O. Box 66 Crystal Bay, MN 55323-0066 Re: Guillaume Bastiaens/Building Permit Application Our File No. 7098.1 Dear Mr. Gaffron: This letter is a recap of our meeting this morning at your office. I wish to thank you and the other members of the City staff for taking the time to meet with Mr. Bastiaens, representatives of Lundgren Bros. Construction, and myself this morning. As discussed at the beginning of the meeting,there were six open issues preventing the issuance of a Building Permit for the Bastiaens' new residence at 665 North Ferndale Road. They were as follows: 1. Height of the proposed new home; 2. Drainage issues, including drainage over the 625 North Ferndale Road property; 3. Interim septic for the existing home at 665 North Ferndale Road; 4. Long-term solution for the existing house at 665 North Ferndale Road, including application for a Condirional use Permit; 5. Future of the existing driveway off Ferndale Road serving 665 North Ferndale Road; and, 6. Location of proposed accessory structure. Mr. Michael P. Gaffron Planning Director CITY OF ORONO Page 2 January 16, 2003 As the result of discussions during the meeting, these issues have been resolved as follows: 1. Building Hei�t. Lundgren Bros. Construction has proposed to reduce the floor trusses from 24-inch floor trusses to 18-inch floor trusses. The City has agreed that since the site slopes, the mid-point of the gable on the north side of the house will be used for measuring purposes. The architect from Lundgren Bros. Construction has represented to the Citv that the new t,ronosed meas�.irement is sli ahtl_v morP thar 2R feet,�F�el? �vithin the 30-foot maximum as set by City Code. The City has agreed to that modification. 2. Draina�e. Otten Bros.' is currently working on a landscaping plan. As was represented to the City, it is our client's intention to grant a drainage and scenic easement over a portion of 625 North Ferndale Road in favor of 665 North Ferndale Road. The easement would roughly extend from the area of the existing wetlands to the site of the new home. Final descriptions for that drainage and scenic easement will not be available until late in the construction process. Accordingly, we have agreed that a signed, recordable drainage and scenic easement would be provided to the City prior to the issuance of any Certificate of Occupancy for the new home. 3. Interim Septic. It was agreed that Lundgren Bros. Construction would have a ditch dug roughly ten feet to the east of the new home, early in the construction process, in order to confirm that the existing septic system serving 665 North Ferndale Road does not extend closer than 10 feet to the new home. A variety of options were discussed to deal with the septic issue, if it proves that the existing system does extend close to the new home. They would include installing a temporary holding tank, hooking up to the new drain fields, or other options. The City septic inspector will work with Lundgren Bros. Construction to determine a final decision on that once the investigation ditch is dug. 4. Lon�-Term Solution far Existing House. The City is in receipt of an executed Agreement signed by Mr. Bastiaens using the form previously provided to us by your office regarding the continuing existence of the current home at 665 North Ferndale Road during the construction of the new house. An application for a Conditional Use Permit will be made by the Bastiaens, but the Building Permit will not be held up pending receipt or action on the Conditional Use Permit application. 5. Existing DrivewaX. The existing driveway for 665 North Ferndale Road will be addressed as part of the Conditional Use Permit application. In the interim, until action is taken on the Conditional Use Permit, the existing driveway will remain in its location and be used in addition to the proposed new driveway for the new home. It was determined at the meeting that the portion of the proposed new accessary building which extends north of the proposed new home is so diminimus that it is not in violation of City Code. Accordingly, any objection on this basis has been waived. It is my understanding from the meeting that the visit to the building site yesterday,January 15, 2003,bvthe CityF�uild�ng In�nect�r,alonvwith Al l,and.�ren�n�?'��rs.pastiae::s;��a�ext;e;ne�y helpful to the City Building Inspector. The City Building Inspectar has accordingly authorized Lundgren Bros. Construction to commence the clearing of the site,including tree removal,prior to the issuance of the Building Permit. It is also our understanding that the Building Permit would be issued no later than Friday,January 17,2003,and that no additional plans,applications, surveying, etc., are necessary prior to the issuance of the Building Permit. I thank you for the successful resolution of this ongoing issue. As you are aware,the Bastiaens are under some time pressure to get the home constructed prior to a family marriage on June 14, 2003. Unfortunately, any further delays in the issuance of the Building Permit would have resulted in Lundgren Bros. Construction not being able to complete the home by that date. I will prepare the application for the Conditional Use Permit and forward it to Mr. Bastiaens for execution.
