The Orono Council met on the above date with the following members present: Mayor Grabek, Councilmembers Peterson, Sime, and Goetten. Councilmember Callahan was absent. The following represented the City staff: City Administrator Bernhar,dson, Public. Works Coordinator Gerhardson, Police Chief Kilbo, Building & Zoning Administrator Mabusth, Septic & Zoning Aide Knott, and City Recorder Peterson. City Attorney Blatz was also present. CONSENT AGENDA* It was moved by Councilmember Councilmember Goetten, to approve subject to removal of the following City Administrator Bernhardson: #4 - #1176 Richard Putnam #9 - #1185 Gary Carlson #21- Administrator's Information Reduction) Motion, Ayes 4, Nays 0. Sime, seconded by the Consent Agenda* Items requested by (Goose Population RECOGNITION OF FIRE CHIEFS City Administrator Bernhardson explained that about a month ago the Council was informed that the insurance service office rating for hydranted areas was reduced from Class 7 to Class 6. Council felt it appropriate to recognize the Fire Chiefs of the four Communities that serve the City of Orono at a Council meeting. He noted that Chief Ray McCoy of the Maple Plain Fire Department was unable to attend this meeting. City Administrator Bernhardson introduced Chief Don Bryce of the Mound Fire Department. Chief Bryce has been with the Mound Fire Department for 22 years, serving the last three years as Chief. He is a carpenter by occupation serving as foremen and deals with fire restoration work. Chief Bryce stated that he attended the International Association of Fire Chief's conference last week in St. Louis with Chief Paul Klapprich of Wayzata. He stated that it was a very informative training conference. He stated that the Mound Fire Department was established in 1923 and currently has a force of 37 fire fighters. Their equipment consists of 3 pumpers (1,000 gpm to 1,500 gpm), 1001. aerial ladder, grass rig, and heavy duty van. Orono emergency calls to the Mound Fire Dept. during 1985 to 1986 were 19% of the total calls; Orono's 1987 year -to -date calls are up to 23% of the total calls. In response to Mayor Grabek's question, Chief Bryce stated that, based on what he saw at the conference, the 1 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 RECOGNITION OF FIRE CHIEFS CONTINUED Mound Fire Departments' equipment, manpower, and training is compatible to comparable cities. City Administrator Bernhardson introduced Chief Paul Klapprich of the Wayzata Fire Department. Chief Klapprich stated that the Wayzata Fire Department was established in 1912 and currently has a force of 30 fire fighters. Their equipment consists of a 2,000 gpm pumper, snorkel pumper, rescue van, and utility van. In 1986, only 3 emergency calls of the total 107 calls were from Orono. In 1987 year -to -date they have had 9 emergency calls from Orono. He noted that the increase is in part due to the dry summer. City Administrator Bernhardson introduced Chief Rick Perry of the Long Lake Fire Department. Chief Perry is an Orono resident and operates Perry's Auto Service in Long Lake. Chief Perry has been on the Long Lake Fire Department for 20 years and served as Chief for the past five years. Chief Perry stated that the Long Lake Fire Department was established in 1915 and currently has a force of 27 fire fighters which includes two women firefighters. Their equipment consists of 3 pumpers, 2 tankers, rescue truck, utility pick -up, and a boat. He noted that the boat and the oldest 1956 pumper needs to be replaced. In 1986, 68 emergency calls of the total 121 calls were from Orono. The total calls for 1987 year -to -date are 117, noting again the dry summer accounting for the increase. He noted that there are a number of false emergency calls of non - permit burns or persons not calling in their burning permit number. He felt this issue should be addressed. Mayor Grabek asked about the strategy for fighting a f ire on Big Island. Chief Perry stated that due to the elevation and proximity of the homes on Big Island, they would probably only be able to protect the surrounding property of the house on fire, feeling that during certain times of the year it is an extremely difficult situation. City Administrator Bernhardson stated that the Maple Plain Fire Department was established in 1930 and currently has a force of 30 fire fighters. Their equipment consists of 2 pumpers, 2 tankers, grass rig, and a rescue van. In 1986, 13 emergency calls of the total 138 calls were in Orono. Total 1987 year -to -date calls are 121, predicting to set a record this year. 7 ■ MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 RECOGNITION OF FIRE CHIEFS CONTINUED City Administrator Bernhardson mentioned that all four departments are volunteer departments. APPROVAL OF MINUTES* It was moved by Councilmember Sime, seconded by Councilmember Goetten, to approve the Minutes of the August 10, 1987 Council meeting as submitted. Motion, Ayes 4, Nays 0. LAKE MINNETONKA CONSERVATION DISTRICT REPORT There was no LMCD Report. PLANNING COMMISSION COMMENTS Planning Commissioner Bellows had no comments as this time. PUBLIC COMMENTS Irene Standa, 2659 Casco Point Road, noted a problem of speeders on Casco Point Road, noting that there are many little kids in the area. She also noted the accident last week involving child. Chief Kilbo suggested that the local residents report the license plate numbers of cars speeding to the police department, in addition to keeping children from playing in the road. City Administrator Bernhardson noted that the narrowness of Casco Point Road gives the perception that cars are speeding. He noted that he was contacted by Chief Kilbo regarding last weeks accident and the Chief had reviewed possible appropriate actions he would be taking. ZONING ADMINISTRATOR'S REPORT: #1176 RICHARD PUTNAM 2765 CASCO POINT ROAD VARIANCES FINAL RESOLUTION City Administrator Bernhardson stated that this application was conceptually approved by Council at their August 10th meeting. In the interim a thorough review of the plat map and survey indicated that the 20' strip at the east end of the survey is actually the 20' dedicated for right -of -way on the plat of Spring Park, although only a small portion of the actual traveled roadway is within this 20' corridor. This technically results in the need to grant a front (street) setback variance for a 20' setback instead of the 30' required, although the paved roadway will still be 40' from the garage. Staff recommends final approval of the proposal including this additional variance. Richard Putnam was present for this matter and stated he 9 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 #1176 RICHARD PUTNAM CONTINUED approved of the revised drafted resolution. Councilmember Goetten noted the numerous variances requested in this application involving a very limited substandard lot which is one reason to carefully review and /or deny. Planning Commissioner Bellows felt that the Planning Commission should review the additional variance before Council takes action. ' It was noted that at applicant's request to avoid a time - consuming tabling, Planning Commission voted 4 -1 to deny the variances noting that additional facts would be needed to fairly consider the average setback issue. It was moved by Mayor Grabek, seconded by Councilmember Peterson, that due to the additional information Application #1176 be referred back to the Planning Commission for recommendation. Motion, Ayes 4, Nays 0. #1179 ORONO COMMUNITY CHURCH ' 770 & 950 OLD CRYSTAL BAY ROAD SOUTH SUBDIVISION OF A LOT LINE REARRANGEMENT RESOLUTION #2249 Orono Community Church representative Gary Connell was present for this matter. City Administrator Bernhardsori explained the application for a Class I subdivision involving a rearrangement of a lot line between Lots 1 and 2 to accomodate constrcution of additions to the Church structure to meet all current setbacks from the newly created lot line. Councilmember Goetten noted concern that this rearrangement could severly limit any future expansion for the Church. Gary Connell stated that the the church is aware of this fact and are now working on a revised commercial site plan. It was moved by Councilmember Goetten, seconded by Councilmember Sime, to adopt Resolution #2249 approving the lot line rearrangement per staff recommendations. Motion, Ayes 4, Nays 0. 11182 LISA AND MARTY DIETRICH— BLOCRER 458 LINDEN AVENUE VARIANCE RESOLUTION #2250 City Administrator Bernhardson explained the request for a front setback variance to install a new foundation to the west portion of the existing house. When the house was first built this was a porch but now is part of the primary structure. Applicant is also proposing to extend construction along the front line of the house. A new foundation was installed for the principal structure less than two years ago. Zoning Administrator Mabusth stated that applicants property consists of three separate lots totaling .77 acre in a 1 acre zone and recommended combination of the -four lots as a condition of approval. After discussion, applicants agreed to this condition. It was moved by.Councilmember Sime, seconded by Mayor Grabek, to adopt Resolution #2250 approving the variance per staff recommendations and subject to combination of the four lots. Motion, Ayes 4, Nays 0. Lisa Blocker asked what right the City had to come onto their property without their presence or consent and dig footing holes? She stated that they are trying to adhere to the City's procedures, yet the City abuses their property in this way. Zoning Administrator Mabusth stated that she was not aware that this occurred until after the fact. She noted that there was some question whether the City had approved the previous footings. She stated that staff dug approximately one foot down around one of the existing footings. Marty Blocker stated that he showed Councilmember Peterson the new footings under the existing house and also showed her the two footing holes dug around his house, noting that the City did. not even have the respect to re -fill the holes. Councilmembers Peterson and Goetten confirmed seeing the footing holes dug by staff. Marty Blocker also noted that a new foundation was approved to be installed under the existing house in 5 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 #1182 LISA AND MARTY DIETRICH— BLOCKER CONTINUED 1986 without requiring a survey. He now is requesting to replace the remaining foundation area and is required to submit a survey and obtain a variance which is costly to him in addition to wasting two months working time for this procedure. Mayor Grabek directed staff to check in the matter of digging footing holes and review the application to determine if a fee adjustment is appropriate. #1183 JACK SWENSON 3020 NORTH SHORE DRIVE AFTER— THE —FACT VARIANCE City Administrator Bernhardson explained the request for an after - the -fact. hardcover variance to allow the construction of a stairs and deck platform within 75 feet of the shoreline extending from the dock over the rip -rap area onto the shore. This structure apparently replaced a similar sized existing structure. Generally, council has not allowed structure within 0 -75' noting that the only exceptions have been in areas of steep 'topography, a 4' wide walkway has been allowed for safe access. Jack and Kathryn Swenson were present for this matter. Jack Swenson explained the rip -rap contractor had destroyed the existing platform. In replacing the platform, 'they were not aware that a permit was required because they believed it was just work on the dock. He felt that their situation is unique and would not set a precedent if approved. He noted that his property consists of 550 feet of channelshore and 278 feet of lakeshore which puts a significant amount of area within the 0 -75' zone. (The proposed increase in hardcover is less than 1 %, and the total hardcover in the 0 -75' setback is less than 1%.) Because of the channel, the location for the safe dock is restricted. He noted that the neighbors are in favor of the structure and submitted a petition. He feels that the platform is a beautiful structure that is consistant with the neighborhood. He does not feel that these unique conditions would be found in other circumstances, therefore not setting any precedent. Kathy Swenson asked the Council to consider the aesthetic value of their structure. She stated that they understand the need for codes to protect the lakeshore. She stated that there are so many unattractive things on Lake Minnetonka needed out of necessity for recreational purposes such as marinas, lights, boat launches, cranes. She hopes that the aesthetic values are not lost through these restrictive codes. MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 #1183 JACK SWENSON CONTINUED In response to Councilmember Peterson's question, Jack Swenson stated that the previous platform was about the same size of the new 161x16' octagon platform. Councilmember Goetten noted that the platform is mostly over rip -rap rock, therefore the platform is hardcover over hardcover. She felt this was an opportunity, with such a unique situation, to approve this structure without setting a precedent, being it is primarily a replacement structure. Councilmember Sime viewed the property and found the structure to be very impressive. He felt that considering the rip -rap that prevents run -off into the lake, the massive amount of area for absorption of water, and minimal increase in hardcover makes this an insignificant issue. He also felt that the key issue was that it is a replacement platform. Zoning Aide Knott noted that the pink rock with plastic under it consisting of 7400 s.f. was not calculated in the hardcover calculations and should appropriately be included in the 0 -75' calculation. Mayor Grabek stated that they have to be concerned not only about the run -off and hardcover on the shoreline, but about building structures in the 0 -75' zone. Approval of which would be a precedent noting that others have been turned down for different types of structures irregard less of the cost expended. He felt a stairway platform over the rip -rap would privide ample access to the dock. He felt that they should preserve the lakeshore and the structure should not be considered aesthetically. - Neighbors present at the meeting confirmed that the previous platform was about the same size as the new platform; and stated they were very much in favor of the replacement platform. Planning Commissioner Bellows noted that the majority of the Planning Commission (4 -2) felt that in the past there has been an inequity in the system and a blind spot regarding protecting the 0 -75' area in that the precedent has been set that the only way to look at these situations is by leaving it a blank slate. She felt that some consideration be given in keeping some sense of the lake as a gracefully elegant place. If the City's intent is to protect the lake physically, they also ought to consider the issue of making the lake useable and making the lake a pleasant place to be. 7 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 #1183 JACK SWENSON CONTINUED Which in turn gets into the issue, whether the City likes it or not, of dealing with things on an individual basis, which was very much the consensus of the Planning Commission. Mayor Grabek did not feel that the Councils have been blind to the 0 -75' zone, in which approval has been given in situations where a hardship is present, such as steep slope, permanent docks due to ice damage. He felt their purpose was to protect the shoreline regardless of the looks. He felt the Planning Commission has been misdirected in approving this structure. It; was moved by Councilmember Sime, seconded by Councilmember Goetten, to approve the after - the -fact hardcover variance to allow a deck platform within 75 feet of the shoreline per the findings as listed by the Planning Commission. Motion, Ayes 3, Nays 1. Mayor Grabek voted nay stating that the Council was shirking their responsibility to the 0 -75' and setting a precedent. Additionally, he would like the Planning ,..Commission be given some direction in order to follow the guidelines as set forth in the City code to protect the 0 -75'' zone. Motion carried. #1185 GARY CARLSON 965 EDGEWOOD HILLS ROAD RENEWAL VARIANCE RESOLUTION #2251 City Administrator Bernhardson explained the request for a renewal variance approved by the City in 1983. The only substantial change the staff recommends is the granting of an underlying road and utility easement over an existing easement that has been designated as a part of a future turnaround for Edgewood Hills Road. Gary Carlson was present for this matter and found no problem with the proposed revision as stated. It was moved by Councilmember Goetten, seconded by Councilmember Peterson, to adopt Resolution #2251 approving the renewal variances subject to granting the City an underlying road and utility easement over an existing easement that has been designated as a part of a future turnaround for Edgewood Hills Road; and subject to notifying staff if additional fill is needed. Motion, Ayes 4, Nays 0. #1169 WILLIAM WEAR OLD CRYSTAL BAY ROAD /WATERTOWN ROAD SUBDIVISION - CONCEPTUAL REVIEW William Wear was present for this matter. City Administrator Bernhardson explained the conceptual 0 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 #1169 WILLIAM WEAR CONTINUED review of a proposed subdivision on 18.5 acres. Three options (A,B & C) have been submitted. Planning Commission recommended Option C because the roads have been aligned and found no problem with the creations of Outlots B & C for future development as long as appropriate covenants are filed against each outlot. Because of staff concerns regarding creation of unbuildable outlots i.e. maintenance, tax forfeit, future code standards, and precedent; staff recommends that Outlots B & C either be required to be combined with the adjacent lots - Option E (to be divided at a future date if sewer is available and future zoning finds outlots buildable); or to do away with Outlots B & C and the area combined with adjacent residential lots _ Option F. Bill Wear stated his preference for Option C. He is opposed to staff's recommended Options E & F because he believes the Outlots will be buildable in the future and wants to retain these outlots himself. CABLE TV REPORT ""After clarification to Council regarding the proposed Options, it was moved by Mayor Grabek, seconded by Councilmember Goetten, conceptually approving Options E or F (applicant's choice) per staff recommendation. Motion, Ayes 4, Nays 0. City Administrator Bernhardson reviewed the Dowden Cable Systems rate restructuring (of which the City has no control over) and channel re- alignment. Staff recommends that the Council stay abreast of the channel realignment issue through its representative and that should Councilmembers receive calls regarding the rate increase that they should have the individuals complaining write letters to the cable system expressing their objections with copies to both the City of Orono and Lake Minnetonka Cable Communications Commission. It was moved by Mayor Grabek, seconded by Councilmember Goetten, that the Council accept the information regarding the cable system rates and channel realignment. Motion, Ayes 4, Nays 0. CITY ADMINISTRATOR'S REPORT: CITY FACILITIES STUDY - CONSULTANT SELECTION City Administrator Bernhardson noted that at the Council's August 10, 1987 meeting, Council moved to undertake a space study for the City facilities and tabled the issue of selecting a consultant and the amount of work authorized until this meeting. 0 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 CITY FACILITIES STUDY — CONSULTANT SELECTION CONTINUED It was moved by Mayor Grabek, seconded by Councilmember Sime, that Council select Jack Boarman and Associates as the consultants to undertake the space study of the facilities for Phase A and that the consultant and the City Administrator report back with the results of Phase A and a recommendation as to which phase or phases should be undertaken to complete this study including Phases B, C and /or D. Motion, Ayes 4, Nays 0. Jack Boarman was present for this matter and stated he looked forward to working with the City. JEFF ESSEN 2648 CASCO POINT ROAD BERM IN RIGHT —OF —WAY Jeffrey and Barbara Essen were present for this matter. City Administrator Bernhardson explained that during the landscaping at 2648 Casco Point Road, the owner placed approximately 3' to 4' earth berm in the front of his property. The berm is approximately 90% in the City street right -of -way. Staff recommends that the berm be allowed to exist in the right -of -way but at a reduced size so as to allow a 5' to 10' shoulder, maintain proper drainage, no plantings allowed on the road side of berm with the exception of grass. In addition staff recommends a hold harmless agreement for the purpose of the City maintaining the water shut -off valve located within the berm. The property owner has also requested a double curb cut on the property. Because of the amount of traffic, traffic speeds, site distance and road design, staff recommends that only one curb cut be allowed. Jeff Essen showed Council the site plan submitted with the application for a new residence building permit. After the building permit was issued, a landscape plan was designed which has led to the berm and double curb cut issue. He stated that they can resolve the berm issue per staff recommendation. However, they would request approval for the double curb cut for the same reasons that staff feels it is a hazard. They feel it is safer not to back out of the drive onto Casco Point and drive out in a forward position. He also noted that the circular drive provided more parking area in order to avoid parking on Casco Point Road. He explained that his house entry was specifically designed for a circular drive, and elimination of the circular drive would create aesthetic and incovenient access problems to the main entry of the house. 10 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 JEFF ESSEN 2648 CASCO POINT ROAD BERM IN RIGHT -OF -WAY CONTINUED City Administrator Bernhardson stated that a driveway turn - around could accomplish the same safe access onto Casco Point Road as a circular driveway. Jeff Essen pointed out that the turn - around would have to be constructed within the front yard (aesthetically not pleasing) as opposed to the standard turn - around off to the sideyard of the property. He also noted that there are several circular driveways on Casco Point Road. Public Works Coordinator Gerhardson stated his concern was the heavy foliage near the second curb cut obstructing views to access onto Casco Point Road. Councilmember Goetten found no problem with the double curb cut and agreed that it would provide safer and easier access onto Casco Point Road. 'It was noted that the City Engineer has not reviewed this matter. City Attorney Blatz advised that the Council obtain the City Engineer's recommendation- if the Council plans to deny the double curb cut drive. It was moved by Councilmember Goetten, seconded by Councilmember Sime, to approve staff recommendation regarding the berm and approval the double curb cut as proposed. Motion, Ayes 2, Nays 2. Mayor Grabek and Councilmember Peterson voted nay. Councilmember Peterson stated she felt a back -up` apron was more appropriate than a double curb cut. Motion tied. The Essen's questioned why they were not informed of the double curb cut problem prior to this i.e. when the building site plan was submitted? Mr. Essen noted that the circular drive was not an afterthought, but the design of the house was based on the circular drive. It was moved by Mayor Grabek, seconded by Councilmember Sime, to direct the City Engineer to review the access to determine if there is a safety concern and table this matter pending the City Engineer's recommendation. Motion, Ayes 4, Nays 0. HIGHWAY 12 MEETING WITH MNDOT Council acknowledged September 2, 1987 at 7:00 P.M. at the Orono School Cafeteria as the meeting date on Highway 12 to discuss the potential upgrade of the transporation corridor. 11 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 MINNEHAHA CREEK WATERSHED DISTRICT APPOINTMENTS City Administrator Bernhardson noted the vacancies on the Minnehaha Watershed District along with a letter from the Lake Minnetonka Conservation District with three individuals named that would -like to fill the vacancies. City Attorney Blatz explained the reasons for the the two vacancies. Mayor Grabek suggested that the Executive Director of the Lake Minnetonka Conservation District, currently Frank Mixa, serve as the LMCD represenative on the Minnehaha Creek Watershed District. No formal action was taken. PUBLIC INFORMATION — EVALUATION City Administrator Bernhardson explained the issue of determineing whether the City of Orono will continue with the "Mayor's Article" on a monthly basis or budget for a different format for its monthly "newsletter" to the community. He felt that the current format has °proven to be a timely means in most cases of the primary information to the community. Council thanked the Weekly News am Pioneer representatives in attendance for their assistance in this matter. It was moved by Councilmember Sime, seconded by Mayor Grabek, that the "Mayor's Article" format for communication of inforamtion to the community be continued in the weekly newspaper, soliciting ideas from Councilmembers and the public as to topics they would like to have addressed and the system be evaluated next August in the budget meeting. Motion, Ayes 4, Nays 0. HIGHWOOD STORM SEWER REQUEST Council tabled this matter until the Highwood residents could be notified to attend the Council meeting to discuss this issue. 1950 SHORELINE — SETTLEMENT AGREEMENT* It was moved by Councilmember Sime, seconded by Councilmember Goetten, to table this matter until the September 14, 1987 Council meeting. Motion, Ayes 4, Nays 0. BID AWARD — FAIRWAY MOWER* It was moved by Councilmember Sime, seconded by Councilmember Goetten, to award the bid to Kromer Co. for Alternate Bid #2 for one used Long. Tractor with Roseman Hydrogang Model 445 Fairway Mower for an amount not to exceed $14,794.00. Motion, Ayes 4, Nays 0. 12 MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 24, 1987 CITY FACILITIES - SEWER HOOK -UP DEFERRAL* It was moved by Councilmember Sime, seconded by Councilmember Goetten, that the City formally grant itself a temporary delay in hook -up until such time as the appropriate consultant studies have been completed regarding the City facilities and further delayed should the City choose to build facilities that would not utilize the current arrangements for hook -ups to be reviewed by the Council no later than December 31, 1988. Motion, Ayes 4, Nays 0. ADMINISTRATOR'S INFORMATION City Administrator Bernhardson explained the issue regarding the DNR establishing a ten day (September 1- 10) limited season to reduce the goose population which has become problematic in several areas of the metro area including Orono near Long Lake and Long Lake. The City has received one request to hunt on the Cox property located on the southeast corner of County Road 6 and Willow Drive North. Under very 'controlled circumstances, staff will issue up to 5 permits in accordance to City guidelines. Councilmember Goetten suggested monitoring the number of geese killed during this special season in Orono.
