This is a plat-dedicated right-of-way and as such serves the neighborhood as access to the lakeshore. There is a substantial record of neighborhood residents historically enjoying the use of this right-of-way for access to the lake for swimming, boating, snowmobiling, etc.which has been severely curtailed since the house at 4415 Forest Lake Landing was constructed in the 1990s. The City has not taken action to have landscaping elements removed from the right-of-way, although those elements are at risk should the City at some future date determine their removal is necessary. The City does have the right to require removal of these encroachments. The property enjoys the right to driveway access, and the current driveway configuration has been in place since the house was built. While we have no plans to improve the right-of-way at this time, there have been past discussions regarding making the access more user-friendly for the public. The City may clearly mark the boundaries of the existing right-of-way. 2) Aerial photo and site plan evidence in City files suggests that the dock serving the property is partially within the extended City right-of-way. Lake Minnetonka Conservation District(LMCD)regulations require that docks meet specified set backs from extended lot lines. We will require the existing dock to be relocated to meet LMCD regulations. Please feel free to contact me if you have any questions regarding the City right-of-way or the dock. I can be reached at 952.249.4627 or mcurtis@ci.orono.mn.us. Joey Mcleister, Star Tribune A Because my show is over the top, people think I'm over the top. But everything is pretty simple. I wear jeans and T-shirts just like everybody else. I don't want to act like a movie star every day. LORIE LINE'S HOLIDAY SHOW Only when I'm onstage. Q You must have a staff to keep it up. A No,we take care of our own house. My husband,Tim, and I do everything together, from cooking to shopping to washing the windows when I have an interview with the Star Tribune. My kids [Jackson, 13, and Kendall, 18] have chores, too. I'm proud of that. When I'm not onstage, I'm a full-time homemaker. Q No kidding? Why don't you hire out? A IYs how I grew up. I'm capable. I want my kids to be capable. Q So, do you have a favorite chore? A IYs what I call nesting. Moving things around, regrouping accessories. I like to redecorate using what I have. Q Do you use what you have for your shows, too? A I recycle things from the show to my house and back again. I use a fox shawl I wore in the show a couple of years ago as a throw. The rhinestones from the music stands are embedded in the tufts on the sofa. I used brooches from one show to decorate the pillows. Even the chandeliers--the one in the foyer was used on the set for 500 shows. Q And the grand piano in your living room? Has that been onstage, too? A Yes,we tip it on its side and take it out the front door to the trucks. But Sven [the black Yamaha] is staying home this year. Esmeralda is white. She goes better with the sets. Q Don't the neighbors call 9-1-1 when they see a piano, furs and chandeliers being hauled out? http://www.startribune.com/printarticle/?id=12246401 10/26/2012 . ` StarTribune - Print Page Page 2 of 3 A No. I own the houses on either side of us. One is a recording studio and guest house, the other is the crew house. We're sort of self-contained. Q Did you design your house the same way you design your sets? A Everything in my house is collected, not bought. I don't go to a furniture store and shop for furniture. Everything is sentimental, everything has a story. The antique Venetian mirror is from Italy. The silver tea set from Turkey, the basket from Africa. Q Is there anything in your house that cost less than 10 bucks? A I spent tens of thousands of dollars on the living room drapes and then I found these finials on sale for 99 cents. At first I was hesitant to put them up because they were so inexpensive, but they look great. Q Where do you go when you want to hide out? A The master bathroom. It has heated floors, a soaking tub and a great view of the lake. My first piano bench and the first chandelier we took on the road are in there. But the bathroom can be closed off by hidden doors. You'd never know it was there. Q Do you remember the first time you played a piano? A Yes! It was in kindergarten. I had perfect pitch and i figured out how to play a simple lullaby. Q Did you have any idea that playing piano would become a lifelong career? A For me and my husband, musicians and a crew? No. But I wake up every morning and thank my lucky stars and say, "I hope I make it." Q Haven't you made it? A I hope I make it. Q Your fans would be surprised if they knew you ... A Shop at Costco. In fact, I'd rather go shopping at Costco than shop for a new dress. Q What's one thing we should know about you? A I'm generous. Q WhaYs one thing we shouldn't know about y-- A-- I'm impatient. Q Every holiday season for the past 17 years, you've been gone for weeks at a time. What do you do to unwind when back home? A Nothing. Absolutely nothing. Q What's Christmas at the Line house like? A Tim and I get home on Christmas Eve. Our celebration isn't elaborate. It's very practical. Very mainstream. Our tree is tasteful. The kids aren't spoiled. I have a budget. But we have one rule: We open presents in order--from youngest to oldest --and you have to completely finish opening one present and show it off before you open the next. Q And then? A The day after Christmas we're back on the road again. http://www.startribune.com/printarticle/?id=12246401 10/26/2012 _ ' StarTribune - Print Page Page 3 of 3 Connie Nelson •612-673-7087 O 2011 Star Tribune http://www.startribune.com/printarticle/?id=12246401 10/26/2012 Melanie Curtis From: Melanie Curtis Sent: Wednesday, October 31, 2012 3:48 PM To: 'Yorks, Patricia E' Cc: Tim Line; Lorie Line Subject: RE: 4415 Forest Lake Landing Attachments: Orono Comp Plan Excerpt re Lake Accesses.pdf.pdf Patly— Thank you for your email. My letter indicated that swimming, boating and snowmobiling were uses historically enjoyed by residents and they were curtailed after the house was built. We have extensive minutes from numerous Park Commission meetings in 2001 where residents commented about their past uses of the access. We can provide these if you wish. In 2001 there were a wide variety of resident opinions expressed on how this access should be used in the future. On October 22, 2001 the City Council on a vote of 4-0 approved aClass I"classification for this access, which allowed pedestrian access, launching canoes and other small boats not requiring a trailer, with the understanding no fishing or swimming will be allowed at this site. The"Class I"designation refers to a system of access classification designed by the Park Commission but apparently never established by ordinance or formal resolution... This City Council action to designate uses of the site could be amended, revised or rescinded by a future Council, so it would be appropriate for potential future adjacent owners to understand that what is in place today could change in the future. I would also refer you to the section of the Orono Comprehensive Plan (attached) that addresses preservation and management of lake access points. Thank you and please let me know if you have further questions. I have attached the approval letter outlining the uses for the Right of Way that the Line's have provided me with. I am confused because they do not match what you sent me. It appears that this issue was discussed and resolved previously. In their letter from the city, the acceptable uses are pedestrian uses only, fishing and launching a canoe or other small boats not using a trailer. It appears that pedestrian uses would not include swimming, boating, snowmobiles as your letter states. Perhaps you have a different document as to what the city council has approved? It is the City's policy that new direct access to arterials is to be minimized to the grea.test ertent possible. However, many of southern Orono's arterials near the Lake Minnetonka.shoreline have historically served a dual function as both arterials and as IocaUcollector streets, due to geographic and topograhic Iimitations. Minimizatian or consolidation of existing driveway and local street access points along these unique roadways is a complex matter which will often require the cooperation of multiple property owners. The City will encourage the use of shared driveways along existing developed arterials wherever feasible. Further, the City will continue to investigate the feasibility of closing existing direct Iocal street access points to principal and minor arterials where suitable alternative access points may be established. LAKE ACCESS PRESERVATI4N AND MANAGEMENT With more than 40 miles of Lake Minnetonka shoreline and nearly 5 miles of additional lake shorelines,Orono's lakes provide a significant recreational resource for all Orono residents, not just for those who own pxoperty abutting the lakes. This value was long ago realized by the City fathers,as well as by eariy Iand developers. In order to provide lake access for the general public,as well as to provide for fire deparnnent access to the lake as a water source,a number of lake access corridors were created as the shoreland developed. These typically are platted, dedicated right-of-ways leading from the local road system to the shoreline, and are commonl.y from 16' to 66' in width. The historic level of use of these right-of-ways{sometimes referred to as"fire lanes" or`Iake access roads)ranges from minimal to year-round. Certain of these corridors have been maintained by the City for local swimming beaches or as winter snowmobile and ice-fishing accesses. Certain accesses are provided with docks for fishing, and some have ramp areas suitable for launching a small boat However, most do not have designated parking available, a.nd are primarily intended to serve the neighborhood rather than the general public. A numbezof these access corridors have steep topography and experience a relaively low Ievel of usage. T'he value of these corridors to the general public both now and in the future is too great to be measured. While an access corridor or fire lane may appear to an adjacent landowner as abandoned, there may well be a future public need for that corridor that may not be obvious today. The Minnesota Supreme Court in 1944 (Application of Baldwin,et al No. 33721 for vacation of a platted dedicated lake access road)upheld the value of retaining the public's right to access the lake. In an excerpt from the findings of the Court: City of Orono Community Management Plan 200&2030 Page 4A-31 CMP Part 4A. Tranaportation Plan 'This court requires no proof thatLakennetonka u a priceless her#age of the people af M'cnnesota,to be preserved and passed on to posterity. Judicia!notice will be taken of rhe fact thatt is one of the most precious jewels in the string of Ten Thousand Lakes of which Minnesota is so justly proud..Becutse af its wide ezpanse and proximity to our metropoCitan areas,it is much frequented and used for boating, frshing, picnicking and bathing-perhaps more than any other lake ix the state. Its shore line of nearly 100 mides is dotted with perrnanent homes and summer cottages, not only at its waters edge, but extending far back from the shore. But the use ojthe lake is not confaned to dwellers on its shore or nearby. During the summer season especially,&is the mecca for thousands upon lhousands of urbanites, not so fortunate as to possess a lake home,who-young and old alike-seek its shores and waters for diverse recreationalpurposes. To those who do not indulge in active recreation,it affords the opportunidy of co►nmuntng with nature at its best With the increase in the permanent lake population, however, the rrtent of lakeshore avarlable tn the public generaUy and the means of public access to the lake have diminished and therefore becorne increasingly valuable from year to year...we must not forget that the public includes persons other than those in the immediate vicinity. The general public/as a true concern in the recreational facilides offered by the lakes which nature has so freely given us in this state. Theirgenerous sharing by all will make for a healthier and happierpeople. The many not , fortunate enough to be able to acquire the advantages of ownership of lake sbore properties should not be depr8ved of these benefits. Thrs we would do if we permtted sireets leading to the lakeshore to be vacated.. Tfie loss to the public of l50 feet af shoreline out of a total of approzimatefy l00 miles may to the Baldwins seem inconsequeniral or even infinitesima!and nothing to be disturbed about But,of this l00 miles ofprecious shoreline, only a small fraction has been reserved for the public;and if the courts shauld create¢precedent by permiting a single inroahowever small, upon the public S share of the shoreline, other inroads iviU inevttably follow,unGi!the aggregate becomes a real threat to the public's free access to tlhe lake. To avoid aay possibility of such a result, the courts should wtth equal vigor repulse the ftrsthe second,ad every other assault upon the public do►nain." Less than 1%of Orono's lake shoreline has been dedica.ted as public access corridors. Nearly all the rest is privately owned, and not available to the public for lake access purposes, save for the DNR Maxwell Bay Access, Hennepin County's North Arm - Access and the City's Summit Park on Long Lake. Hennepin County's Noerenberg Gazdens Meinarial Park, while abutting Lake Minnetonka, has deed restrictions that disallow use for docking or launching boats. With shoreland abutting a dozen separate bays in Lake Minnetonka, Orono has a commitrnent to maintaining access via the dedicated access corridors. Orono's lake accesses are enumerated in Table 4A-8. Lake Access Policies It is the City's intent to permanently retain for public use a11 existing lake access comdors and fire lanes, regardless of the current Ievel of use or maintenance. To this end,the City will follow these policies: 1. Requests for vacation of dedicated lake access right-of-ways will be denied in all cases except where equal or better lake access will be granted nearby in return. 2. The City will identify and take necessary a.ction to preserve the public's right to use of any such accesses which exist but which may not have been formally dedicated. 3. Tb e Ciry will endeavor to work with property owners adj acent to lake access corridors to ensure that both the rights of the public and the rights of the private landowner are upheld.
