Sec.13.04 R[GHTS OF SUBJECTS OF DATA
Subd.1. T�pe of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Information required to be given individual. An indi�idual asked to supply private or confidential data concerning himself shall be
informed oE (a)the purpose and intended use of the requested data within the collecting sfate a�enc��,political subdivision,or statewide s}stem;(b)
whether he mac refuse or is legalh�required to suppl��the requested data;(c)any known consequence arisin�from his suPph�ing or refusing to supply
private or confidential data;and(d)the identih�of other persons or entities authorized b}�state or federal la�v to receice the data.This requirement shall
not apph��hen an individual is asked to supply investigative data,pursuant to section 13.82,subdi�ision 5,to a law enforcement officer.
The commissioner of revenue ma��place the notice repuired under this subdivision in the individual income tax or oroperh�tax refund
instructions instead of on those forms.
Subd.3. Access to data b��individual. Upon request to a responsible authorit}�,an indi�°idual shall be informed whether he is the subject of
stored data on individuals,and whether it is classified as public,private or confidential. Upon his further request,an individual who is the subject of
stored private or public data on individuals shall be sho�vn the data without am�charge to him and,if he desires,shall be infbrmed of the content and
meaning of that data. After an indi��idual has becn sho�rn the private data and informed of its meaniny,thc data need not be disclosed to him for six
months thereafter unless a dispute or action pursuant to this section is pending or additional data on the indi��idual has been collected or created. The
msponsible authorih shall procide copies of the private or public data upon reyuest b�the indi�idual subject of the data.The responsible�uthority may
reyuire the requesting person to pap the actual costs of making,certif}�ing,and cmnpiling the copies.
The responsible authoritp shall compl�immediateh,if possible,with anc request made pursuant to this subdi�ision,or within fi�e da�s of the
date of the request,escluding Saturdays,Sundays and legal holida��s,if immediate compliance is not possible.If he cannot comph�with the request�vithin

and le�;al holida�s.
Subd.4. Procedure when data is not aceurate or complete. An indi�idual mac contest the accuracy or completeness of public or private data
concerning himself.To exercise this right,an indi�idual shall notifi in writing the responsible authority describin�the nature of the disagreement.The
responsible authoritv shall within 30 da�s either: (a)correct the data found to be inaccurate or incomplete and attempt to notif��past recipients uf
inaccurate or incomplete data,including recipients named by the individual;or(b)notify the individual that he believes the data to be correct. Data in
dispute shall be disclosed onk if the indi��idual's statement of disagreement is included with the disclosed data.
The determination of thc responsible authority may be appcaled pursuant to the pro�°isions of the administrative procedure act relating to
contested cases.
