A building inspection was conducted on March 14, 1985 at the Crystal Bay, MN Post
Office through wnich the following list of deficiencies and recommendations were
identified. The responsibility for corrective action is indicated by paragraph
heading.
Lessar
1. The front storm windows are in need of repair due to broken latches which must
be replaced. The top sections are presently held from falling by wooden dowel rods
� on the outside, preventing secure locking.
2. The rear vestibule door binds badly in the jamb due to sagged hinges and jamb.
Jamb must be adequately reanchored and hinges readjusted.
3. The rear vestibule door knob and lockset are 4�orn out and cannot always be
opened from inside., Replace immediately. Fire and safety hazard.
4. Door to furnace room must be planed at the top to allow proper closing due to a
sagged door jamb.
5. Remove scrub trees along the rear wall of building.
'6. Rear exterior door is weathering and should be painted and refinished to prevent
further deterioration.
7. The rear security light was not functional when tried and must be checked and
repaired if necessary.
USPS
1. All floor tile should be power scrubbed and waxed. Tile surface is in poor
condition and has not been waxed in years.
2. Install a new digital night setback thermostat.
3. Install cover over the window air conditioner.
4. The rear dock door needs new weatherstripping and brush type bottom sweep.
BM EO
1. At the time lease negotiations are initiated, a project to install a new hip
roof with insulat ' n and new high efficiency propane furnace will be started.

Dear Mr . Lemieux:
The Orono City Council, staff, and I have been reviewing the Crystal
Bay Post Office operation since the building was originally purchased
by the City of Orono September 20 , 1979 .
December l, 1980 , the City negotiated a month to month tenancy with the
now retired Head of Postal Department Real Estate Mr . R. W. Van Sickle
subject to sharing of the quarters with the City of Orono, (one-half
postal operations, one-half City functions) .
On August 2 and August 4 , 1983 , I met with you to formulate a plan
to share this housing to facilitate required office space for our
staff. At that time , it was brought to my attention by you, that the
postal service could not share office space as originally agreed to
in 1980 .
In our discussions, you related to me the postal department ' s concern
with the present condition of the building, roof, service drive , and
interior . My estimate to complete this work is $12 ,000 or 75$ of the
original building cost. After reviewing this capital funding and a
complete detail of actual income and expenditures for the 1982 calendar
year, we have a loss of $2 , 650 . 15 per year . If I disregard the
depreciation factor of l00 �nd capital expenditures, our net in rent
is less than our return on the money, if it were invested at today ' s
interest rate .
Several factors cause the City to reconsider the present monthly rental
arrangement:
l. The postal service department ' s decision not to reduce its present
space requirement from 914 sq. ft. to 250 sq. ft. as originally
agreed to by Mr. Van Sickle .

The City of Orono would like to pursue the use of a lock-box operation
as I discussed with you to satisfy mail service in our area, which would
reduce the space requirements you now need, allowing us to share housing
to satisfy our requirements.
If this arrangement is not satisfactory, the City has no other alternatiJe
but to terminate the present monthly agreement allowing 120 days for
other arrangements to be made by your department.
Please accept this letter as an attempt to resolve both of our agencies
housing requirements and to reach an agreement by September l , 1983 .
If an agreement cannot be negotiated to resolve both of our housing
requirements by September l , 1983 , this letter is to serve as legal
notice that the present monthly agreement is terminated effective
December 29 , 1983 , allowing 120 days from September 1 to December 29 ,
1983 , to accommodate relocation of the present operation or a combination
postal lock-box and City use of the present structure .

CI3ANGES TO POST OFFICE
City Administrat.or Bernhardson noted that the City received
a letter from the United State Postal Service requesting the
City of Orono to correct certain energy deficiencies at the
CrystalBay post office. Bernhardson noted that the postal
service will reimburse Orono for all reasonable costs.
Mayor Butler moved, Councilmember L. Adams seconded, to
approve the proposed corrections of the energy deficiencies
at the Crystal Bay Post Office with the understanding that
the postal service will reimburse the City for all reasonable
costs. Motion, Ayes ( 5 ) , Nays (0 ) .
SPRING HILL CONFERENCE
CENTER OPEN HOUSE City Administrator Bernhardson noted that the Spring Hill
Conference Center has extended an invitation to the City of
Orono to attend their open house in celebration of the recent
additions to the center. Bernhardson noted that the open
house will be held on May 18 and 19 .
HIGHWAY 12 CORRIDOR
REPORT City Administrator Bernhardson noted that ,7ohnShardlow will
not attend this meeting tonight and summarized Shardlow' s
comments. Bernhardson explained that Shardlow feels that
the nature of any outcome of the project will result in a
Comprehensive Plan amendment which could cost around
$18 ,000-26,000 .
BOARD OF REVIEW City Administrator Bernhardson noted that he will try to
reschedule the Board of Review meeting scheduled for May 30 .
Bernhardson noted that the notice may have already been
published in the paper in which the date could not be changed.
REQUEST FOR EXECUTIVE
SESSION City Administrator Bernhardson requested that an Executive
Session be held after the regular Council meeting has been
adjourned.

Due to budgeting restraints, funding for the energy retrofit project has been
suspended until at least AFTER October 1, 1985.
If you are electing to waive supervision of the retrofit, please mail the
waiver form to our office. In the event funding is released, we will then
proceed on those projects.
Please discontinue the process of securing bids if you are contracting and
supervising the retrofit project yourself. We will contact you immediately
should funding be released.

Dear Mr. Lemieux:
I have reviewed the fixed terms lease for the Crystal Bay Post
Office and will execute and return it to you before December 29,
1983 , conditioned upon removing the requirement for a 25 ' X 127 ' ,
3 , 121 net sq, ft. parking and maneuvering area, which is stated
to be furnished or improved by the lessor.
When we negotiated the short-term lease with Mr. Van Sickle and
Mr. Robert Vogel in 1980 , it was agreed that since the 25 ' X 127 '
area had not been constructed originally, even though it was included
in the short-term lease , the postal department would not require it.
Since we are now executing a new three-year lease , it is necessary
that we all understand and agree that all future capital improvement
costs, including a parking and manuevering area required by the postal
department, shall be furnished and paid for by the United States
Postal Service and not the lessor (City of Orono) as you and I
orginally discussed. Please consider this condition as an addendum
to the three-year lease submitted to me on December 19 , 1983 .
All other considerations and provisions as stated for the three-year
lease at a monthly rate of $450 . 00 ar� satisfactory as originally
discussed.

The City of Orono will not accept the responsibility of absorbing

below what the market is today for rental or leasing purposes.
I suggest you employ an accredited appraiser to evaluate the building
and its current value to allow a final decision to be made by your
department before December 29 , 1983 , the present termination date

My comments to your November 23 , 1983 letter are as follows :
In today ' s world, there is not a building available for rental or
lease purposes below $5. 51 per square foot. We lease buildings
for our retail operation and find that $7. 00 per square foot is
the going price in this immediate area.
The $3 . 93 per square foot or $300 .00 per month the postal department
has been paying for years is not adequate and will not be considered
to be adequate until an agreement is reached that is comparable to
my original offer stated in my November 15, 1983 letter, which is
$5. 51 per square foot or $420 . 00 per month. As my previous letter
stated, Roger, the City of Orono was informed by Mr. Van Sickle in
1980 , future post office use would be reduced to 200 square feet.
You agreed at our first meeting that this was Mr. Van Sickle ' s comments
to his file. We have to review our projected income quite differently
since the postal department wants to maintain full use of the entire
building.
I will be forwarding to you an estimated cost for the parking lot.
The final decision for the postal department use of the current
building and the cost to install a parking lot and manuevering area
is in your hands .
It is not a prudent investment for the City of Orono to enter inta a
five-year term and a five-year option based upon the postal department' s
refusal to pay a fair price for the use of the entire building.
I would suggest that you research what buildings are leasing or renting
for in the Lake Minnetonka area and then make a decision based upon
these facts and not upon the percentage increase over and above the
current $300 . 00 per month you are now paying which is ridiculously low.
I will submit to you the parking lot estimate next week.

=�.: have completed my review of the Crystal Bay Post Office current
rental income problems .
The current rent on the existing 914 net square foot building is
$300 per month or $3 . 93 per square foot, which is not profitable.
The value of the building and land is determined to be $50 ,000 .
=.�'he net income does not allow for a fair return on our investment.
If the quarters were shared as originally discussed with Mr. Van
'>ickle in 1980 , we would view the income situation quite differently.
A fair return on our investment would b� $420 . 00per month rent or
$5. 51 per square foot. As discussed, the postal department will
pay the taxes which are 30� of the annual rent. The City of Orono
will execute a three-year agreement. The monthly rent will remain
firm at $420 per month during the three-year lease period. All
_�wpital improvements required by the postal department not relative
to the existing building as purchased by the City in 1979 , which
at that time housed the postal service , will be borne by the postal
ciepartment.
Roger, the offer as outlined to you is firm to satisfy our income
requirements on the present structure.
If this offer is not satisfactory, please notify me at once to satisfy
our original monthly agreement termination notice dated August 18 ,
1983 .

Dear Mr . Lemieux :
On August 18 , 1983 , the City of Orono notified you that the City
wished to reach an agreement with the Postal Department allowing
the department and the City to share housing to accommodate office
space requirements. If an agreement could not be reached by
September l, 1983 , the City was officially notifying you that the
present monthly agreement was terminated, effective December 29 , 1983 .
An agreement could not be reached and the official termination notice
went into effect.
On October 6 , 1983 , the City Council and I reviewed our previous
decision and again, reviewed future housing requirements. The
decision was made to reconsider the notice of termination and to
negotiate with you an extended agreement and a review of the present
rent.
Please accept this letter as our official notice to you that the
City of Orono will negotiate an extended agreement to meet your
requirements and the City ' s , incorporating a review of rental income.

In response to your memorandum of June 30, a visit was made to determine feasibility
of satisfying the City's request for space in our postal facility.
The facility was built to postal service specifications, hence the building is not
subject to division into separate office space without interferring with operations .
The reques�, therefore, is denied.
During the visit another matter surfaced that is of great concern. The maneuverina
area to the rear of the building was never graded or surfaced. The slab at the rear
vestibule merely exits to grass . Since the maneuvering area� is unfinished, all
. mail is brought in thru the front entrance 5 days a week. On Saturdays the SR
driver either backs in over the grass area or hand carries the mail during h�inter or
inclement weather. This situation is not satisfactory to the Postal Service.
As this building was built and occupied in 1960, predicated on postal plans, we
request that you research your files to determine the reasons for non compliance.
Should the City of Orono desire use of our parking and maneuvering area, we would
consider their application if their use would not interfere with receipt and
dispatch of mail . The village office building is approximately 40 yards north of
the Post Office. The area should be surf aced in any case.

When the City acquired the Post Office building in 1979 , it was
purchased with the intent to use it for future City government
functions, either in conjunction with the current postal operation
or to terminate the 30 day lease rental and utilize the entire
structure .
In light of the attached letter handed to me on ,7ul.y 20, 1983 ,
it appears the only recourse is to consider total usage of the
building. I will be discussing this matter with other postal
officials.
Adequate housing is necessary for our Assessor . I can house that
department temporarily in our vacated police structure, but
permanent housing is needed.
