A RESOLIITION GRANTING
A VARIANCE TO
MIINICIPAL ZONING CODE
S$CTION 10.03, SIIBDIVISION 19
FILE #1667
/,O
WHEREAS, Whitney Macriillan (hereinafter "the applicant" )
has an interest in the property located at frd''ox Street within the
City of Orono (hereinafter "City") and legally described as follows:
Lot 1, Block l, N,acMillan Addition, fiennepin County, biinnesota
(hereinafter "the property"); and
WHBREAS, the applicant has applied to the City for a
variance to Municipal Zoning Code Section 10.03, Subdivision 1S to
permit debris from the foundation of the former residence structure,
tennis court and blacktop drive to be buried on site, such debris
would not qualify as clean fill because the City standard does not
recognize organic, manmade or reprocessed materials as clean fill.
NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of Orono,
riinnesota:
FINDINGS
1 . This application was reviewed as Zoning File #1667 .
2. The property is located in the RR-1B Single Family Rurai
Residential Zoning District.
3. The Orono Planning Commission reviewed this application on
July 15, 1991 and recommended approval of the proposed
variance based upon the hardships and findings set forth by
applicant as follows :
A. The PCA regulations effective January 1991 were amended
to exclude the City from all involvement in burning
permitG for structures. The informal communicaticn
link between Long La3:e Fire Department and City since
that time did not address the City's aditional need
for a demolition permt when structures are razed via a
burn.
B. Applicant had obtGined necessary burning permits from
. _, both the Fire Department and the PCA.

C. Applicant had contacted all required utility companies
to secure legal shut-off and appropriate notification.
4. The City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally to
other property in this zoning district; that granting the
variance would not adversely affect traffic conditions,
light , air nor pose a fire hazard or other danger to
neighboring property; would not merely serve as a
convenience to the applicant, but is necessary to alleviate
a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicant; and
would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City.
5 . The City Council has considered this application includzng
the findings and recommendations of the Flanning Commission,
reports by City staff, comments by the applicant and the
effect of the proposed variance on the health, safety and
welfare of the community.
CONCLDSIONS, ORDER AND CONDITIONS

Council hereby grants a variance to riunicipal Zoning Cocle Section
