In return for issua��ce of said Demolition Permit, the undersigned owner hereby agrees to:
1. Submit a survey, aerial photo or sketch showing all structures on the property. Note which
structures are to be demolished.
2. Submit a survey, aerial photo or sketch showing proposed erosion control measures in
accordance with Chapter 79, Construction Site Runoff Control.
3. Submit a copy of permit approval from the Minnehaha Creek Watershed District (MCWD). The
City will not issue a demolition permit without a copy of the permit(s) from the MCWD or
documentation stating permit(s) are not required. �I� _���
4. Submit a $2,500 escrow and an escrow agreement signed by the property owner.
5. Keep all structure(s) enclosed and/or secured until such time as demolition is complete.
6. Keep all demolition debris off adjoining property and/or the public rights-of way unless specific
prior approval is obtained in writing for temporary use thereof.
7. Completely remove foundation(s) from the ground.
8. Completely dispose of all demolition debris off site in accordance with all applicable PCA
requirements.
9. Abandon water wells in accordance with State Health Department regulations.
10. Call for an inspection when all debris has been removed, before backfilling.
11. Within 5 working days of superstructure removal, a final inspection shall be requested. The site
shall be left clean and clear of all debris, with any excavation filled with earth level with the
adjacent ground elevation (except when such excavation is to be used as part of a new building
and such new building is actually under construction).
12. Abandon septic systems per Minnesota Rules Chapter 7080. All septic tanks must be pumped,
crushed and filled with native soils. An inspection is required after the tanks are pumped and
before the tanks are crushed and filled.
13. The undersigned owner shall and hereby does indemnify and hold harmless the City of Orono,
its agents, employees and assigns from and against all claims, damages, losses or expenses,
including attorney fees, against the City, its agents, employees and assigns arising out of or
resulting from the demolition described herein as performed by the property owner, his
employees, agents, subcontractors or assigns.

Sec. 78-72. - Lots of record.
(a) A lot of record is any lot for which a deed or registered land survey has been recorded in the office
of the register of deeds or the registrar of titles for Hennepin County prior to January 1, 1975, and
after approval by the council if required.
(b) A lot of record located within an R(Residential) or RR(Rural Residential) district but not within the
Shoreland Overlay district, RS Seasonal Recreational district, or any of the LR-Lakeshore
Residential districts, which does not meet the requirements of this chapter as to area or width may
be utilized for a single-family detached dweliing purpose, provided that in the judgment of the
council or administrative approval by the planning director, such use does not adversely affect
public health or safety and the following requirements are met:
�n R districts of one acre or less and served by public sanitary sewer. A lot of record existing
upon January 1, 1975, in any R district of the city of up to and including one acre, which lot is
serviced by public sanitary sewer and which does not meet the requirements of this chapter
as to area or width only, may be utilized for single-family detached dwelling purposes without
council approval if all other requirements of the underlying zoning district are met, including
but not limited to required yards, setbacks, lot coverage by structures, hardcover, etc.
However, the lot of record shall not be more intensely developed unless combined with one or
more abutting lots or portions so as to create a lot meeting the requirements of this chapter.
In R or RR districts of�reater than one acre and served by public sanitary sewer. A lot of
record in any R or RR district in the city in excess of one acre which does not meet the
requirements of this chapter as to area or width only may be utilized for single-family
detached dwelling purposes by administrative approval if the planning director finds that the
following conditions are met:
� ;I lp a. It is at least one acre in size, and the average width of the lot is at least 100 feet;
�eS b. It is served by public sanitary sewer; and
c. It otherwise meets the requirements of this chapter or other applicable Code
provisions.
(3) In R or RR districts not served by public sanitary sewer. A lot of record in any R or RR
district in the city not served by public sanitary sewer must meet the area and width
requirements of this chapter and shall not be utilized for single-family detached dwelling
purposes without council approval. Administrative approval may be granted for a lot of
record not meeting the lot area and width requirements if the planning director finds that
the following conditions are met:
a. The lot area and lot width each meet at least 50 percent of the district standard.
b. Suitable primary and alternate septic sites are identified on the property and are
protected from future development by execution of a covenant.
c. All other zoning ordinance requirements must be met, including but not limited to the
following:
1. Setbacks.
2. Hardcover.
3. Lot coverage by structures.
4. Accessory structure requirements.

A lot of record located in any shoreland district, including the Shoreland Overlay district, RS
Seasonal Recreational district, and any of the LR- Lakeshore Residential districts, that does not
meet the requirements of this chapter for lot size or lot width shall be subject to the following
regulations:
(1) A nonconforming single lot of record may be allowed as a building site without variances from
lot size and width requirements, provided that:
a. All setback requirements can be met;
b. A Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, can be
installed or the lot is connected to a public sewer; and
c. The impervious surface coverage meets all hardcover location and square footage
restrictions of this chapter and the total square footage of hardcover does not exceed 25
percent of the entire lot area.
d. All other zoning district standards can be met.
(2) In a group of two or more contiguous lots of record under a common ownership, an individual
lot must be considered as a separate parcel of land for the purpose of sale or development, if
it meets the following requirements:
a. The lot must be at least 66 percent of the dimensional standard for lot width and lot size
for the shoreland classification consistent with Minnesota Rules, chapter 6120;
b. The lot must be connected to a public sewer, if available, or must be suitable for the
installation of a Type 1 sewage treatment system consistent with Minnesota Rules,
chapter 7080, and local government controls; and
c. Impervious surface coverage must meet all hardcover location and square footage
restrictions of this chapter and the total square footage of hardcover must not exceed 25
percent of the entire lot area; and
d. Development of the lot must be consistent with the comprehensive plan.
(3) A lot subject to either subsections 78-72(c)(1) or(2) remains subject to the hardcover
restrictions of this chapter, as follows:
a. Where the hardcover square footage allotment as calculated based on the assigned tier
exceeds 25 percent of the entire lot area, hardcover shall be limited to 25 percent of the
entire lot area.
b. No portion of the impervious surface square footage allowed shall be placed within in 75
feet of a lake OHWL or tributary bank, except for those items normally allowed in such
location as regulated elsewhere in this chapter.
(4) A lot subject to subsection 78-72(c)(2) not meeting the requirements of subsection 78-72(c)(2)
must be combined with the one or more contiguous lots so they equal one or more
conforming lots as much as possible.
(5) Notwithstanding subsection 78-72(c)(2), contiguous nonconforming lots of record in
shoreland areas under a common ownership must be able to be sold or purchased
individually if each lot contained a habitable residential dwelling at the time the lots came
under common ownership and the lots are suitable for, or served by, a sewage treatment
system consistent with the requirements of Minn. Stat. § 115.55 and Minnesota Rules, chapter
7080, or connected to a public sewer.

In all variance requests, zoning and building permit applications or conditional use requests,
the property owner shall address, when determined as appropriate by the city engineer or city
staff, stormwater runoff management, reduction of impervious surfaces, setback increases,
restoration of wetlands, vegetative buffers, sewage treatment and water supply capabilities,
and other conservation-designed actions.
(7) A portion of a conforming lot may be separated from an existing parcel as long as the
remainder of the existing parcel meets the lot size and sewage treatment requirements of the
zoning district for a new lot and the newly created parcel is combined with an adjacent parcel.

currently associated with the principal structure (setbacks, hardcover, size of building, etc) with its removal.
• Rebuilding on a substandard lot of record (i.e. a lot that does not meet the zoning district required lot area or width
standards) may, with few exceptions, require variance approval by the City Council, and such approval is neither
automatic nor guaranteed but requires that a practical difficulty be demonstrated.
• Additionally, all current zoning standards will have to be met by the new principal dwelling including setbacks, and
building footprint, hardcover (impervious surface), & height timitations, etc.
• Where municipal sewer is not avaitable, provision of two (2) conforming on-site septic treatment sites is mandatory for
a new dwelling.
• Unless specifically approved by the City, all seasonal and permanent docks must be removed at the time of
principal dwelling demolition. They may not be re-installed until a new principal dwelling has reached the framing
stage.

Introduction
On June 12, 2015, Sheltertech Corporation collected samples of suspect asbestos-containing
materials in preparation for the planned demolition of the single-family residential structure
located at 1050 Edgewood Hill Road in Wayzata, Minnesota. The inspection was conducted
by Sheltertech representative George Zortman (Minnesota Asbestos Inspector #A11455).
The site was occupied by a one story, multi-level residential building constructed of wood
frame walls with vertical wood/brick siding, flat roof, and a full basement. The house was
heated with five natural gas forced-air furnaces and cooled with four central air conditioning
systems. The presence of vermiculite was not identified within the attic or those wall cavities
accessible to visual inspection. According to Hennepin County property records, the building
was constructed in 1970.
Laboratory Analysis
After completion of the field sampling activities, the bulk samples and accompanying chain-of-
custody (COC) documentation were submitted to Carolina Environmental, Inc. of Cary, North
Carolina. Carolina Environmental, Inc. participates in the analysis of standard bulk samples
through the National Voluntary Laboratory Accreditation Program. Its NVLAP Accreditation
number is 101768-0. The examination for the presence and identification of asbestos fibers in
bulk samples was performed using crossed polarized light microscopy (PLM) and dispersion
staining particle identification technique in accordance with USEPA, Method for the
Determination of Asbestos in Bulk Building Materials, EPA 600/R-93/116 (July, 1993). Bulk
samples containing multiple layers were analyzed per layer. The samples were analyzed
utilizing a positive stop method, where indicated.

Three (3) material types were found to contain greater than one percent asbestos
(material quantities are estimates only):
• 470 SF Ceiling Texture, North Stairwell; SW Bedroom & adjacent Hallway, Mezzanine; North
Hallway, Main Floor
• 150 LF Transite HVAC Duct, South Lower Mezzanine (sub-slab)
• 3 SF Roofing Sealant, Roof
One (1) material type was found to contain less than one percent asbestos (material
quantities are estimates only):
• Sheetrock/Joint Compound (composite wall system), North stairwell
One (1) material type was assumed to contain greater than one percent asbestos
(material quantity undetermined):
• Waterproofing Material (unknown quantity), Foundation Exterior
No asbestos was detected in the remaining material types.
Asbestos inspection results are presented in the following table. All PLM results of "none
detected" indicate asbestos free materials. All PLM results less than one percent (<1%)
indicate non-asbestos-containing materials, in accordance with the Minnesota Department of
Health (MDH) asbestos rules. Only PLM sample results greater than one percent (>1%) are
asbestos-containing materials. Friable materials are those which when dry can be crushed,
pulverized, or reduced to a powder by hand pressure.
Materials that were determined to contain greater than one percent asbestos are
categorized as friable or non-friable and are indicated in the table by shading (actual
friability may be determined by the degree of disturbance imposed upon the material during
demolition, removal, or transport). Material quantities are estimates only.

Requlatory Discussion
ACM can be either friable or non-friable. The non-friable materials can be broken down into
two categories. Category I includes floor tile, roofing, packings and gaskets. Category II
includes all other non-friable materials.
Regulated ACM consists of the following types of materials:
• Friable materials
• Category I non-friable asbestos that has become friable
• Category I non-friable asbestos that will be sanded, ground, cut or abraded
• Category II non-friable asbestos that has become friable
• Category II non-friable asbestos that has a high probability of becoming
friable during demolition or renovation
The Minnesota Pollution Control Agency (MPCA) and the MDH regulate the removal of ACM in
Minnesota. The Occupational Safety and Health Administration (OSHA) regulates worker
protection. The MPCA administers the requirements of EPA's National Emission Standards for
Hazardous Air Pollutants (NESHAP) regulations. The MDH Asbestos Unit regulates how
asbestos is removed and administers the Model Accreditation Program for asbestos
professions.

a Minnesota municipal corporation ("City")and Barbara Steiner and Tom Rassieur("Owners").
Recitals
1. A building permit application has been filed for a new single family home located at
1050 Edgewood Hills Road the ("Subject Property"), legally described as Tract H, Registered Land Survey No.
1098, Hennepin County, Minnesota. The boundary lines of which have been established by judicial Landmarks as
shown on Plat of Survey and certification as to location thereof filed October 29, 1963 in Torrens Case No. 15271,
in District Court, Fourth judicial District, Hennepin County, Minnesota. (Per Certificate of Title No. 1389468).
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2016-00088, demolition permit
#2015-01109 and In-ground Pool Permit #2017-00098 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

two times per year to determine whether the requirements of the project have been successfully completed and
whether it is appropriate to return the funds. Owner may also request the release of the funds, and such funds shall be
released upon City Staff receiving the appropriate verification that all requirements of the project have been
successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance
to the subject property pursuant to Minn. Stat. §§ 415.01 and 366.012.

AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 180 days at any time after work has commenced.
