It appears that at that time the Council was amenable to allowing a new fence within the right-of-way with a 10-foot setback from the paved roadway. The direction given was that an encroachment agreement would be required, the fence could be as close as 10-feet from the roadway and 42 inches in height, if monuments were proposed and/or if the fence/monuments exceeded 42 inches (up to 6'), variances would need to be reviewed by the Planning Commission and then approved by the City Council. There was no support for a fence which exceeded 6'at all. I have attached a few pieces of information including the variance application packet. Please note our hardcover regulations have changed and the hardcover information listed within the variance packet is NOT accurate. Please refer to the 2"d attachment labeled Hardcoverinformation Packet-2013.pdffor the most accurate hardcover information. Also, the 2013 deadlines have not yet been updated. If you are still proposing gates please follow the guidelines in the attached Entrance Monument packet. Upcoming variance application deadlines are as follows: • Noon on Wednesday, January 23�d (PC meeting on February 19tn) • Noon on Wednesday, February 20t" (PC meeting on March 18tn) • Noon on Wednesday, March 20th (PC meeting on April 15tn) An encroachment agreement was not ever formally drafted for your project. Once you make an application for (right of way) permit or variance I will request that our attorney prepare a draft for your review and signature. Once you get your fence design formalized I'd be happy to review the process with you again so we are all on the same page. Also, finally, as you know, the dynamic of the Council has changed a bit since 2009 so I am not sure how to advise you on whether or not the support you received with the 2009 Council will continue with the current (2013) Council. Our Mayor, Lili McMillan, was a councilmember at that time and perhaps you would like to speak to her about this to test the waters prior to making an official application... Attached is a survey of John and Joan Brooks property at 905 Ferndale showing the proposed fence location along Ferndale. Also included is an elevation of the fence, showing a fairly open/transparent fence design that is 4' tall in height. Please review the drawings consult with Melanie when she is back in the office next week and then contact me to discuss next steps that will be needed in order to allow a permit to be issued for this project.
