We have reviewed the plans for a proposed remodel/addition to the existing home at 805 Forest Arms Lane.
The plans are dated 12-7-11. We have the following comments with regards to engineering matters:
• The site plan appears to have minimal proposed grading and no change to hard cover.
• The plan is acceptable from an engineering standpoint.
• This project will disturb more than 25, but less than 100 cubic yard of material. Sediment and erosion
control information meeting the requirements of Orono's City Code 79-7(c)(1)must be submitted.
The minimum $2000 sediment and erosion control financial security should be required of the
applicant for this permit.

Remarks:
The proposed site improvements trigger the requirements of the City wetland code.
The wetland classification map indicates one wetland is located within the property
and is classified as a Preserve with a 50 foot buffer. A site visit verified the wetland is
present and an estimate of the wetland boundary was completed for purposes of
determining the extent of buffer and setback. In the future if work is proposed within
10 feet of the wetland boundary estimate a formal wetland delineation should be
completed.
The proposed house and deck locations are outside the setback of the buffer.
Currently there is turf and buckthorn within the buffer. The buckthorn is concentrated
on the slope off of County Road No. 151.
Buckthorn and turf found in the buffer are considered to be an undesirable plant
species and are required to be removed from the buffer area. Due to the density of
the buckthorn within the buffer the area will need to be seeded or planted with native
species once the buckthorn is removed. In addition the turf areas of the buffer will
need to be seeded or planted with native vegetation. Per the wetland code a 8 foot
wide mowed path can be maintained across the buffer to provide access to the dock.
The remainder of the buffer cannot be mowed once the native vegetation is
established, unless it is part of a native vegetation management plan.
The applicant will need to provide a ManagemenULandscaping plan that includes the
following:
1. Method proposed to be used to control buckthorn and remove the turf grass
(MN DNR website source for options).
2. Method of establishing native vegetation in buffer. (MN BWSR Web Site—
Publication: "Restoring & Managing Native Wetland and Upland Vegetation"
source for options).
3. Species proposed to be seeded or planted. According to the ordinance Div. 3
Sec. 78-1605 (3)the seed mix must contain at least 12 pounds (PLS) per acre
of native prairie grass seed and 5 pounds (PLS) per acre of native wildflower
seed. The grass mixture must contain a minimum of four species while the
wildflower mixture must contain a minimum of five species. (MN BWSR Web
Site—Publication: "Restoring & Managing Native Wetland and Upland
Vegetation" source for options).
4. A schedule of activities that are part of the management and maintenance for
the removal of buckthorn and the establishment of vegetation in the buffer
shall be provided.
Wetland Buffer Markers
It is recommended that at least two markers are placed at the upland boundary of the
wetland buffer edge. Signage is available from the City and will be sold to the
landowner.
Recommendations
It is recommended that the items in this memo are addressed prior to approval. An
escrow amount for$ 3,000 is recommended to cover the cost of buffer development if
not completed by the applicant and compliance checks.

Attached is the report from our wetland specialist regarding compliance with our Wetland regulations for your
permit at 805 Forest Arms Lane.
It appears your construction project triggers our wetland regulations and a buffer improvement plan is
required. This means as a part of your project removal of buckthorn and turf grass is required as well as a
maintenance and planting plan to install native plantings in the buffer area. We will issue the building permit,
upon receiving your signature on the wetland buffer escrow agreement (copy attached) and submittal of a
check for$3,000 (wetland buffer improvement security). If you are unable to print the escrow agreement, I will
have one ready for you at the City for you to sign.
In an effort to issue your permit in a timely manner, after receiving the escrow and signed agreement, we will
allow time for you to develop the management/landscaping plan. This plan must be submitted prior to allowing
you to begin framing the project. The management/landscaping plan must show:
• A detailed plan for how the buckthorn & turf will be removed.
• A detailed buffer planting plan (i.e. what will be planted)
• A schedule for planting and buckthorn removal and buckthorn removal maintenance

AGREEMENT made this f/ day of �I'K.Lz-►, 20�(, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City")and Albert Guralnik ("Owners").
Recitais
1. A building permit application has been filed for a property located at 805 Forest Arms Lane the
("Subject Property"), legally described as Lot 1, Block 2, Forest Arms, Hennepin County, Minnesota.
2. The City has reviewed and approved this application.
3. The scope of the project which is the subject of building permit #2011-01475 triggers the
application of the City's wetland buffer requirement as established by City Zoning Code Article XI Wetlands
Protection will commence its review of the application and incur costs associated with said review only if the
Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shali deposit $3,000 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee the establishment and
development of the required native wetland buffer and to reimburse the City for all out-of-pocket costs the City
has incurred (including planning, engineering or legal consultant review) or will incur in reviewing the plan. Eligible
expenses shall be consistent with expenses the Owners would be responsible for as part of the establishment of
the wetland buffer. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs the City
has incurred associated with permit #2011-01475 if compliance with the wetland buffer establishment is not
accompiished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed, the native wetland buffer established and written notification is
received from the Owners requesting the funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject-pr.operty pursuant to Minn. Stat. §§415.01 and 366.012.

Joe,
Below is an email which was sent out regarding your property. The steep slope next to your house still doesn't have
vegetation established, but the erosion control blanket seems to be preventing erosion from taking place on the slope.
You should try to make another attempt at getting vegetation to establish on the slope to stabilize it. I realize the lack of
sunlight might make this difficult, but there should be some shady mixes a landscaper can put down to accomplish this.
I also need to see:
1. The erosion gullies at the bottom of the slope along CSAH 151 smoothed out,vegetation established, and
erosion control blanket installed.
2. Acceptance of the wetland buffer along the bottom of the slope. We will have to have our wetland specialist
out there to take a look at it and decide if any corrective measures are required.
With the summer quickly coming to a close,you should contact some landscapers to see if there is anything which can
be done soon to get the seed and blanket installed so some of it can start to take hold before the growing season is over.

I performed an as-built inspection and the applicant has corrected the erosion along the south side of the house. I
cannot tell if what is planted in the wetland buffer area is of the appropriate mixture and it has not established itself.
We can send out the specialist from Bolton and Menk to inspect the buffer area. There are no signs or any sort of
markers to indicate where the buffer area begins either therefore it might be difficult to determine the buffer location.
There is some erosion taking place along the north property line where a path was cleared from CSAH 151. The
applicant has enough materials on hand to make the corrections but this area should be corrected and vegetation
established.

As requested, I examined the wetland buffer at 805 Forest Arms Lane on October 14, 2013. I offer the
following observations, comments, recommendations, figures and pictures for your consideration.
1. The steep slope rising to the county road is blanketed and stable, and the addition of bio roll will help
to keep the blanket in place. However, no vegetation was noted on the slope at this time.
2. No markers are located in the field to delineate the upland edge of the buffer. However,the area at the
base of the slope and the buffer appear to be vegetated with a nurse crop. The native vegetation is not
yet established. It typically takes a minimum of 3 years for native vegetation to predominate a newly
vegetated area.
3. The City should continue to hold enough escrow for native vegetation establishment for up to 2 more
years to ensure that the buffer is established properly.

A couple of pictures to show the work has been completed...l had our landscaper place seed underneath the blanket in
addition to the seed being held in the Erosion control blanket so we should be good to go and with the tree down
sunlight should help it take root.

Joe,
Below is an email which was sent out regarding your property. The steep slope next to your house still doesn't have
vegetation established, but the erosion control blanket seems to be preventing erosion from taking place on the slope.
You should try to make another attempt at getting vegetation to establish on the slope to stabilize it. I realize the lack of
sunlight might make this difficult, but there should be some shady mixes a landscaper can put down to accomplish this.
I also need to see:
1. The erosion gullies at the bottom of the slope along CSAH 151 smoothed out,vegetation established, and
erosion control blanket installed.
2. Acceptance of the wetland buffer along the bottom of the slope. We will have to have our wetland specialist
out there to take a look at it and decide if any corrective measures are required.
With the summer quickly coming to a close,you should contact some landscapers to see if there is anything which can
be done soon to get the seed and blanket installed so some of it can start to take hold before the growing season is over.

Below is an email which was sent out regarding your property. The steep slope next to your house still doesn't have
vegetation established, but the erosion control blanket seems to be preventing erosion from taking place on the slope.
You should try to make another attempt at getting vegetation to establish on the slope to stabilize it. I realize the lack of
sunlight might make this difficult, but there should be some shady mixes a landscaper can put down to accomplish this.
I also need to see:
1. The erosion gullies at the bottom of the slope along CSAH 151 smoothed out,vegetation established, and
erosion control blanket installed.
2. Acceptance of the wetland buffer along the bottom of the slope. We will have to have our wetland specialist
out there to take a look at it and decide if any corrective measures are required.
With the summer quickly coming to a close,you should contact some landscapers to see if there is anything which can
be done soon to get the seed and blanket installed so some of it can start to take hold before the growing season is over.

Melanie,
I performed an as-built inspection and the applicant has corrected the erosion along the south side of the house. I
cannot tell if what is planted in the wetland buffer area is of the appropriate mixture and it has not established itself.
We can send out the specialist from Bolton and Menk to inspect the buffer area. There are no signs or any sort of
markers to indicate where the buffer area begins either therefore it might be difficult to determine the buffer location.
There is some erosion taking place along the north property line where a path was cleared from CSAH 151. The
applicant has enough materials on hand to make the corrections but this area should be corrected and vegetation
established.

Mark,
Jesse Struve visited the property addressed 805 Forest Arms Lane to approve the as-built survey. While
Struve approves of the as-built regarding grading, etc, he stated a wetland specialist should approve the
wetland buffer, especially since the wetland edge and buffer area were no longer staked.
I asked the property owner to have the wetland edge and buffer re-staked before I sent an inspector to the
property. I spoke with the property owner this morning and he says the lot is re-staked and ready for
inspection. The property owner was complaining to me that all the run-off from the county road is prohibiting
the buffer from establishing. I told him I would mention it to the wetland inspector for his comments. . Attached
are photos from Struve's site visit along with the approved wetland buffer improvement plan and a partial copy
of the as-built survey.
Please visit the site at your earliest convenience and provide a written report following your visit.

I cannot tell if what is planted in the wetland buffer area is of the appropriate mixture and it has not established
itsel£ We can send out the specialist from Bolton and Menk to inspect the buffer area. There are no signs or
any sort of markers to indicate where the buffer area begins either therefore it might be difficult to determine
the buffer location.
There is some erosion taking place along the north property line where a path was cleared from CSAH 151.
The applicant has enough materials on hand to make the corrections but this area should be corrected and
vegetation established.

As a result of the as-built survey submitted, our City Engineer, Jesse Struve, visited the site and has the
following comments. Please address his erosion control concerns and once corrected please notify us and he
will visit the site again.
He also has concerns about the wetland buffer, but we do hold a separate escrow for the wetland buffer

I went out to perform the as-built survey for 805 Forest Arms Lane and have a couple concerns:
• There is still erosion taking place on the slope on the south side of the house. There is erosion control blanket
rolled up at the top of the hill. The erosion needs to be corrected prior to the as-built being approved.
• The area which is supposed to be a wetland buffer does not appear to be planted with the appropriate seed. It
appears to be a lawn type seed and not the native seed approved by the wetland.

Since receiving your phone call, I have researched your file and found that an as-built survey is required for
completion of the projects at 805 Forest Arms Lane. Once an as-built survey is submitted our engineer will
review the survey and visit the site. After the as-built survey is approved, I can refund the $2500 associated
with the building permit.
Next Spring after the buffer has started growing, please call so I can schedule a wetland specialist can visit the
site and very the buffer area is in conformance with the approved plans.
