the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires sepazate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is

Overall Project Description
With the change of hard cover restrictions since we built our house, we
would like to relocate our driveway entrance to the front of the street and
gate our property. (See enclosed plan.)
We will be moving a wall of trees to the property line that butts up to the fire
lane. All moving will be done on our property. No changes to city property.
We discussed relocating our flagpole and received verbal approval from
Lyle this past summer.
We will be moving 47 cubic yards out and 36 cubic yards in. Bolig & Sons
Inc. will be handling the excavation and the road we will use to access the
move is Hwy 19 to Wildhurst Trail to Forest Lake Landing.
We have applied for a permit from MCWD and it will be approved with a
city permit.
Enclosed is an updated hardcover analysis by Gronberg. We are within the
scope of available square feet.

4415 Forest Lake Landing
On November 26, the City received a zoning permit application for landscaping work within your property at 4415
Forest Lake Landing and also within the adjacent City right of way. Staff conducted a preliminary review based
on the information provided and recommends the following items be submitted or revised in order for your
application to be considered complete and for the plan review to continue:
1. Certificate of Survey. Please provide two full sized copies of a Certificate of Survey which meets the
City's enclosed survey standards and specifically shows the existing and proposed improvements; existing
topography; and proposed grading within your property as well as within the adjacent right of way.
a. Gate. The plan provided appears to propose entrance monuments and a gate. It appears that
one of the monuments is situated right on the property line. Please see the enclosed handout
regarding Entrance Monuments (and gates) and provide a revised plan meeting the
requirements. A separate zoning permit is required; monument and gate details will be required
for this permit.
b. Trees. There is a row of trees proposed to be planted right on the property line where the
circular driveway is to be abandoned and it appears there is an additional row of trees proposed
entirely within the right of way. Our Public Works Director has reviewed the tree locations and
indicated that the trees along the property line would likely be permitted, at your own risk of
course. However Mr. Edwards indicated that the new trees shown completely within the right of
way adjacent to the new driveway access would not be permitted.
2. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District.
You have provided an existing hardcover calculation worksheet with your permit. Please have the
surveyor prepare the proposed hardcover calculations using the City's hardcover calculation forms
(enclosed).
3. Right-of-Way Improvements. Your home was constructed in or about 1996. At that time an existing
bituminous access within the right of way was removed and replaced with the paver driveway. It is not
clear from your proposed plans whether or not you intend to remove the pavers from the right of way. It
would be the Ciry's preference that the paver improvements be removed and replaced with a paved
surFace to allow the properly at 4440 Forest Lake Landing access, at a minimum.
4. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and
stormwater. The required escrow amount for this project is $2,000 and was paid by you. The escrow
agreement is enclosed; please sign and return the escrow agreement.

5. Minnehaha Creek Watershed District Permits. Your project may trigger the Minnehaha Creek
Watershed District's (MCWD) permitting requirements; please contact the MCWD directly at
952.471.0590 regarding your project. Please note, the City of Orono will not issue a building permit
without a copy of MCWD permits or documentation from the MCWD stating the proposed project does
not trigger any of their permitting requirements.

I met with Joe from 4440 Forest Lake Landing yesterday to discuss his drive way requirements as they pertain to the
Line's,4415 Forest Lake Landing, landscaping plans. I also took the opportunity to walk the right of way area to see how
the proposed changes would impact it. This followed a meeting I had with the Lines on 23 Jan 15.
1. Overall I believe the proposal by the Lines is a positive one for them, for 4440 Forest Lake and for the City.
2. In order for the residents of 4440 Forest lake to maintain access to their home the shared paver driveway should
remain in place from the black top and then extend past the concrete driveway to 4440 by 15ft. At the East end
the pavers should be 15 ft wide. In other words a 15 ft x 15 ft turnaround area should remain to the east of the
concrete driveway once all of the other pavers are removed.
3. All of the pavers in the right of way less those described in item#2 should be removed and grass planted or sod
installed.
4. The Brick border depicted on the plans just running parallel with and just to the north of the right of way
boundary should be moved south to the boundary line. The existing planting bed that curves into the right of
way and frames the new driveway is existing and can remain. The Lines offered this compromise at the meeting
on the 23�d
5. Prior to the removal of the paver shared driveway, Public works will removed the dead tree which is located in
the ROW.
6. I recommend the Plans department review the proposed planting heights planned to run along the northern
property line to the east of the Line's driveway as if they are the same height as the existing plants west of the
driveway they will block neighboring sight lines.
7. Joe asked if there was a plan for the shared mailbox. It was not depicted on the plans but may be something
they are looking at as currently all three homes at the end of the road share one mail box monument labeled
"Line".
8. The home at 4440 is currently undergoing a major renovation. They and the Residents of 4415 will need to de-
conflict their construction activities to ensure both projects can proceed in a timely and amicable manner.

7. DEPOSIT OF ESCRO � �N,p� Contemporaneously with the execution of this Escrow

incur in meeting with the Owners, reviewing the plans, and preparing agenda packet material for City Council
review of Land Use Application �IN�013'11, Eligible expenses shall be consistent with expenses the Owners
would be responsible for under a land use�pplication.
3. MONTHLY BILLING. As the City receives consuftant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall cease all reviews until the Owners pay all
expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be retumed to the
Owners when all requirements related to the project are complete. City Staff shall review the tertns of this escrow
agreement two times per year to deterrnine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shalf be released upon City Staff receiving the appropriate veri#ication that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the efigible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn.Stat.§§415.01 and 366.012.
