Summary
In order to preserve the residential character of neighborhoods and prevent competition with licensed
marina businesses, rental of boat slips on residential docks has been limited in the City of Orono since
1962. Rental of boat slips on residential properties has been prohibited entirely since 1995.
The City Code sections when taken together comprise the City's rules for rental of residential boat slips or
docks are many and are scattered throughout the zoning code. These code sections are outlined within a
City handout attached as Exhibit A. This informational handout with the lengthy title "Orono Municipal
Code Excerpts Regarding Prohibition of Boat Slip Rental in Residential Zones" is also lengthy in content.
� Staff is proposing a zoning code text amendment which will not change the rule but rather state�the
current rules more clearly and succinctly within a single code section.

The Orono Municipal Code prohibits residential property owners from renting out boat slips at
their private docks. The provision of slippage for anyone other than the owners or occupants of
the property, regardless whether there is a 'rental fee' involved, is prohibited. Such activity is
considered to be the 'business of docking, mooring or storing boats' which is only allowed within
the B-2 Lakeshore Business District.

The following Municipal Code sections apply:
Section 78-661: Definition: "Marina Business" means engaging in one or more of the permitted,
accessory or conditional uses allowed within the B-2 Lakeshore Business District.
Section 78-665: Within the "B-2" Lakeshore Business District, no land or structures shall be
used except for one or more of the following uses:
(1) Rental of in-water boat slips...
...(4) On-land storage of boats, winter and summer.
Sections 78-302/303/304; 78-327/328/329; 78-347/348/349: (LR-lA, LR-1B, LR-1C One Family
Lakeshore Residential Zoning Districts, list of permitted, conditional and accessory allowed uses).
None of these single family residential districts include 'rental of in-water boat slips' or 'on-land
storage of boats, winter and summer' as allowed uses. They do allow "private docks" as an
accessory use, 'subject to the City Code and other applicable regulations, including boat storage
density requirements'. While 'private docks' is not defined in the zoning code, the City has
contended and the court has upheld that a private dock is an accessorv structure which by
definition is a use "exclusively used for purposes incidental to those of the principal use", i.e. for
the use of the owners or occupants of the property.
Section 94-36/37/38: Re: Joint Use of Lake Facilities. This Section requires annual licensing for
adjoining riparian property owners who wish to share a dock. It does not allow for business use of
private docks.

94-71: Definitions
"Business Use" means engaging in either a marina business or the business of docking,
mooring or storing boats. �
"Marina Business" means engaging in one or more of the pernutted, accessory or
conditional uses allowed within the B-2 Zoning District.
"Business of Docking, Mooring or Storing Boats" means renting or otherwise providing
" space, including boat buoys, for docking, mooring or storing one or more boats belonging to
persons other than the owner or occupant of the property, except when licensed as a joint use.
94-76: License Required. It is unlawful for any persons to engage or participate in business use
without first having obtained an annual license therefor from the City.
94-100: Business Use Licenses Limited to B-2 Zone. No business use sha11 be licensed in any
zoning district other than B-2, except when a business use is allowed by ordinance in another
zoning district, such use conducted in said district shall not be required to obtain a license.

What You Should Know About... RES/DENTIAL DOCKS
More than 1/3 of the residential lots in Orono abut the lakeshore. With nearly 40 miles of Lake
Minnetonka shoreline, and additional properties abutting Long Lake, Mooney Lake, French Lake,
Dickey's Lake, Lake Katrina, Lake Classen and Lydiard Lake, Orono is home to an abundance of dock
owners. The following rules and regulations govern the placement and use of private residential docks in
Orono: �
• Seasonally installed docks are a permitted accessory use for residential properties which abut the
lakeshore and contain a principal residence structure.
• New seasonal docks require a one-time permit($30.) and may be reinstalled at the same location
annually thereafter without additional permits(Fee Schedule,p. 8). .
• Permanent docks require a Conditional Use Permit(Zoning Code Sec. 78-1113) and may require
additional permits from the Lake Minnetonka Conservation District(LMCD) and the Minnesota
Department of Natural Resources(DNR).
• Rental of residential dock space is not allowed. Such activity is considered to be a commercial
use,which is allowed only in the B-2 Lakeshore Business District(Sections 94-71 thru 94-101).
• Sharing of a single dock by three or more adjacent lakeshore owners is allowed subject to
City Council approval of a Joint Use Dock License(Sections 94-36 thru 94-38).
• Placement of docks on Lake Minnetonka is governed by the Lake Minnetonka Conservation
District(LMCD). Minimum setbacks from the extended property lines are required. Contact the
LMCD for further information (952-745-0789). For other Orono lakes, contact the Building &
Zoning Deparhnent(952-249-4600). Minimum setbacks(similar to those in effect for other types
of accessory structures) will be required, and special permits may be required for docks which
must cross a wetland to reach open water.
Municipal Docks. The City of Orono does not provide municipal docks for private boat storage, and has
no "commons" areas for public dockage. The City does provide a small number of fishing and swimming
docks, typically at locations where roadways were historically platted to the shoreline. Canoe rack rental
spaces are available at Summit Park on Long Lake to Orono residents on a first-come first-served basis.
Orono is home to 5 commercial marinas providing in aggregate a tota.l of more than 450 rental slips.
Additionally, publi� landings on North Arm and Maxwell Bay in Orono provide approximately 150 car-
trailer parking spaces for transient boaters.

Subject: Dock Rental Regulation Code Background
The City initially regulated the rental of docks via Ordinance No. 43 adopted Apri123, 1962.
That ordinance defined the"Business of Docking or Storing Soats" as "Renting or otherwise
providing space for docking or storing three or more boats belonging to persons other than
the owner of the property upon which said boats are docked or stored". That ordinance
further stated that a license is required to be engaged in the business of docking or storing boats,
and that no license shall be issued unless the property involved is in the commercial zone.
Ordinance No. 51 adoptecl April 8, 1963 slightly revised the definition by adding the clause "or
adiacent to which said boats are moored",recognizing that mooring buoys are an alternative
method of boat storage.
Ordinance No. 166 adopted June 25, 1974 again slightly revised the definition to read as follows:
"Renting or otherwise providing space, including boat buoys,for docking, moorin�, or
storing three or more boats belonging to persons other than the owner or renter of the
property upon which said boats are docked or stored, or adjacent to which said boats are
moored". This new language allowed the renter of lakeshore property to have the right to store
a boat on the property.
Ordinance No. 173 adopted December 19, 1974 revised the definition again,this time to read:
"Renting or otherwise providing space, including boat buoys,for docking,mooring, or
storing three or more boats belonging to persons other than the owner or renter of the �
property upon or from which said boats are docked or stored, or adjacent to which said
boats are moored".
The 1984 recodification of the Municipal Code resulted in additional minor changes to the
definition: "Business of Docking, Moorin�, or Storing Boats means renting or otherwise
providing space,including boat buoys,for docking, mooring, or storing three or more
boats belonging to persons other than the owner or�e�occunant of the property�ge�
,
�ee�e�".
The definition underwent a significant revision with Ordinance No. 117, 2"d Series adopted June
28, 1993: "Business of Docking, Mooring, or Storing Boats means renting or otherwise
providing space, including boat buoys, for docking, mooring, or storing�ee one or more
boats belonging to persons other than the owner or occupant of the property, except when
licensed as a ioint use". This revision effectively disallowed the rental of�slips at private
docks without a business license. Ordinance 117, 2°d Series also separated out the joint use dock
licensing requirements from the marina licensing requirements. Note that the clause "except
when licensed as a joint use"would not apply to most dock rental situations,because a joint use
license can only be obtained by a group of riparian or non-riparian landowners within a
subdivision.

Finally, Ordinance No. 132, 2"d Series adopted January 23, 1995 was a complete overhaul of the
B-2 District standards, and for the first time, "Rental of in-water boat slips"became a perxnitted
use in the B-2 District, where such use had not previously appeared as a permitted, accessory or
conditional use. This is significant in that such use is allowed specifically in the B-2 and not in
other districts, so the use functionally became prohibited in all other districts.
Conclusion: From 1962 through 1994, one or two boats not belonging to the
owner/renter/occupant could be stored at a residential dock in a residential zone. Starting in
1995, no boats not belonging to the owner/renter/occupant of a property could be stored. that is
still the case today.

Introduction
Gardening and other horticultural uses are currently allowed in Orono as accessory uses within
residential zoning districts.A permitted principal use mus't be present on the property prior to
the accessory use being allowed. This means,a house must exist on the property before a dock,
a shed,or even a garden may be allowed. Crop farms are currently allowed and require a
minimum of 10 acres of land. Orono's Zoning Code defines crop farms as"a parcel of land
comprising an area of ten or more acres that are used for the growing of plants,trees or shrubs
with or without profit". In the rural residential districts(RR-1A, RR-1B, RR-16-1) crop farms are
allowed as a permitted or principal use; and within the lakeshore residential districts (LR-1A, LR-
1B, LR-1C& LR-1C-1) crop farms are allowed as a conditional use.
Community gardens are used throughout urban areas to provide opportunities for residents
without adequate space on their own property to plant and maintain a plot in a larger, multi-
tenant garden.Some community gardens are created by non-profit and/or volunteer groups in
order to grow needed healthy,fresh foods for donation to local food shelves.
The City was recently approached by individuals interested in creating a community garden in
Orono. The community garden would be run by volunteers. They propose to utilize vacant
property to plant and maintain a garden for the purpose of donating the harvest to a local food
bank/charity. Two of the properties discussed by the interested parties were the vacant lot on
the northwest corner of Wayzata Boulevard and Willow Drive (aka Stonebay Outlot A)and the
City-owned lot east of the Long Lake/Orono Fire Station. The Stonebay lot is currently zoned RR-
1B but is guided for B-6 PUD or non-residential. The City-owned lot is zoned RR-1B residential.
In April,the City Council directed staff to study zoning code text amendments regarding
community gardens. It made sense to include private, residential gardens in the study of
community gardens. Within the residential zoning districts text amendments would be
necessary in order to classify private gardens as a principal, permitted use.This may allow the
� owner of a vacant residential property to create a garden plot for their personal use absent a
principal structure.
Analysis
Private gardens on vacant properties, if properly maintained, may have little to no negative
impact on the immediate neighborhood. However a garden requires regular maintenance,
monitoring and upkeep.Orono has property maintenance regulations that would also apply to
garden properties so they do not become a nuisance. As previously mentioned, a shed is not

permitted on a property where a principal use (house) is not present. It may be appropriate to
allow a minimal garden shed on the property in conjunction with a private garden to allow for
adequate storage of hoses,shovels,wheelbarrows and other necessary gardening equipment to
keep the property tidy. Fencing should also be considered as many gardens require a sturdy
fence to keep out animals such as rabbits or deer.
Multi-tenant community gardens are typically found in higher density,smaller lot, urban sized
neighborhoods.Some cities or neighborhoods have a specific property designated and available
for use as a community garden. A distinction should be made between a single-user community �
garden such as a charity or non-profit group growing food to donate and a multi-user garden
where individual plots are divided offfor individual use. There are benefits and unique
challenges with both types.The City can control how the garden is used and maintained via the
use of a permit. A permit fee may be imposed to cover costs if the community garden is on a
City-owned property. As community gardens typically exist within residential areas the issue of
farm stands or other related commercial uses should be discussed.
Much of Orono is made up of 2-acre zoning districts with many of the lots greater than 2 acres in
area.Orono strives to maintain its rural character, and while they have rural feel, community
gardens distributed throughout the City on private properties may not be consistent with our
goals as a City. Nor do we have a clear understanding of the level of need for this type of use in
Orono. Because the recent interest expressed to the City was specifically regarding a single-
user,volunteer-run, not-for-profit type of community garden perhaps the focus should be spent
there.
Options may include:set minimum standards for private gardens as a principal use within all
residential zones and add community gardens as a principal, conditional or even interim use in
residential zones;add community gardens to be accessory to an institutional use allowed by
CUP such as schools, churches, etc; designate a specific City-owned property or properties for
use as a community garden for a single user(non-profit, etc). The City could issue a permit and
impose conditions as well as a fee to cover staff time and the water usage bill for the season.
The City-owned vacant lot behind the Long Lake/Orono Fire Station on Willow is one example of
a potential site which was explored by the interested parties for a community garden.
There are specific challenges associated with allowing any type of community garden on either
public or private property.The challenges could become long-term problems if the property
owner is unwilling or unable to be responsive to issues. There are a number of issues that don't
fall under the Planning Commission's review including but not limited to use of a City-owned
property, determining the appropriate user of a City-owned property and access to water.
These are decisions the City Council must make from a policy standpoint.

The Planning Commission should discuss and make recommendations regarding the following
issues for discussion:
1. Property Size: Is a certain size property more appropriate for a community garden?
2. Zoning:
a. Are certain zoning districts a better fit than others?
b. Should a community garden be limited to residential districts?
c. Is a garden use appropriate on a commercially zoned property(I, B-1, B-2, B-3,
B-4, B-5, B-6 or B-6 PUD)?
3. Is a multi-user community garden an appropriate use for Orono? Is a single user/non-
profit community garden an appropriate use?
4. Would an Interim Use Permit(IUP)which includes a sunset date be an appropriate
mechanism for allowing a community garden?
5. Garden Sheds:

Summary&Staff Recommendation
�In order to address the desire for locally grown foods,encourage a healthier community and
enhancement of green spaces, staff finds that while there are a few minor logistical challenges
with private residential gardens on vacant properties it may be appropriate to amend the zoning
code to allow private gardens as a permitted use in each residential district. Consideration
should be given to the issues around fencing and garden sheds etc.
Staff finds that community gardens require a different approach altogether. There are many
considerations to take into account regarding a community garden. The Planning Commission
should discuss each of the issues outlined within this report and give general direction to staff
and Council. Ultimately the City Council must determine their interest in moving forward with
allowing private gardens, community gardens(and what type(s)to allow),where community
gardens are appropriate, and the use of City property for that purpose.
The Planning Commission should review the sample definitions in Exhibit A and decide on the
most appropriate definitions for"private garden" and "community garden". Staff recommends
approval of a zoning code text amendment to allow private gardens as a permitted use on
residentially zoned properties as well as the following standards—private gardens should be set
back at least 10 feet from all property lines; a garden shed should be permitted up to 50 square
feet and must meet principal structure setbacks for the appropriate zone; and fencing may be
permitted in conjunction with the standards in Zoning Code section 78-1405.
Staff further recommends approval of a zoning text amendment to allow single-user, non-profit
community gardens within the City in accordance with the following: community gardens may
be allowed on only City-owned property in conjunction with a permit and fee;the user should
be a non-profit group and proceeds should be donated to charity; principal structure setbacks

Kellogg stated the road has been classified as a reconstruct for a number of years but it has not risen to the
level that it needs to be put on the five year CIP. The treahnent being recommended by the Public Works
Department is to dig up the bad spots,put down some new class five, and then new pavement over certain
select areas,which should extend the life of the road another five years. They are estimating$6,000 to
seal coat the road and$26,000 if it is milled and overlaid. Kellogg indicated the City will not get any
extra life for the additional$20,000.
The City Council took no formal action on this matter.
MAYOR/COUNCIL REPORT
Rahn asked if the energy assessment conducted by Xcel has ever been acted on or moved forward and
whether any recommendations from the report were implemented.
Loflus indicated that Don DeBaere or Lyle Oman would be able to respond to the status of the energy
assessment.
Rahn stated it sounds like the City would get a three year payback,and that if the City is still able to get
the rebates, it would be a win/win situation.
McMillan requested the City Administrator get back to the Council on the Xcel energy audit.
McMillan noted the Long Lake Fire Department's pancake breakfast is scheduled for Sunday,April 17th,
at the Willow Drive fire station.
McMillan stated the Council briefly spoke about a community garden in Orono at a work session and that
some of the discussion centered around the location of the garden. Private land was mentioned as well as
possibly having a community garden on the fire station land just east of Willow Road. McMillan stated
the City Attorney would need to comment on whether city-owned land would be able to be used.
McMillan commented since it is now April 11`�'and the growing season is approximately one month from
now, it may not be possible for this year. McMillan indicated the plan is to give the food that is growri to
the local food shelves.
Mattick commented they are seeing more community gardens. Mattick indicated he did speak about this
at the Staff level. At the present time the City's ordinances require at least 10 acres for crop sharing. The
site in question does not have that amount of acreage so it would require a code amendment.
Mattick stated he is not sure how much time the Council would like Staff to spend on drafting the
ordinance. Mattick indicated it can be streamlined to avoid the Planning Commission and that in his
opinion something like that can be accomplished in a month if the City Council is just interested in
changing the acr�age requirement. Mattick noted there has been some discussion and regret expressed in
the past from the Council about skipping the Planning Commission on different items. Mattick stated
from a procedural standpoint it can be accomplished in a relatively short period of time.
McMillan asked what could be done from now until the next Council meeting.

Mattick stated the Council will need to look at what a reasonable amount of land would be and that Staff
could research other cities' ordinances to see what they require. Mattick indicated the acreage
requirement could be reduced or eliminated and that a draft ordinance could be brought back before the

Franchot suggested the City of Long Lake also be contacted to see what their thoughts are on a
community garden and whether they would be willing to provide water to the city property by the Long
Lake fire station:
McMillan stated the water is a big issue and needs to be researched.
Bremer stated in her view this should go before the Planning Commission.
McMillan noted that would not be until May 16`h
Franchot asked how many people have requested a community garden.
McMillan indicated a couple of groups have approached her. Elizabeth Lavang has been working on it
and Dan Sapher made the initial request to use property along Old Highway 12 for a community garden:
McMillan commented Staff could try to figure out how much interest is out there and that she is
attempting to figure out if it is doable from a legal point of view.
Bremer indicated she would defer to someone else on the Council on this issue if they would like to
research it further. Bremer noted this is not an official item on the agenda tonight and that she would like
to have more information gathered on it. Bremer commented that a community garden might be too
rushed this year since soil work also would need to be done but that perhaps they can do fall plantings.
She reiterated a code change related to community gardens should follow the Planning Commission
process.
McMillan asked what the deadline is for submitting items to the Planning Commission for their May
meeting.

10. SCHEDULING SOFTWARE
Police Chief Farniok stated one of the concerns the police deparhnent has had is scheduling of the police
officers 24/7,3 65 days of the year,and that in the past they have had issues with the paper copy.
Currently they need to use whiteout if someone requests time off or otherwise changes the schedule.
Over the course of the years the police deparhnent has never lost the paper copy,but what they aze
looking at doing is something that is Internet based or computer based. Farniok indicated they would
need to malce sure#hat it is maintained and readily accessible to the officers.

Background
In order to repair an ice dam issue with the existing roof the property owner would like to
reconstruct the roof over the older portion of their home with a slightly steeper pitch. The
resulting increase in height would be an additional 2' 11"from the existing roof. The existing

Side Yard Setback Variance
The applicants' property is nonconforming with respect to area and width. The existing home

HARDSHIP DOCUMENTATION FORM
This form is a required submittal for A!L variance applicatlons. An appiication will not be considered

Minnesota State Statutes Section 462.357, Subdivision 6(2) requires that a hardship be demonstrated in order for
a variance to be granted. The hardship must be unique to the property as variances run with the land and not the
land owner. Persona!and economic situations are not considered valid hardsf�ips. In order for an application to

Hardship Statement

practical difficulry or unusual property conditions preventing compliance with Zoning Ordinance requirements in
the following lines (attach additional sheets if necessary):
The original 65`x26'fifty year old rambler portion ofi our house has a poorly insulated
roof and no attic cavity to ventilate which causes annual ice dams and water infiltration
in many areas. The old roof has a poor design with 2x8 rafters oniy, sheetrock on the .
under side, 6 inches of insulation in the cavity, 1 x8 boards and shingles on top, and a
flat 3:12 slope. The entire house was re-roofed in 2009 using heavy Ice & Water Shield
underlayment on the entire old house area, but the problems continue.
The solution is to raise the roof 2' 11" on the old portion of the house only, through the
�. use of scissors trusses, to create space to add insulation and provide a cavity for
ventilation (to create a cold roof) and to ha�e a steeper roof pitch.
A variance is needed since part of the 1960 structure is in the current 30' setback on
both sides. The 1960 structure was built in accordance with zoning and setback
regulations in effect in 1960. The proposed work will not be any closer to lot lines then
the original (existing) roof and will not be outside the existing footprint.
The tallest part of the house will now be 8" higher than the highest ridge prior to the
subject change. The total height of our home will be under 17' , which is well below the
30' limit and much shorter than 3 of our 4 nearest neighbors.

(aJ It is unlawful for any person to perform or have performed the following land alteration
activities without a conditional use permit issued by the council:
(1) Remove,fill, use for fill, dredge,store or excavate rock,sand, gravel, dirt or
similar earth material within the limits of the city.
(2) Fill or rec�laim any land by depositing such material or by grading of existing land
to elevate or alter the existing natural grade.
(3) Build, alter or repair any seawall or retaining wall, or otherwise change the
grade or shore of lakeshore property.
(bJ AI!land alterations involving filling and grading shall be performed only with clean fill as
defined in section 78-1. Granting of such permits is subject to other regulations and prohibitions
of this Code and other applicable statutes or ordinances of other governmental bodies.

� An application for a conditional use permit shall be accompanied by a drawing made by a
registered surveyor or other competent person showing the location of the proposed excavation
orstorage and shall state the amount of material which is to be removed, excavated orstored,
filled or graded, and such other information as the council may require.Applications shall be
filed with the city administrator and shall be accompanied by a deposit to be determined by the
city, which will be used to offset the cost of processing the application.Any unused portion will
be refunded to the applicant.
Background
The Orono Schools intend to improve an area of the southernmost property on campus for a
new softball field. As a result of the City's Old Crystal Bay Road project there will be soil
material exported out of the roadway area. The school would like to utilize the excess material
to improve the grade to prepare for the new softball field. Due to the amount of material
proposed,a conditional use permit is required.
Issues for Consideration
Are there any other issues or concerns with this application?
Staff Recommendation
Planning Staff recommends approval of the CUP. All of the City Engineer's requirements
including erosion control measures will be addressed with the administrative land alteration
permit following CUP approval. The school should notify the MCWD of their project.

Orono Public Schools is submitting a Land Alteration Request for a section of property
located to the north of the Junior Varsity Baseball Field which is located off of Wayzata
Blvd(see attached map of location).
The existing conditions consist of an old gravel parking lot and a gradual grass slope to
the edge of the school district gravel driveway.
We propose to scrape the black dirt,bring in roughly 6,000-8,000 cubic yards of fill to
. create a flat area and re-grade existing black dirt for a future softball field.
Upon grading completion grass will be re-established until the construction of the ball
field is completed.
