Dear Melanie:
As requested, we have completed an engineering review of the documents submitted for the above
referenced project. Our current review is based on the documents listed below, and we offer the
following observations,comments, and recommendations for your consideration.
Submittal Documents
• Resolutions granting variances to sections 78-305, 78-1279, and 78-1288 and a CUP pursuant to
sections 78-966, 78-967, and 78-1286; dated February 27, 2012
• Certificate of Survey prepared by Egan, Field, and Nowak; dated April 29, 2013
• Certificate of Survey prepared by Egan,Field, and Nowak with additional proposed hardcover
• Grading and Floodplain Mitigation Plan prepared by Anderson Engineering; dated December 14,
2011
• Landscape Plan prepared by Anderson Engineering; dated December 14, 2011
• Architectural Plans and Elevations prepared by YA Architecture; dated May 1, 2013
• Foundation and Framing Plans prepared by YA Architecture; dated May 1, 2013
Review Comments
1. Per City Council resolution 6118, the following items should be conditional to the approval of the
building permit:
a. Council approval is based on the survey, site grading, landscape and house plans
submitted by the Applicants and annotated by City staff, attached to this Resolution as
Exhibits A, B, C, &D. Any amendments to these plans may require further Planning
Commission and City Council review.
b. Hardcover in the 0-75' zone shall be limited to 8,581 sf or 32.2%per the proposed
survey/site plan and hardcover allowance summary as depicted in Exhibit A. The
Applicants are advised that any future requests to increase hardcover or change the nature
of existing/proposed hardcover shall require City approval, and increases in hardcover
will not likely be approved without concurrent reduction in existing hardcover. The
current hardcover depicted on the Certificate of Survey is 8,871sf or 33.29%. The
plans must be revised to be in conformance with the approved resolution or request the
City to increase the allowable hardcover.
c. A lakeshore buffer shall be established and maintained in the areas shown on Exhibit C;
all landscaping shall be planted and maintained per the planting plan attached to this

Resolution as Exhibit C as annotated by Staff. The submitted Landscape Plan was used
as Exhibit C and has not been revised since approval of Resolution 6118.
d. Applicants shall not place any plastic or fabric liner material under any landscaping on
the property to ensure their permeability as non-hardcover surfaces. The Landscape
Plan should be revised to add notes accordingly.
e. Council approval is based on the Grading and Floodplain Mitigation Plan submitted by
the Applicants and annotated by Ci�y staff, attached to this Resolution as Exhibit B. Any
amendments to these plans may require further Planning Commission and City Council
review. The submitted Grading and Floodplain Mitigation Plan was used as Exhibit B
and has not been revised since approval of Resolution 6118.
f. Submittal of MCWD permit for floodplain alteration/mitigation shall be submitted to the
City prior to the issuance of a building permit. The Applicants will also rzeed a MCWD
permit for erosion corztrol,and a copy of all required permits should be submitted prior
to issuance of the building permit.
g. The home plans submitted are for the parpose of hardcover review. The construction
plans and survey submitted for building permit will be reviewed for conformance with
Orono's building height and number of stories calculation. Review of home plans for
conformarcce with height and number of stories calculation will be performed by the
Building Department.
h. Authorities granted by this resolution run wilh the Property not with the Applicants,but
are permissive only and must be exercised by obtaining a building permit for the new
construction and commencing construction of said project. A framing inspection must be
completed within one year of the date of Council approval, or the variances and
conditional use permit will expire on that date (February 27, 2013). The Applicartts have
requested and been granted an extension by the City.
i. Violation of or non-conformance with any of the terms and conditions of this Resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
j. The undersigned Owner and Applicants have read, understood and hereby agree to the
terms of this Resolution and on behalf of their heirs, successars and assigns, hereby agree
to the recording of this Resolution in the chain of title of the property.
2. Since this project will disturb the majority of the lot and is located directly adjacent to Lake
Minnetonka, it is recommended that a financial security of$5,000 for erosion control and
engineering oversight be required of the Applicants. The financial security is intended to provide
protection in the event that it becomes necessary far the City to install or maintain erosion and
sediment control within the project area and covers the cost of turf re-establishment if the
applicant is unable to follow through with the conditions of approval.
3. Perimeter erosion control devices (siltfence, rock construction entrance, and inlet protection)
should be inspected by the City prior to any land disturbing activities to ensure compliance with
the erosion control depicted on the Grading and Floodplain Mitigation Plan.
4. Tree protection fencing should be installed at the outside edge of the drip zone for trees to be
saved, and the fencing should be inspected by the City prior to any land disturbing activities to
ensure compliance with the locations depicted on the Landscape Plan. The areas requiring tree
protection depicted on the Landscape Plan do not correspond with the Grading and Floodplain
Mitigation Plan. The Landscape Plan should be revised to add fence installation notes
accordingly, and the Grading and Floodplain Mitigation Plan should be revised to correspond
with protection areas depicted on the Landscape Plan.
5. Inlet protection should be placed on the proposed yard drain after installation and removed only
after permanent site stabilization. The Grading and Floodplain Mitigation Plan should be revised
accordingly.

6. If a concrete washout is to be used on-site,the plans should be revised to provide a detail of the
washout and show where it is to be located.
7. A record drawing of final grading elevations should be submitted after grading is complete to
ensure compliance with floodplain mitigation depicted on the Grading and Floodplain Mitigation
Plan.

Charles Truwit, Applicant, was present.
Curtis stated in 2009,the property owners applied for and received approval to redevelop the subject
property in order to make it more saleable. The property owners have received annual renewals of those
applications. The applicants have an interest in purchasing the property. With the exception of a few
cosmetic changes to the property,they wish to construct what was initially approved.
The applicants are proposing to slightly increase the size of the proposed footprint by 19 square feet over
the previous approval. The proposed home consists of 3,409 square feet of structural coverage. A second
floor continues to be proposed over a portion of the house, although the applicants are proposing to move
it further west for a more central location. The change results in less massing for the adjacent lot.
Also being requested is an increase in hardcover from 30.1 percent approved hardcover to 36 percent
within the 0-75 foot zone. The hardcover numbers were recently adjusted by the applicant. The increase
in hardcover being requested is primarily to allow a tear drop configuration of the driveway.
The Planning Commission voted in January to recommend approval of a CUP and to recommend denial
of the increase in hardcover. The Planning Commission had recommended approval of the hardcover
variances with the removal of the proposed tear drop driveway.
Curtis stated the colored overhead view reflects the Planning Commission's recommendation relating to
the driveway. The Planning Commission recommended approval of the existing hardcover for the
driveway with the exception of the green and red areas as well as the addition of hardcover to provide
access to the front door. In addition, the Planning Commission recommended approval of the lot area and
lot width variances, approval of the requested side yard setback variance, approval of the requested 75-
foot lake setback variances, and approval of the CUP for grading within 75 feet of OHWL.

have agreed to plant addifiional shrubs or trees to screen the proposed lakes�'�3e�deck. Staff continues to
recommend approval of the inclusion of a vegetative, shoreline buffer to infiltrate stormwater runoff
along the southwest lakeshore area in the place of the proposed sod as illustrated on the landscape plan.
The Council should discuss the various elements of the application and determine an appropriate level of
hardcover for the property. In addition,the applicant should be required to provide a revised plan and
revised survey prior to final Council approval.
Rahn asked when Staff recommends approval of the 32.2 percent hardcover,whether that is more or less
than what was approved in 2009 plus the 19 square feet. Rahn noted Staffs report states that 8,899 square
feet was approved by Resolution 5841, but noted there was some swapping with the driveway.
Curtis stated the front page of Staff's report shows the levels approved originally. Those hardcover
numbers have since been adjusted to account for the removal of a piece of property belonging to the
adjacent lot. Curtis noted the revised hardcover numbers have been adjusted on the second page of Staffs
report, t�['Ch i he 8,028 square feet. The Planning Commission is recommending approval of an

Curtis noted Staff did receive an e-mail today that has been distributed to the Council from an adjacent
property owner.
McMillan asked where that property owner is located.
Curtis illustrated on the overhead the location of that property.
Bremer noted the concern relates to headlights and privacy.
Rahn asked as it relates to the 5-foot setback, what the next level of distance is. Rahn asked if the 5-foot
conflict is only for the last 10 feet.
Curtis indicated it is and that it is closer to l2 feet. The lot line was adjusted in the past to reflect a
chimney on the adjacent home. Today there is a carport that goes to the property line on the subject
property.
Rahn asked whether 10 feet is required there or 30 feet.
Curtis indicated it is a 30-foot setback since it is a two acre zoning district. The proposed home is
consistent with the home's current footprint.
Tom Owens, Attorney-at-Law, stated he would like to supplement Staf�s review with five additional
points. Before the Council tonight is an application seeking these variances because the plans in 2009 had
one key oversight; namely,the driveway near the house lacks two features to make the driveway safer and
more practically useable. The plans were drawn up in 2008 and modified several times in 2009. Those
plans were drawn up for a hypothetical buyer.
Owens stated his second point is that the findings made by the City Council in June 2009 all apply to this
application with one exception, which is that instead of a slight decrease in hardcover, there is a slight
increase from 31.5 percent to 36 percent.
The third point is that the only genuine issue before the City Council is whether the hardcover change is
reasonable and whether it will alter the essential character of the locality. The applicant urges the City
Council to find that the request is reasonable. The subject property is surrounded on three sides by water.
The property located at l 101 West Ferndale was granted hardcover of 52.6 percent in 1995 for a
replacement residence.
In addition,the dwelling and lot nonconformities and parcel configuration are truly unique to this lot,
which means that whatever the Council does tonight will not set a harmful legal precedent. It is
extremely unlikely that another homeowner will come before the Council and make a similar request.
Owens noted the legal landscape has changed recently and the bar for variance approval has been
considerably lowered by the MN Legislature. The practical difficulty standard allows the property owner
greater latitude.

Dr. Truwit stated what he is attempting to do is live within the spirit of what was already approved but
that there were a couple of items that were either deficiencies or oversights with the original approval.
Truwit noted the previously approved house has no door on the lake side of the house, which is
inconceivable that someone would construct a house on the lakeshore without a door to access that area.
Dr. Truwit noted the original proposed house and driveway were to be elevated as well as the garage floor
per the previous variances. Truwit stated the thing that caught his attention the most was the elevated
driveway. Due to the issues associated with the elevated driveway as previously approved, Truwit
indicated he is proposing the area in green. Given the current configuration of the driveway without the
extension, if someone is backing out in the winter and the driveway is icy, a vehicle could slide over the
retaining wall. The Planning Commission agreed with that premise since it is a safety issue.
The second issue before the City Council is one of practical difficulty. Currently you have to back out
into the neighbor's driveway or back all the way out to the road. That situation is going to raise the risk
that someone is going to back up and go off the driveway. Truwit indicated he would like to have a
turnaround so that people can drive out facing forward.
Truwit stated he has only recently learned ofthe neighbor's concern. With the current configuration of
the driveway, the headlights will hit the neighboring home when someone enters the driveway and when
someone leaves. With the tear drop,the neighbor would experience only one set of headlights.
Truwit displayed a picture of the lot showing the trees on the property. Given the substantial number of
trees, Truwit stated he is not sure what the neighbor will see. Truwit indicated they are not proposing to
remove the trees and are, in fact, proposing to plant more trees, which will increase the privacy. This
issue was not raised at the Planning Commission meeting.
Truwit stated they will be taking out the patio that was requested be removed, removing the carport, and
freeing up the space between the two properties the best they can, but that that they would like to use the
existing foundation. Truwit stated he has talked to the neighbors about the project and they have
indicated they would like to see the carport removed, which is being done. Truwit stated he is asking for
a slight increase in hardcover, but that in his view it is a reasonable request.
Truwit stated he initially attempted to point out to Staff that the neighbor has over 50 percent hardcover.
They are requesting 31.6 percent. Staff pointed out it is not an apples to apples comparison, which he
understands, but that he would request the City Council consider what the hardcover numbers would be if
that portion of the driveway is added to their property. Truwit stated according to his calculations, it
would be between 39.5 and 42.5 percent hardcover. Truwit pointed out their request is still well below
what the most immediate neighbor has for hardcover and that he is asking for something very reasonable
in order to address some safety concerns.
Franchot asked about the conservatory on the second floor.
Truwit indicated it is more of a four-season room. Concerns with the conservatory were also included in
the comments from the neighbor. Truwit stated there is no conceivable way the neighbors can see the
conservatory from their property.

Franchot commented his concern with the conservatory in general is that if it is used at night, it will be
quite brightly lit.
Truwit indicated if they do use it at night, it would be with the lights off and that it is not going to be a
center of activity during the nighttime. Truwit illustrated the line of view from the neighbor's house to the
conservatory.
Franchot asked whether there would be lights in the conservatory.
Truwit indicated there will be.
Franchot commented the residence is larger appearing with the second floor and high peak and that he has
a concern the glass structure will be lit and bright for the whole lake. Franchot stated the concern also
relates to future property owners.
Truwit stated the shades would be down at night and not lit up so people can see what they are doing.
The principal concern raised at the original City Council meeting was the proximity to the adjoining
property and the proximity to the lake, which is why their plans do not put the second story right up to the
corner and instead step it back.
Rahn asked if the existing home is a single story.
Truwit indicated it is.
McMillan asked if the driveway needs to be elevated due to the floodplain.
Curtis indicated it does.
McMillan commented the elevated driveway may be more as a result of the MCWD than the Orono City
Council.
Truwit indicated there was no MWCD approval applied for with the last application, which has been
taken care of with this application. The MWCD has reviewed this application and Staff has been
provided with their findings.
McMillan commented the Council would love to have a driveway without a retaining wall but that it may
not be possible in this case. McMillan asked if the driveway would be raised all the way out to Ferndale.
Truwit indicated the straight part is elevated approximately six or seven inches and that the portion near
the house has to be raised a foot and a half.
McMillan stated whenever there is a shared driveway arrangement, the City gives some credit for the
hardcover, and asked whether that has been done in this case.

Curtis indicated that is what the revised hardcover calculations show on the second page of Staff's report.
Staff removed the portion of the driveway that only benefits the neighbor and everything that the subject
property needs to access the property is included in the hardcover numbers.
McMillan asked whether anyone has any issues with the patio being converted into a deck.
Bremer and Printup indicated they do not.
Rahn stated as it relates to the driveway, in his view the circular driveway is excessive and that he is not
in support of the turnaround. Rahn commented there might be more headlight issues with the tear drop.
Rahn stated he is not sure why the City Council would allow the blue driveway area since it appears the
applicants have a plenty wide turnaround without the blue area.
Truwit indicated the blue currently exists and that it would be removed with the addition of the
turnaround.
Rahn stated he would go with Staff's recommendation and pointed out that it is a lot more house than
what was there before and that in his opinion it would have an impact on the character of the
neighborhood. Rahn commented that he has received complaints from other citizens about ramblers
being changed to two-story residences.
Rahn stated as it relates to driveways in general,the City Council gets very detailed on how wide
driveways can be, along with turnarounds. Rahn stated it appears that there would be plenty of room to
turn a car around and asked whether the engineer agrees with that assessment.
Curtis indicated he does.
Rahn stated if the applicant would like to rearrange the driveway and perhaps remove a third garage stall,
the application can be tabled for redesign.
Truwit indicated he did remove some of the existing hardcover and that he is not interested in redesigning
his plans. Truwit noted this is the last one-story house in the neighborhood and that the other homes have
already been converted or have been approved for redesign. Truwit stated the character of the
neighborhood has already changed and that the current house is not livable the way it is.
McMillan commented the applicant has a right to construct a second story but that it will have some
impact to the neighboring property. As it relates to the driveway, in an ideal world without the need to
limit hardcover, it would be elegant. McMillan stated in her view the applicant does have enough room to
back cars in and out of the driveway. McMillan stated she understands why the applicant would like that
amenity but that in her opinion there are already concessions being made with the location of the house.
Truwit stated the current house is an eyesore and that they are proposing a solution. Truwit stated he has
given the City Council his rationale for the turnaround and that he would like to proceed forward with the
rest of the house.

Curtis stated the applicant is proposing to redevelop the subject property and construct a new residence.
They are requesting a lot width variance, a lot area variance, hardcover variances, as well as a side street
setback variance. Due to the topography and shape of the lot,the majority of the driveway for the
existing home is located in the right-of-way along with some other encroachments.
The applicants' proposal includes a setback variance from the right-of-way to allow a 10-foot setback
where a 15-foot setback is required; an average lakeshore setback variance to allow a small portion of the
covered porch to partially encroach two to three feet; and a hardcover variance to allow 46 percent
hardcover. All of the encroaching improvements within the right-of-way are proposed to be removed and
the right-of-way will be restored with vegetation.
The Planning Commission voted 5-0 to recommend approval of the request. Staff also recommends
approval of the variances. '
Curtis noted this application has received supporting comments from the neighbor to the north,who
would be affected by the average lakeshore setback variance. Public Works has also commented today on
the applicant's right-of-way vegetation plan and they are satisfied with the proposed improvements. The

Have you received and/or approved a floodplain mitigation permit and erosion control permit applications for the project
to construct a new home at 1105 Ferndale Rd W? (Chip Truwit) They recently submitted a building permit application;
we will require copies of MCWD permits.
Also, I'd like to discuss coordination of escrow securities with you. Our engineer is recommending that we collect $5000
escrow for erosion control purposes (instead of our $2500 minimum). I don't want to be overly heavy handed with our
escrow requirement if you will also a significant amount. What are your thoughts?

2. PURPOS�OF�SCFiOW. The purpose of the escrow Is to guarantee relmbursement to the Clry far all
out-of-pocket costs(fncluding planning, englneering, or legal conaultsnt revlew)the City has lncurred to assure that the
erosion control measur�s are installed and malntalned so the Sub�ect Properry complles wlth the provlslons of Orono
Clty Code Chapter 79. The flnancial security may also be used by the City to elfminate any hazardous conditions
asaocfated wlth the work attd to �epair any damaga to public property or Infraetructure that le caused by the work. !f
compliance with the approved 6ullding Permlt is not accompllshed wtthin the allowable tlme perlod,the City may bring

3. RlGWT OF ENTRY. The Owners h�reby grant the City,its agents,employe�s,o�cers and contractors
the rlght to enter the SubJect Prope�ty to perform all work and lnapectione deemed approprfete by the Clty In conf unctlon
wfth the required erosian control measures, lncluding but not Ilmited to constructing or completing any and all of ths

:2. PURPOSE OF E3CROW. The purpose of the escrvw is to guarantee reimbursement to tha City for all
out-of-pocket costs (ncluding planning, engineering, or legal consultant review)the City has lncurred to assure that the
erosion control measures are installed and maintained so the property complies with the provisions of Orono City Coda
Chapter 79. The financial securlty may also be used by the City to eliminate ariy hazardous condltlons associated with
the work and to repair any damage to publlc property or tnf�astructura tnat is caused by the work. If complian�e with the
approvetl Land Distu�bance Permit is not accomplished within-the allvwable tlme period,theCity may bring tho proJcet
lnto compllance by use of the securlty.
a, RfGWT OF ENTRY. The Owners hereby grant the Clty, its egent5, employees,officers 9nd CAnt�eCtofS
the rlght to enter the property to pertorm all work and Inspectlons deemed approprlate by the City in conjunction with the
required eroslon control measures,I�eluding but not limited to constructing or completing any and all of the agreed upon
Improvements should the Owners' contractor not complete those improvement�by the date specified herein.
'3. MONTHLY BILLING. As the City receives consultant bllls for incurred costs, the City wi�� in turn sena .

4, DISBURSEMENT FROM ESCROW ACCOUNT. In the ev�nt that the Owners dc �ot make payment
