1989 RECONVENED BOARD OF REVIEW
• MAY 24, 1989
The 1989 Reconvened Board of Review was called to order at
7:00 P.M., Wednesday, May 24, 1989. Present were Mayor Grabek,
Councilmembers Goetten, Peterson, Callahan and Nettles.
Representing the City staff were Mark Bernhardson, City
Administrator; Dorothy Hallin, City Clerk; Rolf Erickson, City
Assessor; David Wilde and Rita Guderian Assistant City Assessors.
Mr. Erickson stated that persons would be heard in the
order of their arrival at the Council Chambers.
Appearing before the Board were:
1. Robert Lapinski, 2948 Casco Point Road
P.I.D. 20- 117 -23 31 0036
Mr. Lapinski stated he had received a 26% market value increase
in 1988 and has received notice of a $31,000 increase for 1989.
He stated the Minneapolis Board of Realtors have indicated that
the Lake Minnetonka area has a 10% increase in selling prices
and therefore was asking the Board to limit his 1989 increase to
no more than 10 %. Mayor Grabek stated that the Board could not
limit everyone on Lake Minnetonka to a 10% increase. Mr.
• Erickson stated he felt the valuation was correct and Mr.
Lapinski should appeal to the County Board stating that by
appearing before the County Board Mr. Lapinski will receive
another appraisal of his property. Mayor Grabek stated he could
see no justification to lower the valuation.
It was moved by Mayor Grabek, seconded by Councilmember
Callahan, that the Board accept the 1989 valuation as set by the
Assessor. Motion, Ayes 5, Nays 0.
2. Neil Castagna, 1890 Shadywood Road

Mr. Castagna stated a $321,300 market value is too high. Mr.
Erickson stated the Crystal Bay area had three sales in the past
year which indicated smaller houses are selling in the $200,000
range. Mr. Erickson stated the 1989 market value is $7,000 over
Mr. Castagna's purchase price three years ago.
It was moved by Mayor Grabek, seconded by Councilmember Nettles,
to accept the 1989 valuation as set by the Assessor. Motion,
Ayes 5, Nays 0.
3. Thomas Bernier, 3535 Ivy Place

Mr. Bernier asked if the increases in market value are a product
of the State or the City. It was his opinion that the Council
• should be working for the residents. Stating that investing in
Lakeshore property was an individual's choice. Mayor Grabek
stated we are not in a no win situation. Persons should contact
their Legislators regarding Minnesota tax laws. Mr. Erickson
stated because of a lot line rearrangement Mr. Bernier now has

lake access. Mr. Bernier stated he has no lake access because
of the low lake level. Mr. Erickson stated that in 1988 before
the lot line rearrangement the land was valued at $112,000 and
is valued at $158,000 for 1989. Councilmember Goetten asked Mr.
Erickson what would happen if the Board reduced the entire City
to the 1988 market values. Mr. Erickson stated the County would
not allow such an action and would raise the valuations. He
stated the Board can reduce values by 1% of the total value of
the City, noting the total City value is $400 million. Hennepin
County is not accepting the action by the City of Minnetonka's
Board where they reduced the entire City's 1989 market value by
1 %. Administrator Bernhardson stated the Assessor has lowered
some values, the persons present tonight are most likely persons
who did not agree with the Assessor's valuation. Mr. Erickson
stated there could be some relief from the State in the form of
a 10% cap on market value increases or some other type of
relief.
It was moved by Mayor Grabek, seconded by Councilmember Peterson
to accept the Assessors 1989 market value. Motion, Ayes 5, Nays
0. The Board reminded Mr. Bernier of his right of appeal to the
County Board.
4. Thomas Sarenpa, 1670 Shadywood Road

Mr. Sarenpa stated he lived on Shadywood Road north of the •
bridge. After a revaluation by Mr. Erickson the 1989 market
value is now $177,000. Mr. Erickson stated that he had
depreciated the house considerably because of age and lack of
footings on portions of the structure, stating the value is
based on sales data. Councilmember Callahan asked Mr. Erickson
why land values can vary in the same neighborhood. Mr. Erickson
stated that site values can vary depending on their depth or
road location.
It was moved by Mayor Grabek, seconded by Councilmember Nettles
to accept the Assessor's 1989 market value. Motion, Ayes 5,
Nays 0. Mr. Erickson stated that anyone who feels aggreived
should hire a real estate appraiser and go to Court, stating our
appraisals are done on a mass appraisal basis.
5. Robert Merkow, 2340 Abington Way

Mr. Merkow asked where citizens can get a copy of the State laws
relating to market value. Mr. Erickson stated that it is
available at public libraries. Mr. Merkow stated market value
can have many different definations; purchase price, appraisal
value, mortgage value, etc. He requested the Board reduce his
1989 valuation from $393,000 to $300,000 or $325,000. He stated
he had purchased the property for $425,000 but felt he could not
sell the property for that amount.
It was moved by Mayor Grabek, seconded by Councilmember Nettles, •
to accept the Assessor's 1989 market value. Motion, Ayes 5,
Nays 0.

6. Alan Larson, 3844 Cherry Avenue

Mr. Larson stated he had talked to Rita prior to tonight's
meeting and she had answered all of his questions regarding the
identified property. He went on to say he is in the process of
purchasing the adjacent property for $70,000 and the 1989 market
value is in excess of $80,000 and wanted to know how this value
can be changed. Rita stated that once the purchase has been
completed the Assessor would revalue this property. Mr.
Erickson stated he could not change the 189 value until Larson
was the actual owner noting he would revalue the property at
that time.
There was not action by the Board on this matter.
7. David Bie, 1910 Shadywood Road

Mr. Bie asked the Assessor for a breakdown on the valuation
between land and structures stating his lot was 75 feet of
lakeshore and 176 feet deep. Councilmember Goetten asked Mr.
Erickson if he had reappraised this property for 1989. Erickson
replied he had changed the value from $229,400 to $170,400
noting this reduction was due to an error in calculation.
• It was moved by Mayor Grabek, seconded by Councilmember Goetten
that the Board accept the Assessor's revised 1989 market value.
Motion, Ayes 5, Nays 0.
8. Jack McElhaney, 875 Partenwood Lane

Mr. McElhaney stated he paid too much for the property. He
stated he had talked with the Assessor and his staff and they
had answered his questions in a very professional and courteous
manner. He stated his property was valued higher than
neighboring properties noting his lot was pie shaped and because
of the low lake level was unable to use his lakeshore. Mr.
Erickson stated that odd shaped lot values were based on a
functional value noting that this procedure was an accepted
appraisal practice. Mayor Grabek suggested Mr. McElhaney use
the appeal process. Mr. McElhaney asked the Assessor if his
property was equitable with 850, 855 and 880 Partenwood.
Erickson stated he would give him that information.
It was moved by Mayor Graybek, seconded by Councilmember
Callahan to accept the Assessor's 1989 market value.
Councilmember Callahan stated that either the Assessor is
correct, the value is too high or the neighboring properties are
too low and you are not too high. Mayor Grabek noted that the
property owner can still appeal to the County Board.
• Councilmembers Nettles and Goetten noted the 1989 market value
is under the purchase price. Motion, Ayes 5, Nays 0.

9. Michael Miller, 870 Windjammer Road •

Mr. Miller stated he had telephone contact with the Assessor and
the 1989 market value of his property had been changed to
$208,000 but he had not received anything in written form
regarding the change. Mr. Erickson confirmed the value had been
changed to $208,000 and that notification of this change was in
the mail to Mr. Miller.
No action by the Board.
10. A. F. Gallistel, 2933 Casco Point Road

Mr. Gallistal asked for a breakdown of value between land and
structure on the 1989 valuation of $196,400. Ms. Gunderian
stated the breakdown. Mr. Gallistal stated that old houses have
a negative impact on the property noting that a couple of older
houses on Casco Point have either been torn down or removed from
the property to allow new construction.
It was moved by Mayor Grabek, seconded by Councilmember Nettles
to accept the Assessor's 1989 market value. Motion, Ayes 5,
Nays 0.
11. Kenneth Roelofs, 1650 Shadywood Road
P.I.D. 17- 117 -23 21 0014 •
Mr. Roelofs asked for a breakdown of the $231,100 1989 market
value stating that he did not feel he could sell his property
for this amount.
It was moved by Mayor Grabek, seconded by Councilmember
Peterson, to accept the Assessor's 1989 market value. Motion,
Ayes 5, Nays 0. Mr. Erickson asked if he could go through the
house and Mr. Roelofs stated he should call and make
arrangements to do so.
12. Mrs. Bill Fox, 1095 Ferndale Road West
P.I.D. 02- 117 -23 43 0023
Mrs. Fox stated the 1989 market value had been adjusted to
$525,000 and asked for a breakdown of this valuation. Mr.
Erickson stated the land is this area is very valuable and the
land was valued at $475,000 and the structure at $50,000. Mrs.
Fox stated that she would not be able to rebuild the house on
this property if it were destroyed. City Administrator
Bernhardson stated he would check with the Building and Zoning
Department to determine if that information was correct. Mr.
Erickson noted that land values in this area had been raised
because of sales.
It was moved by Mayor Grabek, seconded by Councilmember Nettles
to accept the Assessor's 1989 market value. Motion, Ayes 5,
Nays 0. •
At this time all persons wishing to appear before the Board had been
heard.

Mr. Erickson presented a listing of properties that had been
reviewed at the property owners request. He stated that some
changes had been made in valuation and these property owners names
should be noted in the minutes of the Board meeting to enable these
property owners to appear before the County Board if they chose to
