Dear Christine:
As requested, we have reviewed the wetland boundary and buffer area at 1900 Fox Ridge Road. We offer the
following observations, comments and recommendations for your consideration.
1. I reviewed the wetland boundary and buffer in the field on September 5, 2012 and agree with the
wetland boundary as marked.
2. The proposed construction has the potential to adversely impact the wetland which will trigger the
wetland protection ordinance requirements. Therefore,the following should be considered:
a. This wetland is listed as a`'Manage I"wetland management class in the MCWD's Functional
Assessment of Wetlands inventory, which requires a 35 foot buffer per City code.
b. The existing buffer area is a steeply sloped, heavily wooded area predominated by mature Red
Maples, with very little undergrowth. The ground is covered with Red Maple leaf litter.
Because of the 90-100%shade provided by the maples and the leaf litter providing erosion
control, 1 recommend that no additional vegetative planting be required. However,extra care
should be taken in providing erosion control protection at the top of the slope so as to prevent
erosion problems and damage to the wooded slope.
c. Wetland Buffer markers should be placed at the upland boundary of the buffer edge located at
lot lines and spaced a maximum 200 feet apart.
d. A $500 escrow should be submitted by the Owner to cover the cost of buffer sign placement if
not completed by the applicant.

Attached is a copy of our wetland specialist report based on the site visit he made. The pool location appears
fairly level. After cursory review of the 8 '/z x 11 size survey submitted, please have the surveyor:
• confirm there is no additional topography to be shown around the pool area
• add the pool equipment location
• show where silt fence and other erosion control measures will be placed (see wetland specialist report
attached)
Your survey shows potential additional storm water draining onto the neighboring property. Measures must be
taken so drainage onto the neighboring property does not increase with the pool project.
Once the above has been addressed, please submit two, full-sized surveys for us to continue our review
process of this application.
Also, the application does not include the property owners email address. Please forward to them.

On August 1, 2012 the City received a building permit application for a pool. Your application is incomplete.
The following items must be submitted or revised in order for your application to be considered complete and for the
plan review to continue:
1. Certificate of Survey. Please provide 2 copies of an updated, full size certificate of survey which meets all of
the City's survey standards (enclosed) indicating the location of the proposed pool (and any proposed
grading) as well as all existing buildings, structures, landscaping and retaining walls on the property.
2. Wetland Delineation. A Manage 1 wetland exists on the subject property; according to Orono's City Code
Chapter 78 Article XI Wetlands Protection, Manage 1 wetlands require a 35' wide vegetative buffer. The
proposed project appears to trigger the administration of the City's Wetlands Protection regulations. Please
submit a wetland delineation report. The wetland delineation must be approved by the Minnehaha Creek
Watershed District (MCWD). The delineated edge of the wetland must be shown on the survey, along with
the required 35'foot buffer and 20' structure se±back from the buffer.
3. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement
to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will
guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required
escrow amount for this project is $2,500. The escrow agreement is enclosed. The property owner must sign
the escrow agreement and submit a check for$2,500.

We received a pool permit application for 1900 Fox Ridge Road. Attached is a copy of the survey (not to scale)
received with the application. Even though the pool is over 200' from the wetland, it triggers our wetland
buffer improvement requirements. Please review the wetland and wetland buffer and submit a report to me
regarding the location of the staked boundary, the condition of the buffer vegetation and if improvements are
necessary. If improvements are necessary, please also advise the escrow amount requied. Please visit the site
and submit a report to be by Tuesday, September 11th. We will require the property owner to show the edge
of the wetland and buffer on an as-built survey.

Building Permit #2012-00744 at 1900 Fox Ridge Road pertaining to the pool construction is
complete. The Applicants, Rusty & Shannon Lundquist, have requested a refund of their
$2,500 escrow.
The applicants are aware of pass-through charges for which they have not received an
invoice from the City yet for. The applicants will pay $433 before we release their escrow.
As a result of the site visit by Jesse Struve reviewing the as-built survey, it was noted the
property has a couple of areas that require the establishment of vegetation. The City
continues to hold $500 for wetland buffer escrow which will be held until spring when the site
will be reinspected for vegetation establishment around the pool area.

AGREEMENT made this � day of �u�u�, 20�2;by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Shannon & Rusty Lundquist("Owners").
Recitals
1. A building permit application has been filed.for pool located at 1900 Fox Ridge Road the ("Subject
Property"), legally described as , Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2012-00744 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURS�MENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the r�view has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred b the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subje prop y pursuant to Minn. Stat. §§415.01 and 366.012. �

the ("Subject Property"}, legally described as Lot 5, Block 1, Fox Ridge, Hennepin County, Minnesota.
2. The City has reviewed and approved this application.
3. The scope of the project which is the subject of building permit #2012-00744 triggers the
app{ication of the City's wetland buffer requirement as established by City Zoning Code Artic{e X1 Wetlands
Protection will commence its review of the application and incur costs associated with said review only if the
Owner establishes an escrow to ensure reimbursement to the City of its costs.

AGREEMENT AND SWORN STATEMENT
7'he work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Buildino Code. This permit is for only the work described and does
not grant permission ior additional or related work which requires separate
permits. All provisions of laws and ordinances goveming this type of work
shall be compied with whe[her or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 davs of the date of issuance,or if construction is
suspended for a period of I 80 days at any time after work has commenced.
The applicant is responsible for assuring all required inspections are
requested in conformance with the State Building Code.This permit may be
revoked at anv time for due cause.
