Perimeter sediment control measures should be installed by the Contractor and inspected by the City prior to any work,

There appears to be some misunderstanding about the driveway and retaining walls.
• Item 1a in the letter refers to the driveway that enters from Fredrick Street and encroaches on 2490 Casco Point
Road. This driveway is existing and is currently the only open access to the property. It shouBd not have been
labels as"proposed".
• Item 1b-The retaining wafls on the plan are all existing except the entrance to the new garage.
• Item 1d—The item labeled as CW is shown as a Concrete Wash area.This should not be needed—all concrete
trucks must reclaim and recycle all waste concrete. I will request that the surveyor remove this unneeded item
form the site ptan.
• ltem 2 Landscape Plan.There will be no changes to the landscaping.The driveway and sidewalks are shown on
the plan.

On August 24,2016 the City received a building permit application for an addition. Staff conducted a preliminary review
based on the information provided and recommends the following items be submitted or revised in order for your
application to be considered complete and for the plan review to continue:
1. Certificate of Survey. Our engineer has reviewed the survey and has the following comments:
a. The plan depicts a driveway leading from the detached garage that encroaches upon 2490 Casco Point
Road. The driveway should be relocated completely onto the subject property keeping a 5' setback
from the edge of the property for grading. Reference City Code Section 78-967(b)(3), copy enclosed.
Or an easement should be developed and approved for this encroachment. Once recorded, please
provide a copy of the easement.
b. The plan depicts several retaining walls. The City survey requirements require the top and bottom of
wall elevations be shown. Any walls greater than 4' must be designed by a licensed professional and
plans submitted to the City for approval. Please provide updated information.
c. City utilities (sewer and water) are not depicted (enclosed is an as-built of the utilities for your
contractors and surveyor). The utilities should be added to the survey.
d. The survey depicts a square structure labeled CW near the new main driveway. Please clarify what
this structure is.
e. The average lakeshore setback line is not shown on the survey. Please have the surveyor add and
shown on an updated survey.
f. Top of Foundation. The top of foundation elevation is shown on the survey. Please have the surveyor
show the point or spot where the top of foundation elevation is in reference to. Please note,we expect
the location to be consistent when submitting the foundation as-built survey,

3. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow
amount for this project is$2,500. We currently hold a$700 escrow conjunction with the in-kind replacement
of the boat house. Please have the property owner sign the enclosed updated escrow agreement combining
both projects and submit a check for$1,800 at their earliest convenience. Please note, we will not issue the
permit until we receive the signed updated agreement and additional escrow money.

. Sec. 78-967. - Exception.
(a) The requirements of section 78-966 are not intended to govern the foilowing land alteration
activities:
(1) Normal and customary grading in the area of an existing or a newly constructed building,
or the grading of the driveway serving such building.
(2) Any earth movement less than 500 cubic yards which does not adversely impact the
existing drainage.
(3) Grading, filling or excavating of 50 cubic yards or less within the shore setback zone of all
lakes enumerated in article IX of this chapter.
(b) Such grading and earth movement shall be subject to approval by the building inspector at
the time of issuance of a building permit, provided that a plan showing proper drainage and
protection of adjoining property has been submitted. Where such earth movement is not
being performed in conjunction with a building permit, a separate land alteration permit shall
be required. Any unusual land alterations, including earth filling, removal or grading,
proposed by a builder shall be subject to a conditional use permit as provided for in this
chapter. The following land alterations shall be considered as unusual land alterations:
(1) All excavations for foundations in excess of 12 feet average depth if any amount of the
excess material removed below 12 feet depth is to be stockpiled on the site.
(2) Any additional fill brought on site in excess of 500 cubic yards, except for fill required to
raise grade for adequate frost footing protection, the intent being that structures shall
not be artificially raised above the preexisting surrounding topography.
(3) Grading or alterations that would propose any changes in elevations within five feet of
adjacent residential lot lines except for drainage swales and ditches.
(c) The building inspector shall have the authority to refer any requests for land alteration
permits to the city council for review and approval in instances where the land alteration
appears to potentially create negative impacts or be not in keeping with the goals and policies
of the community management plan.

I've reviewed the subject grading plan and offer the following comments:
1. The plan depicts a driveway leading from the separate garage that encroaches upon 2490 Casco Point Road. An
easement should be developed for this encroachment.
2. The plan depicts several retaining walls. The City Survey standards require retaining waBls top of wall and
bottom of wall eievations to be called out (Survey requirement#23). Walls greater than 4' in height must be
designed by a licensed professional, and plans must be submitted to the City for review prior to the approval of
the permit.
3. Care must be taken during the execution of the grading plan to make sure that surface and hardcover runoff are
not directed down the driveway and then onto neighboring properties of the city road.
4. City Utilities (Sewer and Water) are not depicted (as built attached for contractor and surveyors
reference). There is a sewer line and a manhole in the vicinity of where the proposed driveway from the
separate garage is depicted.
5. Plan depicts a square structure labeled CW new the new main driveway. Applicant should clarify what this
structure is.

Thank you for submitting the proposed project for our review. After reviewing the proposed project plans a MCWD
permit will be required for erosion control.The area of disturbance will be greater than 5,000 square feet according to
the submitted hardcover sheet. Attached you will find the required application materials.
It also appears that the proposed retaining wall will be within the 100-year floodplain zone (931.5').The District's
Shoreline and Streambank Stabilization and Floodplain Alteration rules will also be triggered. In order for the wall to be
permitted under our Shoreline and Streambank Stabilization rule, an engineer will need to provide documentation that
the wall will withstand expected ice,wave, and earth pressures according to section 10 of the rule (see attached). We
would also like to know the dimensions of the proposed wall.
The MCWD will need a calculation of the total floodplain fill and information on how this fill will be compensated within
the 100-year floodplain per the Districts Floodplain Alteration rule (see attached).Since a Floodplain Alteration permit
will be required, the project will also need to go through a two week public comment period to properties that are
within 600 feet of the proposed project.The public notice period cannot start until we receive an updated site survey
with the required documents.

We spoke Monday morning regarding our renovation and addition project located at 2480 Casco Point Road in Orono.
Per our conversation on this project, we do not foresee any reason that this would require additional review by the

We have reviewed and approved the electronic copy of the foundation as-built survey for the in-kind replacement of the
boat house. You may proceed with framing. A copy of this email authorizing yau to proceed should he kept on site
witF�the inspection card.
Also, please submit a full-size copy of the foundation as-built survey for our records. The electronic copy emailed must
be printed on 22"x 34" paper and we are only able to print up to 11"x 17" in-house.

ARROW LIFT ACCESSIBILITY:
The ELV INSTALL permit work has been completed and approved for the following project:
Permit Number: ELV1707-00241
Project Name: STEVE RUDOLPH
Site Location: 2480 Casco Point Rd, Orono
The Department of Labor and Industry is required to inspect and provide approvals on elevator related devices
prior to allowing them to be placed into service.
An Inspector from the Elevator Safety Section recently performed an inspection of the work performed under
the permit listed at the site above.The new installation is in compliance with the Department rules for
elevators.
NOTE: Compliance with Minnesota Rules and the ANSI/ASME A17.1, Safety Code for Elevators and Escalators
does not necessarily assure compliance with the Americans With Disabilities Act of 1990.
