In return for issuance of said Demolition Permit, the undersigned owner hereby agrees to:
1. Submit a survey, aerial photo or sketch showing all structures on the property. Note which structures are
-.to be demolished.
2. Submit a survey, aerial photo or sketch showing proposed erosion control measures in accordance with
Chapter 79, Construction Site Runoff Control.
3. Submit a copy of permit approval from the Minnehaha Creek Watershed District (MCWD). The City will
not issue a demolition permit without a copy of the permit(s) from the MCWD or documentation stating
permit(s)are not required. �����

4. Submit a$2,500 escrow and an escrow agreement signed by the property owner(copy attached).
5. Keep all structure(s)enclosed and/or secured untii such time as demolition is complete.
6. Keep ail demolition debris off adjoining property andior the public rights-of way unless specific prior
approval is obtained in writing for temporary use thereof.
7. Completely remove foundation(s}from the ground.
8. Completely dispose of ali demviition debris off site in accordance with ali applicable PCA requirements.
9. Abando�water wells in accordance with State Heatth Depanment regulations.
10.'Cail for an inspection when ali debris has been removed, before backfifling.
11. Within 5 working days of superstructure removal, a final inspection shall be requested. The site shall be
left clean and clear of all debris, with any excavabon filled with earth level with the adjacent ground
elevatio� (except when such excavation is to be used as part of a new building and such new building is
actually under construction).
12. Abandon septic systems per Minnesota Rules Chapter 7080. All septic tanks must be pumped, crushed
and filled with native soils. An inspection is required after the tanks are pumped and before the tanks are
crushed and filled.
13. The undersigned owner shall and hereby does indemnify and hold harmless the City of Orono, its agents,
employees and assigns from and against all claims, damages, losses or expenses, induding attomey
fees, against the City, its agents, employees and assigns arising out of or resutting from the demolition
described herein as performed by the property owner, his employees,agents,subcontractors or assigns.

This permit is not transferable without District approval, and is valid to the date of expiration. No
activity is authorized beyond the expiration date. If the permittee requires more time to complete
the project, an application for renewal of the permit must be received by the District at least 30
days before expiration.
The applicant is responsible for compliance with all District Rules and for the action of their
representatives, contractors, and employees.
Conditions: Project to be completed as described in plans submitted to the
MCWD office on August 23�d, 2016 according to the provisions of this permit.
• Properly install and maintain all required erosion control measures until the
disturbed areas are re-stabilized
• Notify MCWD in writing upon completing installation of perimeter and
sedimentation controls
• When the site is re-stabilized and the MCWD staff has performed a final
inspection, all perimeter control must be removed

Inspection/Analvsis/Monitorinq Fees
A site inspection and monitoring by District staff will be performed where the activity involves:
• a commercial/industrial/multi-family residential development
• a single family residential development greater than 5 acres or of any size if within the
Minnehaha Creek subwatershed
• any alteration of a floodplain or wetland
• dredging within the beds, banks or shores of any protected water or wetland
• a violation
• any project which in the judgment of the District staff should be inspected due to project
location, scope, or construction techniques
In these cases, the applicant shall pay to the District a fee equal to the actual costs of field
inspection of the work, including investigation of the area affected by the work, analysis of the
work, and any subsequent monitoring of the work, which in the case of a violation shall be at
least $35.

1. An application for a demolition permit has been filed for �d0/ /.��o located at

2. I� conjunction with the demolition, erosion control measures are required as shown on attached
Exhibit"B".
NOW,THEREOFRE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporan�ousiy with the execution of this Escrow Agreement,
the Owners shall deposit$2,500 with the City. Alt accrued interest, if any, shall be paid to the City to reimburse the
City for its cost in administering the escrow account
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarentee reimbursement to the City for
all out-of-pocket costs(induding planning,enginesring,or Isgal consultant�eview)the City has incurred to assure that
the erosion control measures are installsd and maintained so the property complies with the provisions of Orono City
Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous oonditions
associated with the work and to repair any damage to public property or infrastructure that is caused by the woric. If
compliance with the approved Land Disturbance Permii is not accomplished within the a{lowable time period, the City
may bring the project into compliance by use of tt�e securiry.
3. R1GHT OF ENTRY. The Owners hereby grant the City, its ageMs, employees, officers and
contractors the right to enter the property to perform all work and inspedians deemed app�opriate by the City in
conjunction with the required erosion control measures,including but not limited to constructing or completing any and
a(I of the agreed upon improvements should tfie Owners' contracfor not complete those improvements by the date
specified herein.
3. MONTHLY BILIING. As the City receives consultant bills for incurred costs, the City will in tum
send a bill to the Owners. Owners shal! be responsible for payment to the City within 30 days of the Owners' receipt
of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above,shal)issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners io
reimburse the Ciry for eligible expenses the City has incurred.
, 5. CLOSING E8CROW. My remaining amount of the finanaal security deposited with the City for
faithful performance of the plans and specfica�ons and any related remedial work will be released after the ,
; wmpletion and inspection of all such measures and the establishment of final stabilization for the Subject Property.
i City Staff shall review the terms of this escrow agreement two times per year to determine v►fiether the requirements
of the projed have been sucxessfully completed and whether it is appropriate to retum the funds. Owner may also
requast the release of the funds, and such funds shall be released upo� City Staff receiving the appropriate
verification that all requirements of#he project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the proJect is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject properiy pursuaM to Minn.Stat.§§415.01 and 366.012.
