4460 Forest Lake Landing
On August 21, 2014 the City received a zoning permit application for a deck &stair replacement and installation of a paver
patio. Your application is incomplete. The following items must be submitted or revised in order for your application to be
considered complete and for the plan review to continue:
1. Certificate of Survey. The survey dated 7-31-14 is incomplete. Please provide two copies of an updated, full size
certificate of survey which meets all of the City's survey standards (enclosed) indicating existing and proposed
topography (and any proposed grading). Clarification is aiso needed as the stairs on the survey dated 4-10-14 do
not match the stairs shown on the survey dated 7-31-14.
2. Building Permit. Construction and/or replacement of a deck and stairs require a Building Permit application.
Enclosed is a Building Permit application, please complete and return.
3. Building Plans. Please submit construction plans for the deck and stairs.
4. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District. Hardcover
calculations were submitted date 7-31-14, but the stairs do not appear in the calculations worksheet. Please have
the surveyor update the hardcover calculations, showing existing and proposed hardcover. Attached is a copy of
our hardcover information packet.
5. Escrow& Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of
an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for
out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance
with City Code Chapter 79 relating to erosion control and stormwater.The required escrow amount for this project
is $2,500. The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a
check for$2,500.
Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please contact the
MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will not issue a building permit
without a copy of MCWD permits or documentation from the MCWD stating the proposed project does not trigger any of
their permitting requirements. The above information is required in order for the plan review to continue. Please feel free

Christine is out of the office for the next 2 weeks. I apologize if I've missed something already submitted but it appears
we are still waiting for submittal of the $2500 escrow and escrow agreement(form attached), the construction
plans for the deck and stair refurbishment—or a description of this portion of the project.
The following are comments from our City's engineer, please address:
1. The silt fence should be installed and inspected by the City prior to any land disturbing activities. The Contractor
must provide a minimum 24 hour notice prior to inspection.
2. A financial security of$2,500 from the Applicant is recommended for erosion control and engineering oversight.
The financial security is intended to provide protection in the event that it becomes necessary for the City to
install or maintain erosion and sediment controt within the project area and covers the cost of vegetation re-
establishment if the applicant is unable to follow through with the conditions of approval.
3. The applicant may be required to obtain Minnehaha Creek Watershed District (MCWD) approval and permitting
for their Erosion Control rule. A copy of any approved permit or confirmation that no permit is required should
be submitted prior to any land altering activities.

a Minnesota municipal corporation ("City")Tom Barta ("Owners").
Recitals
1. A building permit application has been filed a deck and stair replacement and installation of a
paver patio located at 4460 Forest Lake Landing the ("Subject Property"), legally described as Lot 10 Tonkawa,
Gardens, Hennepin County, Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit apptication. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2014-00932 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BiLLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligibfe expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§ 415.01 and 366.012.
