(b) A lot of record existing upon January 1, 1975, in an R district, which does
not meet the requirements of this chapter as to area or width may be utilized for a single-
family detached dwelling purpose, provided that in the judgment of the council or
administrative approval by the planning director, such use does not adversely affect
public health or safety and the following requirements are met:
. (1) In R districts of one acre or less and with public sanitary sewer. A lot of
= record existing upon January 1, 1975, in any R district of the city of up to and �
including one acre, which lot is serviced by public sanitary sewer and which does
� not meet the requirements of this chapter as to area or width only, may be
utilized for single-family detached dwelling purposes without council approval if �
the area measurements and width of that lot are within 80 percent of the
requirements of this chapter. However, the lot of record shall not be more
intensely developed unless combined with one or more abutting lots or portions
so asto create a lot meeting the requirements of this chapter.
Sec. 78-350. Area, height, lot width and yard requirements.
(a) Height. No structure or building in the LR-1C district shall exceed 2 1/2
stories and shall not exceed 30 feet in height except as provided in section 78-1366.

Background �
The subject property is substandard in area and in width for a lot within the LR-1 C
zoning district. Further, the property does not meet the 80% minimum requirement for
an administrative lot area and lot width approval as provided by City Code Section 78-
72(b)(1). The property has lakeshore on two sides of the property with approximately
8,800 square feet of area within the buildable zone. The applicant would like to
construct a new residence on the property. '

Lot Area & Lot Width Variances
The applicant has proposed a home which meets all of the required setbacks and
hardcover requirements. Without variances for lot area and lot width, a home of any size
could not be constructed on the property.
Hardship Statement
Applicant has completed the Hardship Documentation Form attached as Exhibit B, and
should be asked for additional testimony regarding the application.
Hardship Analysis
In considering applications for variance, the Planning Commission shall consider
- . , the effect of the proposed variance upon the health, safety and welfare of the
community, existing and anficipated tra�c conditions, light and air, danger of fire,
risk to the public safety, and the effect on values of property in fhe surrounding
area. The Planning Commission shall consider recommending approval , for
variances from the liferal provisions of the Zoning Code in instances where•fheir
strict enforcement would cause undue hardship because of circumstances unique
to the individual property under consideration, and shall recommend approval
only when it is demonstrated that such actions will be in keeping with the spirit
and intent of the Orono Zoning Code.
Staff finds that the applicant cannot put the property to a reasonable use without
variances for lot area and lot width. � The applicant's request is supported by a clear
hardship. Further, the applicant has demonstrated that enforcing the lot area and lot
width provisions of the Zoning Ordinance deprive the applicant of the reasonable use of
their property. ,

We have reviewed the pians for the proposed new home construction at 1985 Fagerness Point
Road. The site plan is deted 7-19-10. We have the foliowing comments with regards to
engineering matters: �
• It appears that the proposed retaining wall adjacent to the driveway is approximately 6
feet high. Engineered design and detaiis should be submitted for review and approval
for all retaining walls over four in height, and for all tiered walls with a separation of less
than two times the wall height. '
• This project will disturb more than 100 CY of material. Sediment and erosion control
information meeting the requirements of Orono's City Code 79-7(c)(2) must be
submitted. The minimum $2000 sediment and erosion control financial security should
be required of the owner for this permit.

I have no objections to the variances being requested. I do however have several
concerns about the management of the construction project itself and the extra parking �
which will take place. •
. During the last project on this stretch of road, (1983 Fagerness Point Road)which ran .
from approximately July 2009 until late this spring there were numerous issues with
getting up and down the road and with the amount of mud and dirt that was present on the
road. I will say that while Michael Ga11us Construction was actively on the site there
, were few problems. However once the major house construction was complete a
landscape group took over.' From that point on there were many times when we could not
drive out the road because they blocked us in with trucks and trailers. On top of that the
road was a muddy mess for several months. I cannot even guess how much mud and dirt
washed into the lake. There were a couple of times when I saw the Watershed District
out to make them put back up the mud fences.
I have two request for this project.
The road is very narrow in front of this project. It is several feet less in width than fiu-ther
up the road. On the south end of this property the road turns into a private drive which
can be difficult to get in and out of if vehicles are parked on the road. I would request
that there be no parking on_the road in front of this properly. In addition I would like to
understand why trailer parking is allowed on the this road at a11. A number of years ago
the city banned trailer parking on Fagerness from County Rd 19 to Webb. The road along
the stretch from 19 to the end of the pazk is probably at least 25%wider than the road at
this end of the point. If the road isn't wide enough to handle trailers at the beginni.ng of
Fagerness Point it sure isn't wide enough when you get down to this end.
My second request is that the road be kept clean of mud and dirt. If that means having a
� street sweeper there on daily basis then that is what should be done.

Application Sunzmary: This zoning code text amendment would address inurnment or
burial of cremated remains at places of worship in residential zoning districts by:
• Allowing indoor columbaria as an accessory use to a place of worship.
� Allowing outdoor columbaria, ground niches, and direct earth burial with or
without an urn that is accessory to a place of worship with a conditional use
permit.
Inurnment is the placement of an urn of cremated remains in a final resting place.
Staff Recommendation: Planning Department Staff recommends the Planning
Commission make a recommendation to the City Council for approval.

Background
Since 2004 St. Edward's Church and Trinity Lutheran Church have expressed a desire to add
outdoor columbaria. Columbaria are above ground structures for the inurnment of cremated
remains. Good Shepherd Lutheran Church is proposing to provide direct earth burial for urns or
ashes. There is no provision in the zoning code for inurnment or burial of ashes.
In Minnesota the cremation of human remains is a form of final disposition of huxnan remains,
the equivalent of burying a body in a cemetery. There are few regulations governing the
disposition or treatment of cremated remains. A place solely for inurnment or burial of ashes is
not considered a cemetery. If a place for inurnment,burial of ashes or scattering of ashes is
abandoned the County is not required to assume its upkeep as a cemetery.
Exhibit A is an excerpt from State Statutes governing the disposition of cremated remains.

Discussion
. This amendment does not allow cemeteries. The intent is not to exclude cemeteries. There are
different issues with cemeteries since they are a very permanent and protected land use. They
could be considered separately at some future date.
While not as common as it once was, it is not unusual for a place of worship to include a
cemetery,primarily for the burial of inembers. With the coming need to provide final resting �
places the"baby boom" generation, communities will be asked to consider proposals such as
those being made by these churches.
Places of inurnment within the church building have no land use impact separate from the
building. For this reason Staff is recommending they be allowed as an accessory use.
Places for inurnment or burial of ashes not within the church building have a land use impact
because they involve structures, including buildings that are only for inurnment. For this reason
Staff is recommending they be an allowed accessory use but require a separate conditional use
permit unless an outdoor place of inurnment is part of the initial conditional use permit for a
place of worship. � .
Because what is being proposed is not a cemetery, the possibility exists that in the future the
property ceases to be a place of worship. Staff recommends that the religious organization be
required to make provision for disposition of the cremated remains (regardless of where they are
located) in the event that occurs.
Cremated remains in urns within niches are easily physically relocated. When urns and remains
are placed directly in the earth physical relocation becomes more difficult. The Planning
Commission should discuss the acceptability of this arrangement and if it would be more
acceptable if the urns and ashes were placed as Good Shepherd Church proposes, at a shallow
depth and within a closely defined area, rather than being placed separately as in a cemetery.
There are also niches that can be placed horizontally, but they do not allow the earth burial of
ashes.
Scattering of ashes on land so there is no defined burial or inurnment location can occur on any
property with the consent of the owner. Since it has no land use impact Staff does not propose to
regulate it.
Action Requested �
1. The public hearing should be opened and comments received.
` 2. After Planning Commission discussion of the proposal, a motion should be made either
makes a recommendation to the City Council or tables the item.
Staff Recommendation
The Planning Commission make a recommendation to approve the zoning text amendment with
any changes the Commission determines appropriate.

Subdivision 1. Generally. Every dead human body lying within the state, except unclaimed '
bodies delivered for dissection by�the medical exaxniner, those delivered for anatomical study
pursuant to section 149A.81, subdivision 2, or lawfully carried through the state for the purpose �
of disposition elsewhere; and the remains of any dead human body after dissection or anatomical
study, shall be decently buried, entombed; or cremated, within a reasonable time after death.
Where final disposition of a body will not be accomplished within 72 hours following�death or
release of the body by a competent authority with jurisdiction over the body, the body must be
properly embalmed or refrigerated: A body may not be kept in refrigeration for a period exceeding
six calendar days from the time of death or release of the body from the coroner or medical
examiner. �
Subd. 2.[Repealed, 2007 c 114 s 75]
Subd. 3. Permit required. No dead human body shall be buried, entombed, or cremated
without a disposition permit. The disposition permit must be filed with the person in charge of the
place of final disposition. Where a dead human body will be transported out of this state for final
� disposition, the body must be accompanied by a certificate of removal.
� Subd. 4. Cremation. Inurnment of;cremated remains and release to an appropriate party is
considered final disposition and no further permits or authorizations are required for
transportation, interment, entombment, or placement of the cremated remains, except as provided
in section 149A.95, subdivision 16. • .

� Subd. 15. ;:Cremation;procedures; container of insufficient capacity. If a cremated remains
container is of insufficient capacity to accommodate all cremated"remains of a given dead human
body, subject to directives provided in the written authorization to cremate, the crematory shall
place the excess cremated remains in a secondary cremated remains container and attach the
second container, in a manner so as not to be easily detached through incidental contact, to the
primary cremated remains container. The secondary container shall contain a duplicate of the
identification disk, tab, or permanent label that was placed in the primary container and all '
paperwork regarding the given body shall include a notation that the cremated remains were
placed in two containers. a
� Subd. 16. Disposition procedures; commingling of cremated remains prohibited. No
cremated remains shall be disposed of or scattered in a manner or in a location where the
cremated remains are commingled with those of another person without the express written '
permission of the person with the legal right to control disposition or as otherwise provided by
law. This subdivision does not apply to the burial of cremated remains at sea from individual
containers, to the scattering or burial of cremated remairis in a dedicated cemetery, to the disposal
in a dedicated cemetery of accumulated residue removed from a,cremat�ion; chamber or other
.;crernation;; equipment, to the inurnment of inembers of the same family in a common container
designed for the cremated remains of more than one body, or to the inurnment in a container or
interment in a space that has been previously designated, at the time of sale or purchase, as being
intended for the inurnment or interment of the cremated remains of more than one person.
Subd. 17. Cremation;procedures; disposition of accumulated residue. Every crematory
shall provide for the removal and disposition in a dedicated cemetery of any accumulated residue
from any cremation� chamber, mechanical processor, container, or other equipment used in .
�cremation�;. Disposition of accumulated residue shall be in accord with the regulations of the _
dedicated cemetery and any applicable local ordinances. �
Subd. 18. Cremation:procedures; release of cremated remains. Following completion of
the �cremation-,, the inurned cremated remains shall be released according to the instructions given
. on the written authorization to cremate. If the cremated remains are to be shipped, they must be
securely packaged and transported by a method which has an internal tracing system available and
which provides for a receipt signed by the person accepting delivery. Where there is a dispute
over release or disposition of the cremated remains, a crematory may deposit the cremated
remains with a court of competent jurisdiction pending resolution of the dispute or retain the "
cremated remains until the person with the legal right to control disposition presents satisfactory
indication that the dispute is resolved.
Subd. 19. Unclaimed cremated remains. If, after 30 calendar days following the inurnment,
the cremated remains�are not claimed or disposed of according to the written authorization to
cremate, the crematory or funeral establishment shall give written notice, by certified mail, to the
person with the legal right to control the final disposition or a legal designee, that the cremated
remains are unclaimed and requesting further release directions. Should the cremated remains be
unclaimed 120 calendar days following the mailing of the written notification, the crematory or
funeral establishment may dispose of the cremated remains in any lawful manner deemed
appropriate. �

Summary
The City of Orono has not formally adopted a historic registry or regulations to protect
' and preserve structures considered by some to be historically significant to the City or to
the Lake Minnetonka area. One method of preserving historical buildings is to move
them from a site to be developed or to be changed on to a new site where the building
can be preserved. The City's accessory structure regulations may make it difficult to
allow for preservation of . buildings, particularly large buildings, without special
consideration or variances.
This issue was recently brought to the attention of City staff following the June 24'h State
Supreme Court ruling on variances. A property owner approached the Cify for
permission to move an existing, historic barn, constructed in approximately 1910, from
one property to another property in order to preserve it along with the original home, also
constructed in approximately 1910. The barn exceeds the maximum size limitation for
the property where it is intended to be located. Without a variance the barn would have .
to be reduced to the allowed square footage or it would not be permitted. �

Staff is suggesting a minor change be made to the maximum accessory size limitation in
order to facilitate the potential preservation of some local historical structures. The
current code limits the maximum size of an accessory structure based on the property
area. The suggested amendment would exempt structures with local, historical
significance from the maximum individual accessory structure size. The square footage
of the structure would still apply to the total square footage of accessory structures
� � allowed for the property; however it could exceed the maximum size limit. A definition
for"historic building" or"historically significant" is recommended.
Some suggested language for development of the definition:
• The building has historical significance and the building is an important part of '
the City's heritage worthy of protection from inappropriate changes or
destruction. � '
• Any building that is of historical significance or that is a historical resource within
the City of Orono or the Lake Minnetonka area. �
• Any individual property, place, building, structure, work of art or other object that
has been determined to be historically, culturally or architecturally significant and
has been locally designated as a heritage preservation landmark.
• Any building or collection,of structures deemed of importance to the history,
architecture or culture of the City of Orono or Lake Minnetonka by the City
Council. This shall include historical buildings or properties on, or determined '
eligible for, national, state or local historical registers or inventories, such as the
National Register of Historic Places, Minnesota Historical Society, and city or `
county registers, inventories or surveys of historical or architecturally significant
sites, places or landmarks. . • •
• Mirriam-Webster defines historical as follows:
a : famous or important in history <historic battlefields>
b : having great and lasting importance <a historic occasion> '
c : known or established in the past <historic interest rates>
d : dating from or preserved from a past time or culture <historic buildings>
The Planning Commission should discuss and develop language for a definition of
historic building and/or historical significance using the above staff suggestions or any
other language determined to be appropriate.
Issues for Consideration
1. Who should decide on the historical significance of a building? The City Council?

2. If a historic building is moved to a site, and the exception�made for size, should
� there be any additional provisions for protection of the�historic building? For
example, the 2,000 square foot historic building should not, in the future, become

Staff Recommendation
Planning Commission should recommend a code amendment to allow a size exception
for buildings determined to be "historic". Planning Commission should also draft a
