnesota
� (hereinafter"the North Parcel"); and

, WHEREAS, Craigbank and Longridge have jointly submitted an application for a
' lot tine rearrangement involving the South Parcel and the North Parcel which would relocate the
lot boundary line between the properties; and
WHEREAS, after due published and mailed notice in accordance with Minnesota
� Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono
P{anning Commission held a public hearing on the lot line rearrangement on April 16, 2012 at
' which time afl personS desiring to be heard concerning this application were given the
jopportunity to speak thereon; and

WHEREAS, the Orono City Councif reviewed the proposed lot fine
! rearrangement at a regular meeting held on May 14, 2012 and makes the following findings with
regards to the proposed lot line rearrangement:

FINDINGS
1. This application was reviewed as Zoning File#12-3553.
2. The existing North Parcel contains 11.66 acres in area including dry land, pond and �
wetlands. The existing South Parcel contains 13.83 acres in area including dry land,
pond and wetlands. The application contemplates a lot line rearrangement to combine a
3.5 acre piece of the North Parcel with the South Parcel.
3. Following the lot line rearrangement the North Parcel will be 8.16 acres in area, and the
South Parcel will be 17.33 acres in area.
4. The status of the North Parcel as an Outlot means that no part of it can be built on
without a future re-pfat to make it a Lot. This proposed lot line rearrangement to split off
part of the Outlot and attach it to the South Parcel does not change the Outlot status of
the remaining 8.16 acres.
5. Because this is a lot line rearrangement which results in no additional lots, no park fee or
stormwater trunk fee will be required.
6. No Park Fee will be due as the lot line rearrangement will include a Special Lot
Combination Agreement and no new buildable lot will be created.
7. No Stormwater Drainage Trunk Fee will be due with the lot line rearrangement.
8. Dedication of drainage and utility easements are not required as this is not a new plat.
9. The proposed lot line rearrangement will not result in making any of the structures on
either property non-conforming.
10.The remaining 8.13 acre porEion of the North Parcel is not individualfy buildable because
it is an outlot; because it has no separate access to a public or private raad; and
because it has not been tested for on-site sewage treatment capability.
11. Because the North Parcel is Torrens land and the South Parcel is Abstract land, legally
combining the South Parcel with the 3.5 acre portion of the North Parcel will require the
creation of new deeds for both properties reflecting the new legal descriptions, or a
Special Lot Combination Agreement may be required, to be determined by the City
Attomey.

CONCLUSIONS, ORDER AND CONDiTIONS
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby grants the lot fine
rearrangement of the above referenced properties based on the lot line rearrangement survey
dated 3/5/2012 by Gronberg and Associates, Inc., attached as Exhibit B, subje�t to the
following conditions:
1. Craigbank and Longridge shall file the appropriate deeds reflecting the new fegal
descriptions (subject to City Attorney approval) with the Hennepin County Recorder's
Office and/or Registrar of Titles Office on or before May 14, 2013, or the approval
granted by this resolution shall expire.
2. Craigbank and Longridge shall submit to the City copies of the newly rec�rded deeds in
order that final preparation of a Special Lot Combination Agreement can be compfeted if
deemed necessary by the City Attorney incorporating the correct new legal descriptions.
