GRANTING VARIANCES TO
MUNICIPAL ZONING CODE
SECTIOt�S 78-'f�79(6} and 78-16Q5

WHcP.�Qs, Joseph R. Fefdmann and Doneife L. Feldrnann, a married couple
(hereinafter "the Appiicants°) are the owners of the property located at 805 Forest Arms Lane
within the City of Orono (hereinafter the "City") and legalfy described as Lot 1, Block 2, Forest �`'`'����
�.
Arms, tiennepin County, Minnesota (hereinafter the "Property"); and
WH�R�AS, the Applicants have made application to the City of Orono for a
�dar�ance to Orono Municipai Zoning Code Section 78-1279(6) to aliow construc"tion of a new 20'
x 40' in-ground swimming pool, patio and retaining walls ahead of the average lakeshore
setback on the Prope�-iy; and
WN�R�AS, the Appiicants F�ave made appii�ation to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-16Q5 to aliow construction of one retaining
wall within the 50-foot wetland buffer and two retaining walls within the 10-Toot setback from the
buffe�; and
WHcR�AS, after due publisned notice and mailed notice in accordance with
f�innesata Statutes and tnA Orono, Niinnesota, Ci"ty Code, tne Orono Planning Commission held
a pubii� hearing on N�arch 17, 2014 at which times ali persons desiring io be h�ard concerning
tnis appfication were given the opportunity to speal: thereon.

1. This appfication was reviewed as Zoning r=il� number 14-36�5.
2. Tne Property is iocated in Yne LR-1 B One �amily Lakesnore Residen"tial �oning
Gistrict which requires a minimum lot area of 1.Q acre and a minimum lot width of
140'.
3. The Pianning Commission reviewed this application at a pubiic hearing hefd on
Niarch 17, 2014 and voted 6 for and 0 against on a motion to recommend
approval of the average lakeshore setback variance based on the following
findings:

a. The Property contains 48.665 square feet in area and has a defined width of
1 Q�-feet at the fake and 172-feet at the 75-foot setback.
b. Tne Property has a unique shape and is iocated at the northern most point of
th� channel which extends to Forest Lake. Du� to the nature of the
lakeshore the Property is somewl�at dis:;onnected trom the lake proper.
c. The location of the Applicants' home is partially ahead of the average
lakeshore setback fine. There is no conforming location lakeward of the home
to construct a pool.
d. The proposed patio, in-ground pooi and walis will meet th� 75-foot lake
setbacE:.
e. The Property will conform to the rardcover limi;ations o` a Tier 1 property.
f. The cor,stru�tion of the home in 2011 trigaered the es,abfishment of a 5C-foot
wetland quffer and at th� time tne City required a 20-Toot setback Trom the
bufrer Tor any stru�ture. In 2013, tne City's wstland regu�ations were
amended to eliminate the City buffer requirement and es;ablished a 35'
setback Trom the adge of a defineated wetland or a 10 foot setback Trom the
@GQ� 0` an estabfished buff?C TO!' struciures and 'nardCOV�I'.
g. Tne U�SIOpe edgA OF thA �JG T00� WBtiand buTTer extenGs �' ta �2' iandward
rrom tne 75 setba�k iine.
h. Tne most iakeward proposed wal! extends inio an existing 20' utility
easem�nt which extends across the Proraerty just west of the proposed pool.
The proposed wall is a repiacement of an existing wall in the same qeneral
iocaiior. The Appiicants should enter into an cncroachment Fegresment for
any improvements construcT�d within the existino easement.
i. The Appiicants' reauest is in harmony with the purpose and intent o` the
ordirance.
j. The Aapii�ants nave d�mor,strat�d that entor;,ing tne provisions of tne Zoning
Ordinance deprives the P,pp(icants o�th� reasonable use o`tneir Prop�rty.
k. The Applicants� proqo5ed elevated paiio is designed in a way wnich
minimizes impact of the visual encraachment as OppCSAd to the existing
elevated deck.

essAntial character of tne neighborhood and will resuit in minimal or no
negative impact on adjacent properties.
m. The Appli�ants' proposal to cor,struct patio, ir�-ground pool and walls ahead
of the average lakeshore setback will n�t adversefy impact iake views
�njoyed r"rom the adiacent home to the south.
4. The City Council has considered this application in�luding the Tindings and
recommendation of the Planning Cornmission, reports by City staff, comments by
the Aqplicants and the pubiic, and the effect of the proposed varance on the
health, saTety and welfare of the comrnunity.
5. Tne City Councii finds trat tne conditions existing on tnis Property are pe�uGar to
it and do not appiy generalfy to other property in this zoning aistrict; tr�a� g�anting
tne varance vvould na� adversely affe�t trafric conditiors, iight, air no- pos� a fire
hazard or other �ana�r to neignborinq property; wouid not merei�� serve as a
convenience to th� Appficants, but is necessary to alieviate a practical difticulty;
is necessary to preserve a subs,ant�al property right of the Appli:,ants; and would
�� in keeping with tne spirit and intent cr" th� �oning �od� and �omprehensiv�

3. The Appiicants shall enter into an Encroachment Agreement with the City prior to
issuance of a builciing permit for the walls to be constructed within the utility easement.

4. Authorities g�anted by this resolution run with th� PfOD�rty not with the Appiicants, but
are permissive only and must qe exercised by ob�aining a buiiding permit for the in-
grounG pool and retaining wall s and commencing constructior oT said proiect. ,A rooting
insp�ction must be complet�d Tor tne pooi and/or walls within one v�ar of the date of
Council apqroval, or the variances will expire on that �ate (Apri! 14, 2015).
5. Violation of or non-comqliance with any of the t�rms and conditions of this resolution
shali constitute a violation of the zoning code; shall automatically termirate any authority
granted herein; and sr�all be punisr�abfe as a misdemeanor.
6. The undersigned Appli�ants have read, understand and hereby agree to the terms of
this resolution and on behalf of the Applicants and the Appiicants' heirs, successors and
assigns, hereby agree ta the recording of this resolution in the crain of title of the
Property.
