a Miiulesota Non-Profit Coiporation, (lzereinafter "the applicant") is the owner of the
property located at �65 Ferndale Road I�Torth within the City of Orono (hereinafter t}Ze
"City") and legally descriUed as follows:

�VHEREAS, tl�e applicant has made application to the City of Orono for a
conditional use pennit per Orono Municipal Zoning Code Section 78-418 (3) in order to
conduct land alterations in the area between the church building and County Road 6,

12' x 24' shed; and

3. The Plaiuzing Commission reviewed this application at a public hearing
held on September 18, 2006 and recommended approval of the conditional
use pei7nit for the land alterations and proposed shed based on the
following findinas:
a. The applicant has met all City Etigineer recommendations.
b. All buildii�.g setbacic requirements are met.
c. No addiiional li;hting, excepl lhaL requiiecl by tiie building code, is
proposed.
d. The proposed storage shed�vill meet all building height requirements.
e. The conditional use pernlit standards of Section 78-916 (a) (1-3) are
mei.
4. The Plamling Commission revie�ved the si�nage element of this
application at a public hearin� held on September 18, 2006 and
recommended approval of the conditional use pernlit for a campus
monument si�i as well approval �f the si�n size variance, bui
reconlmended denial of the variance for l�eight based on the followin�
findings:
a. The property is approximately 4.35 acres in area and has fi�ontage
alon�Ferndale Road North and County Road 6 (Sixth Avenue I�Torth).
b. The ctu-rent Orono Zoning Code does not have siQil standards for
instiiutional uses allo�ve�d conciilionaliy wiliiiri Resitiential �isYl-icts.
Within Resideiltial Districts a nanleplate si�n �vith a maxitminl of 12
s.f. is peilnitted.
c. The existing montlment si�i is outdated, and in disrepair; th� netiv
monument si�z will ve niodei�Z, larger, nlatch th� architectllral style of
the ile��-1�- reconstructed cht�tch and ��-ill be easie-r to see and read from
the intersection.

d. The new monument si�n will conforni to Zoning Code Section 7�-
1466(11) z�egarding nlonument signs, and will have total a sign face of
42 s.f. plus an emblem within the "gable end" of the sign area.
5. The City Council finds that the height variance for an additional 6" is
appropriate for this site only Uecause it will have the follo�ving
characteristics �vhich support its approval:
a. The sign is located in compliance with the setbacks established within
the Orono Sign Code and �vill have no negative visual impacts because
of its hei�ht.
b. Tl�c- pl�ysical separatiot� bettiveen the bt�i:ding and the si�1 is such that
the additional 6" of hei�ht is an architectural scale characteristic that
�vill allo�v for a visual consistency and coiuiection between the
chlu�ch's steep roof pitch and the si�l's design.
6. The City Council finds that the coluix�barium is a use similar to a cemetery
and is rlot an allowed use in the RR-1B district, and therefore caiulot be
approved without an amendment of the zoning code.
7. The City Council has considered tllis application including the findings
a?id reconzmendatioi7 of the Plaluling Conunission, repo�-ts by City staf.f,
conuilents by the applicant and the �ublic, and the eftect of�the proposed
conditional use pernlit on the l�ealth, safety and�velfare of the commtinity.
�. Tl�e City �eu�lcil f't.lds that the conditions exisliug on tl�is pro,�erty a�e
�eculiar to it and do not appl_y �enerally to other property in this zonin�
district; that grantin�the conditional use pen�lit wotild not advei•sely affect
traffic conditions, light, air nor pose a fire hazard or other dan`er to
11ei�hboring property; would not merelv serve as a convenience to the
applicanl, but is necessary to alleviat�e a demonstrable hardsllip or
ditficuit}; is necessary to preserve � substantial propei-[y right of the �
applicant; aild �j�ould be in kee�ing �vith tlle spia-it a�ld intent of the ZoninU
Code and Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
�-ants a conditional use petznit per Orono Municipal Zoiling Code Section 78-418 (3)
coudllct lazld alteratioils in the area between the church buildin� and County Road 6, and
t0 CO11SL1'L1Ct 1 IZ' x 24' shed; and grants variances to Section 78-1467 to a11ow placement
of a sign �vith 42 s.f. and 10'6" in height, subject to the following conditions:
l. Council approval is based on the site plans suUmitted by the applicant and
aiu�otated by City staff, attached to this Resolution as Exllibit B. Any
amendnients to the site plan which are not ii1 conformity with City codes will
require furtller Planning Commission and City Council review,
2. Any additional lighting beyond that required by the Building Code will require
approval of a separate conditional use pennit.
�, BL111CI111� peimits are required prior to commencement of all of the aspects of the
proj ect.
4. Prior to issuance of a buildin� pern7it of the �adin� portion of the project the
applicant witl provide the City �vith a Developer's Agreement in lieu of a Letter
of Credit for the improvements.
5. Any and all existing and forthcomin� City Engineer recommendations shall be
incoi-�orated into the final plans. ' '

7. Autliorities �ranted by this resolution run �vith the property not with the applicant,
but are pernlissive only and must be eYercised by obtai�zinQ a buildin� permit for
the ne�v construction within one year of the date of Council approval, or the
conditional use pei�nit will espire on that date (l�Tovember 27, 2007),
