The Weisbergs (2990) and the Kellys (2980) have made an application to the City a Class I subdivision (lot line rearrangement) in order to move the current lot line 53 feet to the south as shown in Exhibit C. Because this is a lot line rearrangement which results in no additional Iots, no park fee or stormwater trunk fee will be required. After the lot line rearrangement, the finro lots will remain conforming. The proposal to move the common (side) lot line closer to the home at 2990 Sussex results in a side setback of 34 feet which remains conforming. Issues for Consideration 1. The City Engineer has recommended the existing common lot line utility and drainage easements be abandoned and new easements be established at the proposed common lot line. 2. Are there any issues or concerns with this application? Staff Recommendation Staff recommends approval of the lot line rearrangement provided the lot line drainage and utility easements are handled as the City engineer specifies. In the fall of 2010 the lake side slope of the applicant's property experienced a catastrophic failure. Several hundred cubic yards of earth and all of the vegetation slid off of the slope and landed in the lake below. Technically, in order to conduct earth moving activities to repair the slope a CUP is required. In an effort to expedite the restoration of the slope City staff, the City engineer and representatives from the MCWD have been working with the applicant and the applicant's engineer and contractor to design a restoration plan . that meets engineering standards for this type of location, soil, slope, etc. The applicant has provided a plan which has been deemed acceptable to the City and has been allowed to proceed with the restoration. The plans are dated 11-4-10. We have the following comments with regards to engineering matters: • Please see the attached memo from Phillip Caswell dated 11-8-10 regarding the structural stability of the project. • It is our understanding that on site soil or"black dirt" will be used on top of the structural rock boulders on the hillside as topsoil. This will be protected with Verdyol Biotic Earth BFM, FRM, HGM hydromulch and seed. The slope would then be planted with 100 #2 sumac, 40 #2 grow low sumac, 130 #1 day lily, 50 #2 bush honeysuckle. • The applicant should provide a letter from Verdyol stating that they understand the site conditions and that their product will function acceptably as proposed. • The seed mix used in the hydro seeding should be submitted. • A general planting plan should be submitted. This plan should show a general planting pattern over an area. It should provide enough detail to determine or state the density of the plants as proposed. • This project will disturb more than 100 CY of material. Sediment and erosion control information meeting the requirements of Orono's City Code 79-7(c)(2) has been previously submitted. The minimum $2000 sediment and erosion control financial security should be required of the owner for this permit. • Minnehaha Creek Watershed may be reviewing this design as well. The city should verify that this project has received their approval. Draft Ordinance Summary Currently, a zoning code variance is valid for one year from date of Council approval. The variance must be acted on — in most cases by obtaining a building permit — within 12 months of approval or it will expire. If an applicant is not able to use the variance within the 12 months the City has historically processed a new application as a variance renewal. These variance renewals have typically been approved on the consent agenda. A variance renewal request with considerable changes to the proposed plan would be processed as a new variance altogether. The 2010 Krummenacher Supreme Court ruling has resulted in the City reviewing a number of our codes and processes. Technically a variance renewal is a new variance approval and it may not pass the Krummenacher "test". Therefore, in order to allow a property owner to use a previously granted variance City staff is proposing an amendment to the zoning ordinance which would allow for an extension of a variance approval. The proposed amendment would allow City Staff to grant a 12-month extension of an existing variance as long as the request to do so is made at least 60-days before its expiration. Further the Council may grant an additional 12-month extension provided the request is made 60 days prior to the expiration.
