John—
Sorry for the delayed response. I can meet with you and John Adams tomorrow (Tuesday) at 9:00 a.m. or 2:00 p.m.;
Wednesday at 10:00 a.m. would also work.
The Notice of Decision received from Courtney Hall indicates that the MCWD accepts the location of the delineated
boundary between wetland and upland, and accepts the classification of the two types of wetland on the property.
However, it does not make any conclusion as to whether the wetlands are contiguous with the OHW of Lake
Minnetonka for City zoning purposes.
We met with Brandon Wisner of MCWD on July 22 and discussed this with him. He agreed that based on the channel
connecting the open lake with the wetland, it is entirely possible that the 929.4 OHW contour extends into the wetland.
From a zoning standpoint, we have evidence (topographic surveys) for both properties immediately west of yours(980
and 1070)that shows the 929.4' contour at or near the wetland/upland boundary, and both those homes were required
to meet the 75' setback from the 929.4' contour. For the property at 960 West Ferndale, the 929.4' contour is not
shown on the Anderson Engineering survey on file. Until that information is provided, we cannot make a conclusion as
to whether your setbacks would be based on 1) 75'from the 929.4' contour or 2) based on 20' setback from the upland
edge of whatever wetland buffer is required by the MCWD. We believe the MCWD would require a 25-foot buffer based
on item 6(f) of the MCWD rules, which can be accessed at the following:

Let me know when you wish to meet.
Mike

Subject: Meeting request to discuss 960 Ferndale setbacks
Hi Mike,
i
 . ..
As you may recall from our meeting in late June, I'd like to tear down the Floyd house and hold the 960
property as long as possible as nice looking green space. The only structure would be the existing garage, which
I have already repaired and painted.
The key follow-up item from our meeting was to get clarity on whether the north and east part of the property
was wetlands or Lake Minnetonka. You recommended I check with MCWD for their determination.
On July 17 Courtney Hall of the MCWD issued an e-mail copying Christine Mattson at the city with the
MCWD's Notice Of Decision describing the area in question as wetlands.
Pd like to meet with you to discuss this determination and confirm setbacks befare I proceed with the tear down,
which could start as early as next week.
Do you have any time available Wednesday after 10:30, Thursday from 9-11 or Friday after 11:00? Hopefully
John Adams can join us.
Thanks,
John
