You asked me to comment on the survey dated June 25, 2014 showing a proposed house. I have the following
comments:
• A wetland delineation was completed in 2003/2004 when the subdivision was created. A wetland delineation is
valid for 5 years, an updated delineation would be required. The updated delineated edge shouid be shown on
the survey including the required 35' setback from the delineated edge.
• The survey dated June 25, 2014, does not show correctly the delineated wetland edge approved with the
subdivision. At a minimum the delineated wetland edge approved with the subdivision should be added in
addition to the recorded wetland buffer of 35'. (reference Document No. 4071992, copy attached)
• The survey should be updated to show the following:
o the conservation easement per pocument No.4085098 (copy attached)
o the storm pond
• Also:
o the "Edge of Water" notation should be removed from the survey.
o provide clarification regarding the significance of the 939.2' elevation. What is this in reference
to? Please clarify or remove.
o the driveway location should be set back a minimum of 5' from the property line.
Please note all structures and hardcover must be set back a minimum of 35' from the actual updated delineated wetland
edge or the recorded buffer, plus 10', whichever is greater. Reference City Code Section 78-1605
For the building permit the house footprint and all improvements including grading should be shown by the surveyor.

` STORMWATER FACILITY MAINTENANCE
i These terms apply to the stormwater facilities constructed pursuant to Minnehaha Creek
, Watershed District permit application number 04-232. �
WHEREAS,application has been made for a permit from the MCWD pursuant to
' MCWD Rule N,Stormwater Management;and
' WHEREAS,the property that is the subject of the permit is legally described in the
i Declaration 'snto which this Attachment is incorporated,and the facitities on the property to ;
, which these maintenance requirements apply are as follows:
� Storm Water Pond aad Infiltration Basin
� WHEREAS,MCWD Rule N provides that a maintenance agreement shall be submitted
for stormwater treatment ponds,outlet struciures for such ponds,culveris,outfall structures and
� all other stormwater facilities,and that the maintenance agreement shall specify methods,
' schedule and responsible parties for maintenance and must include at a minimum,the elements
� contained in the District's Maintenance Agreement Form.
� NOW,THEREFORE:
� ]. The property owner sha11 inspect the stormwater retention and treatment basin(s)
; at a minimum of once a yeaz to determine if the basin's retention and treatment characteristics
� , aze adequate. A storage treatment basin will be considered inadequate if sediment has decreased
� the wet storage voiume by %2 of its origina]design volume. Based on this inspection,if the
� stormwater basin(s) is identified for sediment cleanout,the property owner shall restore the
� basin(s}to its original design contours within one year of the inspection date. -

! 2. The property owner shall inspect the grit chambers,sump catch basins,sump
� manholes,outlet structures,culverts,outfall structures or other stormwater facilities for the
• project in the spring and fall of each yeaz. The property owner shall remove all sediment and
, debris during the inspections such that the stormwater facilities operate as designed and
percnitted.
i 3. Rain gardens must be kept clean of excess sedimeni and debris.Healthy plant
; growth must be maintained in the rain gardens by removing dead vegetation in the spring of each
� year.
' 4. Violation of the inspection and/or maintenance provisions of this Agreement is a
' violation ofthe MCWD permit for the project far which the MCWD may take action against the
� property owner.
i 5. "Property owner"as used in this Attachment means the owner of the property on
� which is located the stormwater faeility to which the obligations herein apply.

AND WAIVER OF DAMAGES

Creekside in Orono, LLC,a Minnesota limited liability company and its successors and assigns �
(hereinafier collectively referred to as the"Grantor")and the City of Orono, its successors and �
assigns,a municipal corporatian under the laws of the State of Minnesota(hereinafter referred to �
as the"Grantee".)
WITI�BSSETH, Grantor, for and in consideration of the sum of One Dollar($1.00)and other
valuable consideration,hereby covenant,grant, gift,quit claim and convey to Grantee the right to
restrict and Grantor agrees to limit and preclude the use,improvement and development,under
the conditions and covcnants herein contained,the fallowing described Land in the County of •
Hennepin and State of Minnesota:

1. Grantor(s)hereby covenant(s)and agree(s}:
A. No structures shall be constructed,erected,or placed upon,above,or beneath the I
Land including without limitation, Fences, fireplaces, steps,docks,piers,
hardcover or roads of any nature whatsoever,or any other structure or
� improvement inconsistent with the natural state of the Land. �
B. No domestic animals,including but not limited to horses,sheep,chickens,etc,shall
be allowed on the Land.
C. No trees,shrubs or other vegetation shall be destroyed,cut or removed from the
Land except as authorized by written consent of Grantee.
D. No earth,loam,peat,gravel,soil or any other natural material or substance shal!
be moved or removed from the Land and there shall be no dredging or excavation
of any nature whatsoever or any change of the topography of the Land without the
written consent of Grantee.
E. No soil,sand,gravel or other subsiance or material as landfill shaU be placed,
dumped or stored upon the Land and no waste,trash or garbage shall be placed,
dumped or stored upon the Land.
F. No use shall be made of the Land except uses, i f any,which will not change or
alter the natural condition of the Land,and no use which would tend to change the
drainage, flood control,water conservation,erosion control,soil conservation,
fish and wildlife habitat characteristics shall be made ofthe Land or the water �
situated thereon.

G. Grantee may enter upon the Land for the purposes of inspection and enforcement
of the covenants contained herein and to cause to be removed &om the Lanci,
without any liabifity,any structures,uses,materials,substances,or unnatural
matter inconsistent with the covenants contained herein and the natural state of
the Land.
H. Creation and maintenance of non-hardcover walking paths is allowed on the Land.A
private trail with no more than one(l)connecting point to the Luce Line Trail may be
constructed pursuant to this section,with prior written approval of the Minnesota
Department of Natural Resources.
1. Pennanent markers of a design and material acceptable to the Planning Director of ,
thc City of Orono shall be placed at atl points where this easement intersects a lot
boundary or where this easement boundary line changes direction,as noted on �
Exhibit A.
2. Grantor hereby grants,gifts,quit claims and conveys to Grantee,a perpetual flowage
easement and right and privite�e to trespass with water over and upon any or all of the
Land.
' 3. 'The existing wood creek crossing bridge is to remain on the Land. The Grantor,or its
assigns shall have�he ribht and obligation to make such use of said Land as is reasonably
necessary and advisable to the maintenance,rcpair or replacement of said bridge.
4. Grantor herein does hereby remiss,release,acquit and forever discharge,forever, the
Grantee and any and all of its officers and employees of and from any and all claims,
demand or eauses of action of any kind or nature whatsoever which may arise or accrue
by virtue of any(i)flowage or trespass with water within terms of these agreements or
(ii)the maintenance,repair or replacement of said bridge referenced in Section 3 hereof and
any path,if any,created by virtue of Section 1(H)above,which was specifically perfocmed
by Grantor or its assigns.
In addition to any other remedy the Grantee may have,the covenants and restrictions
coniained herein may be enforced by injunction.
Grantor does not intend that the public should have any interest in the above Land by
virtue of this indenture or otherwise,except as hereinabove set forth.
Thc Grantors herein ceriifies that the Land herein described are free and ctear of all
encumbrances except:

THIS AGREEMENT,made and entered into this���day of February,2005,by
and between the Ciry of 4rono,a municipal corporation organized under the laws of the State of
Minnesota(hereinafter called"City"), and Creekside In Orono,LLC, a Minnesota limifed
liability company, its heirs,organized under the laws of the successors and assigns, (hereinafter
called"Devedoper").
WITNESSETH:
WHEREAS,the Developer has made application to the Ci�Ey Council for approval of the
final plat of Creekside in Orono.
AND,WHEREAS,the City Council has granted approval for such development on the
condition that the Developer enter into this agreement to provide for the installation of
improvements hereinaf�er described on the#erms and conditions hereinafter set forth.
NOW,THEREFORE,in consideration of the premises and of the mutual promises and
conditions hereinafter contained, it is hereby agreed as follows:
I. Property Descri�tion: Lots 1-7,Block 1, Outlot A, Outlot B, Creekside in Orono,according
to the recorded plat thereof.
2. Improvements: In accordance with the policies and ordinances of the City, the following
described public or private improvements(hereinafter collectively called the -
"Improvements")shall be constructed and insta.11ed on the terms and conditions hereinafter
contained:

3. Construction Plans: The following described detailed plans and specifications for the
complete installation of the Improvements shall be submitted by the Developer for the
approvaf of the City prior to the start of construction. The Plans and specifications shall
conform to all current City standards for alI applicable work. The detailed plans and
specifications for complete installation are as follows:

All furtiier revisions to the above plans shall require approval of the City Engineer.
4. Construction of Improvements:
a. Commencement Date-The construction of Tmprovements shall begin no later than
June 1, 2005. No land alterations can take place untii erosion control is
established and the City is in receipt of a fmal grading and road plan. In addition,
no Improvements can begin until the City Engineer of Orono has approved all
Improvement plans.
b. Completion Date—All Improvements shall be completed no later than July 1,
2006.

c. Contractors -- The Developer shall select,retain and supervise the Contractor{s)
responsible for Improvement construction.The City reserves the right to require
satisfactory proof of successful experience and adequate financial status of any
such contractor. Where required by City ordinance,the contractor shall first
obtain a Iicense from the City.
d. PreConstruction Conference--Prior to the start of any construction,the
Developer and the Developer's Confractor shall meet with the responsible City
official to review construction plans and schedules.
e. Permits-Prior to the start of any construction,the Developer's Contractor shall
apply for and receive all necessary permits from the Ciiy and/or government
agencies having jurisdiction. No building permits will be issued until ali drainage
facilities and drainage impzovements have been instalied and a satisfactory road
base,including the first bituminous Iayer,has been installed.
£ Construction-The construction,installation and materials sha11 be in accardance
with the plans and spec�cations approved by the City.
g. Insurance -The Developer will cause each person,who constructs and installs any
Improvement to maintain complete insurance coverage including Worker's
Compensation,Liability and Property Damage.
5. Performance Deposit: For the purposes of assuring to the City that the Improvements will be
completed according to the terms of this agreement, and that the Developer will pay all
claims for work done and materials and supplies furnished,the Developer has deposited with
the City at the time of the execution of this agreement an irrevocabie letter of credit in a form
satisfactory to the City providing that the City is able to draw upon such letter of credit in its
sole discretion to complete the Improvements if the Developer fails to satisfactorily complete
the work prior to the complstion date specified in Section 4 above. The a.mount of such
deposit shail not be reduced before substantial completion of the Improvements.The letter of
credit shall expire no sooner than six months after the completion date specified in Section 4
above,or no sooner than August 31, 2006,whichever is later.
6. Fees and Expenses: The Developer agrees to pay all City fees required per the current City
Fee Schedule and furttter agrees to completeiy reunburse the City for alI the variable
additional expenses it incurs in regard to the review and approval of the Improvements
inciuding,but not limited to,direct City payroll and overhead, costs,and fees paid ta
consultants and other professionals.
7. Resolutions of Citv. Developer agrees to be bound by the provisions set forth in ali
resolutions of the City Council approving the Development.
8. Termination: This Agreement shall be terminated upon the completzon of alI Improvements
set forth in this Agreement.

9. Binding Effect: The terms and provisions hereof shail be binding upon aud inure to the
benefit of the heirs,representatives, successors and assigns of the parties hereto and shall be
binding deemed covenants n�nning with the land.References herein to Developer,if there be
more tban one,shall mean each and all of them. This agreement to be executed by the
Developer, shall be placed of record so as to give notice hereof to subsequent purchasers and
encumbrancers of all or any part of the subdivision at�d all recording fees,if any, shall be .
paid by the Developer.
10. Notices: Whenever in this agreement it shall be required or permitted that notice or demand
be given or served by either party to this agreement to or on the other party,such notice oz
demand shall be delivered personaily or mailed by United States certified mail (return receipt
requested}to the addresses set forth below. Such notice or demand shall be deemed tunely
given when delivered personally or when de}�osited in the mail in accordance with the above.

Improvements; Terms and Conditions.
The Improvements i�iclude site grading; construction and installation of a private road; construction and
installation of stormwater management facilities; constnzction and installation of sanitary sewer and
water facilities; and site restoration and Iaudscaping.
The Improvements sha11 be constructed in accordance with the approved construction pla.ns as stated in
this Ageement, and with the pertinent condi#ions of approval contained within the Final Plat Approval
Resolution No. 5279 adopted by the Orono City Council on January 24,2005.
Tree Preservation a.nd Landscapin�. The developer shatl adhere to the approved tree preservation and
landscaping plans.The developer shall walk the site with City staff prior to site grading to establish
which,if any,trees within the grading area can be saved or transplanted. The developer sha11 confer
with the property owner of 130 Brown Road South and with City staff to establish an altemate layout
for spacing of boulevard trees along that adjoinin�property to provide a natural look rather than a
regimented look.Developer shall follow the landscape plan general notes(upper left on Sheet 12 of
12), especially with regards to pruning and removal of dead wood and dainaged branches within the
Conservation Easement areas. �
Conservatian Easement Markin�. Perrnanent markers of a design and xnaterial accep#able to ihe
Planning Director shall be piaced by the developer at a11 points where the Conservation Easement
intersects a lot bowrndary ox where the Easement boundary line changes direction, as stipulated in the
Flowage and Conservation Easement.
Sanitary Sewer and Water Systems. All applicable City of Long Lake connection fecs and charges
associated witli the sewer and water system serving the developinent shall be paid to Long Lake by the
Developer. Developer shall be responsible for any charges to the City of Orono from the City of Long
Lake in relation to the provision of zx�unicipal sewer and water from Long Lake.
Upon coinpletion by the Deveioper and accepta.nce by the City of Orono,the sanitary sewer and water
facilities within Outlot B and within the 30'utility easement of Lot 7, shall becorrie the property of the
City of Orono and become a part of the City o£Orono utility sys#em,to be operated and mairitained by
the Czry of Qrono.

As part of the installation of sanitary sewer and water improvements per the approved plans,Developer
shall install two sewer and two water stubs for future service to the Dunn property and one sevver and
one water stub for future service to the McCuskey property.
Gradin� and Draina e Requirements. General site grading shall be in confornlance with the approved
Grading, Drainage and Erosion Control 1'lan. During development within individual lots,wherever
feasible, individual driveways and yard areas shall be graded to drain toward the road storm sewer
system. Wherever feasible,roof guiter systeins sha11 be installed to discharge roof runoff so that it will
drain towazd the road storm sevc�er system.
Si�na�e and Lig�g_ No street lighting or development identification signage has been approved for
G�eekside In O�ono. Any such pz-oposed lighting or signage shall be subject to prior City approval,
which may require public hearings.
Site Improvements;Building Perrnit Issuance. No land alterations shall take place until erosion con#rol
is established and the City Engineer has approved all�nal improvement plans. No buzlding permits will
be issued until all drainage facilities and improvements have been installed and satisfactory road base
(including road base and the initial lift of bituminous)has been installecl and approved by the City.
Site bnnrovement Cost Estimate. The Site Improvement Cost Estimate on page 3 of this E�ct�iibit shall
be flie basis for the amomit of the Letter of Credit required by this agreement.

WHEREAS,the City of Orono is a municipal corporation organized and existing under
the laws of the State of Minnesota; and
WHEREAS,the City Council of the City of Orono(hereinafter"City Council")has
adopted subdivision and la��d development regulations for the orderly,economic and safe development of
land within the City; and
WHEREAS,the City Council has considered the application by Creekside in Orono LLC
(hereinafter the"Developer")for subdivision ofproperty located at 120 Brown Road South and legally
described as follows:
Tract H,Registered Land Survey No.352,Hennepin County,Minnesota
(hereinafter"the property"); and
WHEREAS,on July 12,2004 the City Council adopted Resolution No.5204 granting
Preliiriinary Plat Approval for the proposed development of a seven-lot Planned Residential Development
(PRD)plat for single family residential purposes; and
WHEREAS, the Developer has completed or has agreed to complete all other
requirements of the platting regulations of the City including:
1. Completion of all platting requirements of Preliminary Plat Resolution No. 5204.
2. Submittal of a`record preliminary plat drawing'incorporating all elements described in
Conditions 1 and 2 of Resolution No. 5204.
3. Dedication on the plat of perimeter Drainage and Utility Easements and Drainage
Easements as required in Resolution No. 5204.

11. Provision to the City of a title commitment as well as a title policy in the amount of
$100,000 in favor of the Cityto ensure coverage of all City interests associated with filing

easements currently affecting the Property.
12. Payment to the City of Stormwater and Drainage Trunk Fee in the amount of$54,000.00
as established in Resolution No. 5204.
13. Payinent to the City of Park Dedication Fee in the amount of$33,300.00 as established
in Resolution No. 5204.
14. Payment to the City of final plat review fees and legal review and filing fees in the amount
of$530.00 as established within Resolution No. 5204.

NOW,THEREFORE,BE IT RESOLVED that based on the findings ofResolution No.
5204,the City Council ofthe City of Orono does hereby approve the Planned Residential Development
plat of CREEKSIDE IN ORONO,Hennepin County,Minnesota subject to the following declarations and
conditions:
1. Shoreland Status.In addition to the various development limitations established herein,Lots
1 through 7 are within or partially within the designated Shoreland Overlay District and
subject to the City of Orono Shoreland regulations pertinent to tributaries.
2. Lot Development Standards.Lot development standards applicable to Lots 1 through 7
are generally as shown on the approved Grading,Drainage and Erosion Control Plan,
Sheet 4 of 6,by Schoell and Madson,Inc.,revision dated O l-19-OS and attached hereto
as EXHIBIT A(which Plan shall be designated for reference purposes as the`Record
Preliminary Plat Drawing') and more specifically as follows:
All Lots: Required Front Yard: 35'
Required Side Yard: 30'
Required Side Street Yard: 35'
Setback from Creek: 75'
Setback from Delineated Wetlands: 35'
The bank of the creek for setback purposes is established at the 936.5'
elevation contour line.
"Required Yard" designations shall be as depicted on the `record
preliminary plat drawing'with the standard`front yard abutting the private
road, `side yards' abutting adjacent lots within the plat, `rear yards'
generally opposite the front yards, but with the exceptions noted below.

The lot size far administeiing accessory structure ordinances shall be the
actual lot area and shall not credit any of the Conservation Outlot area.
Additional I��dividual Lot Standards:
Lot 1: The westerly 50'of Lot 1 is subj ect to a Conservation Easement allowing
izo structures or hardcover. The northerly yard of Lot 1 is designated as
a side street yard. The rear yard 50' setback is coincident with the
Conservation Easeinent boundary.
Lot 2: The westerly 50'of Lot 1 is subj ect to a Conservation Easement allowing
no structures or hardcover. The westerly 50'yard of Lot 2 is designated
as a rear yard for zoning purposes. The westerly SO'setback is coincident
with the Conservation Easement boundary.The southerlyyard of Lot 2
shall also be treated as a rear yard,and shall be subj ect to a 5 0'rear yard
setback and the 75' creek setback. No accessory structures shall be
placed within the 50' rear yards, nor within 75' of the creek.
Lot 3: The existing house setback to Lot 3's northeasterly boundary shall
be recognized as a legal nonconformity. However,any new construction
within Lot 3 shall conform to the standards established herein. The
southerly and southeasterly yards of Lot 3 shall be designated as rear
yards, and shall be subj ect to a 50'rear yard setback and the 75'creek
setback.No accessory structures shall be placed within the 50'rear yard,
nor within 75' of the creek.
Lot 6: There shall be no stnictural or hardcover encroachments of the stomlwater
pond easement or the 35' wetland buffers.
Lot 7: There shall be no structural or hardcover encroaclunents of the stormwater
pond easement,of the 35'wetland buffers,nor of the 30'drainage and
utility easement along the northwesterly boundary of Lot 7.
3. Tree Preservation and Landscaping. The developer shall adhere to the approved tree
preservation a�ld landscaping plans.The developer shall walk the site with City staff prior
to site�rading to establish which,if any,trees within the grading area can be saved or

4. Conservation Easement Markin�. Pennanent markers of a desi�a�id material acceptable
to the Planning Director shall be placed by the developer at all points where the
Conservation Easeinent intersects a lot boundary or where the Easement boundary line
changes direction, as stipulated in the Flowage and Conservation Easement.
5. Construction ofRoads,Utilities and Site Improvements. Developer shall construct the
private road within Outlot B and Tract G,RLS 352,as well as sanitary sewer,water and

6. Sanitary Sewer and Water Svstems. All applicable City of Long Lake connection fees and
charges associated with the sewer and water systein serving the development shall be paid
to Long Lake by the Developer. Developer shall be responsible for any charges
to the City of Orono from the City of Long Lake in relation to the provision of municipal
sewer and water from Long Lake.

8. Gradin�and Draina�e Requirements. General site grad'uig shall be in conformance with the
approved Grading,Drainage and Ero sion Control Plan,subj ect to the recommendations
of the City Engineer in his letter dated January 13,2005. During development within
individual lots,wherever feasible,u�dividual driveways shall be graded to drain toward the
road storm sewer system.Wherever feasible,individual yard areas shall be graded to drain
toward the road storm sewer system. Wherever feasible,roof gutter systems shall be
installed to discharge roof runoff so that it will drain toward the road storm sewer system.
9. Si�na�e and Lighting. No street lighting or development identification signage has been
approved for Creekside In Orono. Any such proposed lighting or sig�lage shall be subj ect
to prior City approval, which may require public hearings.
10. Citv En�ineer Approval.Approval of all improvements is subj ect to recommendations of
City Engineer Thomas Kellogg as noted in his comments dated January 13, 2005.
11. Miruzehaha Creek Watershed District A�proval.This subdivision approval is subj ect to
MCWD approvals and permits as required. The final plat shall not be released for filing
until the Developer has provided evidence that all required MCWD permits have been
obtained.
12. Developers A�reement.The plat shall not be released for filing until the Developer has
executed aDeveloper's Ageement per the conditions ofResolutionNo.5204,including
a letter of credit written to 150%of the cost of the proposed site improvements,including
any required landscaping.
13. Site Improvements;Buildin�Permit Issuance. No land alterations shall take place until
erosion control is established and the City Engineer has approved all final improvement
plans.No building pernuts will be issued until a11 drainage facilities a�ld improvements have
been installed and satisfactory road base (including road base and the initial lift of
bituminous) has been installed.
14. The City Clerk shall release the plat documents for filing ol�ly upon certification by the City
Attorney and Planning Director that all requirements of the platting regulations have been
satisfied.

Hi Chris,
I just spoke to you a little while ago about this lot. It is Creekside in Orono, lot 6. The house drawn on the lot
is NOT what they are building but an example for the owners to get a feel of size of house/lot/yard etc.
We have a client who has a Purchase Agreement on this lot and want to make sure we are providing them
with accurate information. Our questions are as follows:
1.) What is the "EDGE OF WATER" (seems odd that it is inside the 35' Setback From Wetland)
2.) May we take fill where the house will sit and add to the site for grading towards the rear of the 35' Setback
3.) If they want a pool in the future, it needs to be with in the 35' Setback correct.
I am available via email or cell and happy to come in if that is easier.
We do have a soil report if you would find that helpful. I have asked the survey company about this and they can't
