A RESOLUTION
APPROVING THE PLAT OF
DRAGONFLY HILL 2ND ADDITION
- FILE #06-3196/#08-3342
V�'HEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono (hereinafter "City Council")
has adopted subdivision and land development re�ulations for the orderly, economic and safe
development of land within the City; and
WHEREAS, the City Council l�as considered the application by Patrick J.
Mcl�aughton and Lisa McNau�hton, husband and wife, and Edward H. Hamm, sin;le
(hereinafter "Applicants") for a 3-e-plat subdivision of private property located at 1391 Fox Street
and 1401 Shoreline Drive and legally described as follows:
1391 Fox Street (Mcl�Tau�hton):
Lot 1, Block 1 and Outlot A, BLUE HILL, Hennepin County, Minnesota
1401 Shoreline Drive (Hainm):
Lot 1, Block 2, DRAGONFLI' F-IILL,Hennepin Count��, Minnesota
(hereinafter "the Propei-ties"); and
t�'HEREA.S, on July 24, 2006 the City Council adopted Resolution No. 5489
;ranting Preliminary Plat Approval for a re-plat of the Properties to detach Outlot A, Blue Hill
fron� Lot l, Block l, Blue I-�ill, and eombine said Outlot A with Lot l, Block 2, DraQonfly Hill;

��'�E�AS, the Applicants forn�ally v��itl�di-ew tl�e lot ar�a ��ariance reques±s
associated with the application p:ior to September 4, ?006, th�reby in��alidating the ��ariance
denials per condition (1) of Resc�iu�ion No. 5489; and
V�'I�EREAS, on June 25, 2007 the City Council adopted Resolution No. 56�1
��-antin� a six month e�tension of the Effective Period of Preliminary Plat Appro��al to January
24, ?008; and

WHEREAS, Edward H. Hamm, as Trustee of the Trust of Edward H. Hamm u/d
dated August 14, 1992, as amended and restated from time to time (hereinafter "Owner") has
since acquired the McNaughton parcels and is now fee owner of the Properties; and
WHEREAS, the Owner has completed or has a�-eed to complete all other
requirements of the platting regulations of the City including:
l. Completion of al] platting requirements of Preliminary Plat Resolution No. 5489.
2. Dedication on the plat of "drainage and utility easements" 10' along exterior
property lines and 5' along the interior property line perimeter as required in
Resolution No. 5489.
3. Provision to the City of a title opinion or other evidence of ownership satisfactory
to the City Attorney and certified copies of all recorded easements currently
affectin�the Property.
4. Payinent to the City of final plat review fees and le�al review and filing fees in
the amount of$530.00 as established within Resolution No. 5489.
NOW, THEREFORE, BE IT RESOLVED that based on the findin�s of
Resolution No. 5489, the City Couilcil of the City of Orono does hereby approve the residential
plat of DRAGONFLY HILL ?ND .4DDITION, Hennepin County, Minnesota subject to the
followin� declarations and condi�ions:
1. No building pennits will be allowed for either of the two new Lots resultin� fi-om t1�e
subdivision until such time tl�at 1ot area variances are �ranted for each of the said Lots.
2. Access to the new Lot at 1401 Shorelu�e Drive shall be frozn Orono Lane as de�ic�ed on
the preliminal-y plat, and said Lot sl�all be ass��led an Orono Lane address uuon
coinpletion of tl�e plattii�«pro�ess. _ �
3. Upon filing of the plai tlle City and the Owner s:�a11 take the necessary steps to extinauish
the Special Lot Combination A�reeinent between Lot 1, Block l, Blue Hill and Outlot A,
Blue rIill.

4. The City Clerk shall release the plat documents for filing only upon certification by the
City Attorney and Planning Director that all requirements of the platting regulations have
been satisfied.
5. The aforesaid plat shall be filed by the City of Orono with Hennepin County on or before
July 14, 2008 to�ether with a certified original copy of this resolution and executed
copies of documents extinguishinQ the aforesaid Special Lot Combination Agreement.
The approval granted by this Resolution shall expire if the conditions of this Resolution have not
been met or the plat has not been filed by the date specified above. In that event, it will be
necessary to file a new application with the City of Orono for subdivision review.
Adopted by the City Council of Orono this 14th day of January, 2008.
