A CONDITIONAL USE PERMIT
FOR LAND ALTERATION
PER SECTION 78-966
FILE NO. 08-3359
WHEREAS, David C. Weyerhaeuser and Elizabeth Weyerhaeuser, husband
and wife, (hereinafter "the Owners") are the owners of the property located at 1540 Fox Street
within the City of Orono (hereinafter the "City") and legally described as:
See Exhibit A.; and
WHEREAS, the Herb Baldwin has made application on behalf of the Owners
to the City of Orono far a conditional use permit for land alteration to create a level area for a
sport court; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on May 19, 2008, at which time all persons desiring to be
heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS -
1. This application was reviewed as Zoning File#08-3359.
2. The City Engineer has reviewed the plan and finds it acceptable.
3. The Planning Commission reviewed this application on May 19, 2008 and on a
vote of 5 - 0 recommended approval of the conditional use permit.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff,
comments by the owners and the public, and the effect of the proposed
conditional use on neighboring properties and the community.

5. The City Council finds that the proposed location of the conditional use is in
accord with the objectives the purposes of the RR-1B zoning district in which
the site is located and with the comprehensive municipal plan and that the
proposed land alteration would not be detrimental to the public health, safety
or welfare, or materially injurious to properties or improvements in the
vicinity.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a
conditional use permit far a land alteration permit to create an area for construction of a sport
court, subject to the following conditions: �
1. Council approval is based on the grading plan submitted by the owners and
annotated by City staff, attached to this Resolution as Exhibit A. Any changes
or amendments to this plan will require further Planning Commission and City
Council review.
2. Authorities granted by this resolution run with the property not with the
owners, but are permissive only and must be exercised by obtaining a land
alteration permit before June 9, 2008 or grounds will exist for revocation of the
conditional use permit.
3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically �
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
4. The undersigned Owners have read, understand, and hereby agree �o the terms
of this resolution and on behalf of the owners and the owners' heirs, successors
and assigns, hereby agree to the recording of this resolution in the chain of title
of the property.
