not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances goveming this type of work

Occupancy(TCO) may be necessary. A TCO requires a $10,000 escrow.

On June 30, 2016 the City received revised building and landscape plans and an updated survey for a new single family
home. Staff conducted a preliminary review based on the information provided and requests the following items be
submitted or revised in order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. Our engineer has reviewed the survey submitted and has the following comments:
a. The plan depicts fill as deep as 10-12 feet in places along the western side of the property. Please have
the surveyor provide a calculation for the amount of fill that is being brought onto the site.
b. As drawn it appears the sewer service cleanout structure will be 4 feet underground. The applicant
should provide a plan for maintaining access to the structure for future maintenance needs.
c. Retaining walls are grayed out which would indicate they are being removed. Please provide
clarification.
d. Show proposed well location on survey.
e. Show rock construction entrance.
2. Landscape Plan. A landscape plan dated June 27, 2016 was received. We have reviewed and request
clarification on the following:
a. Retaining walls shown on the survey are not shown on the landscape plan. Please clarify.
b. There appears to be proposed grading in the"no grading" area. Please clarify

On January 1, 2016 we received a building permit application for a new single family home at 1050
Edgewood Hills. The plans were reviewed, comments were made and sent to the builder, several times.
On May 26th we were notified the plans were changing. Today we received new construction plans,
landscape plans and surveys. You each have a one set of the construction plans, landscape plan and
survey, along with partial copies of the original site conditions/survey and a narrative from the builder
with the proposed changes.
The original set of plans, surveys, etc. are the shelving unit in the plan review area if you need to
reference them.

- Garage moved from south side of main entrance to the north.
- Stone steps from upper patio to pool deck removed. Retaining wall revised from straight to L-shaped.

- Retaining walis on north corner of the pool were removed. Grade slopes north at 3:1.
- House rotated roughly 5 degrees counter clockwise. All setbacks respected.

- House livable area reduced from 5460 sf to 5265 sf. Garage remains the same size.
- Building height increased by two inches but remains below height limit (refer to A-001).

I've reviewed the subject site/grading plan and offer the following comrraents:
1. Plan depicts grading within and unclassified wetland on the fVorth West corner of the property. The applicant
may be required to obtain Minnehaha Creek Watershed District(MCWD) approval and permitting for their
Wetland Protection Rules.A copy of any approvals or permits required should be submitted prior to final
approval.
2. The erosion control plan is not depicted. The erosion control plan is discussed on Sheet T-001 however l did not
see a depiction of the plan in accordance with the City's standard survey requirements. The erosion control
plan should depict the location of any planned measures silt Fence, Bio Roles and construction
entrance. Erosion control mechanisms should be planned for and must be installed and inspected by the City
prior to any land disturbing activities. The Contractor must provide a minimum 24 hour notice prior to
inspection.

On April 28, 2016 the following was submitted: survey dated 4-25-16; L1, Site Plan dated 3-15-2016; and L2.1 Erosion
Control Plan. Staff reviewed the information and has the following comments:
1. Landscape Plan.
a. The word 'gate' was removed, but the landscape plan stills shows what appears to be a gate, please
remove.
b. The landscape plan shows a limestone wall adjacent to the pool equipment, but this wall is not shown
on the survey. Please have the limestone wall shown on the survey, showing top and bottom wall
elevations.
c. Sheet L2.1 of the Landscape plan references sheet L2. Please provide two full-size copies for our
review.
d. The landscape plan references a `no grading' area, however the survey shows retaining walls to be
removed. Please clarify.
2. Certificate of Survey.
a. The concrete wall south ofthe terrace does not indicate top and bottom wall elevations. Please clarify.
3. Pool Permit. A pool permit application was submitted without plans. I will contact the pool contractor directly
about obtaining pool plans. Once we have all the other issues resolved,we will issue the building permit. The
pool permit will be issued separately.

Included in the packet was the permit application for the outdoor pool. I told your admin asst.that I wanted to confirm
if in fact the pool was to be part of the project. I reviewed budgets with the clients today and it will be included. I will
stop by your office and pay for the plan review fee portion of the pool permit.
Lastly is the MCWD items. I was told they will have their final report (verifying our engineers' report that states
wetlands do not exist on this property) released on May 5th. If they don't send you a copy, 1 will forward to you and
Christine.
Based on the above, could you tell me when the entire permit package will be completed? I want to start scheduling
excavators, concrete work,framers, and of course my clients are anxious to see us get started. I told them that most
years,we're still on road restrictions for another couple of weeks but that didn't pacify them O.

I received the plans with your note showing that the City of Orono has flagged a potential wetfand on the neighboring
property.This potential wetland triggers the City of Orono's wetland rule.According to MCWD internal records there is a
potential wetland straddling the northern property boundary, half on 1050 Edgewood Hills Road and half on 320
Woodhill Road. Independent of the City of Orono's wetland rule,the Mir�nehaha Creek Watershed District Erosion
Control and Wetland Protection rules are triggered because there is a proposed new single family home on a property
with a potential wetland.This potential wetland has not been delineated and we require a wetland delineation, which
cannot occur until the ground thaws in order to issue a MCWD permit.The City of Orono will not issue a permit until the
District issues a permit.The "Getting a Wetland Permit-MCWD Fact Sheet" goes over the timeline for our Wetland
Protection rule process.

On Wednesday, March 2"d, 2016, Kjolhaug Environmental Services (KES) reviewed the 1050
Edgewood Hills Road to determine if wetland was present at the project location and if present,
determine the extent. At that time, snow cover was absent but soils were still frozen. Leaves were
generally absent from deciduous trees and shrubs, but dead herbaceous vegetation from the
previous growing season was present and largely identifiable.
Topography on the site was steeply sloped downhill toward the northwestern portion of the
property. The site was cleared of vegetation except for deciduous and coniferous trees located
along the site boundaries. One potential wetland area(Area A) was identified just north of the
site boundary (Figure 1). Area A had a canopy of boxelder, green ash, and silver maple trees.
The understory was dominated by Kentucky bluegrass and lesser amounts of garlic mustard. No
ponded water was observed within the area of investigation at the time of the March 2°d site visit.
The absence of ponded water especially during the winter snow melt season could suggest the
area does not accumulate a sufficient amount of hydrology to support wetland conditions. While
the observed plant community was dominated by species that can be associated within wetlands,
they area also commonly seen in historically disturbed/altered areas and single-lot homes
throughout the metro area.
Based on the observations from the preliminary site review we believe no wetland is present on
the site however, an additional site visit during the growing season is needed to assess whether
hydric soils and/or wetland hydrology indicators are present before a formal wetland
determination can be made. Please note that this opinion does not constitute a formal wetland
determination and cannot be relied on in your City and MCWD reviews.

I apologize that I haven't gotten back to your sooner. I am happy to set up a meeting with you to discuss the process for
permit applications triggering our wetland protection and erosion control rule. In order to give you background
information, I am forwarding you the materials I sent Streeter associates and the City of Orono that are required for a
permit at 1050 Edgewood Hills Road, Orono. Weather allowing I will be in the office until 4:30pm today. Feel free to call
me to set up a meeting or answer any questions after you take a look at the attached materials.
I received the plans with your note showing that the City of Orono has flagged a potential wetland on the neighboring
property.This potential wetland triggers the City of Orono's wetland rule. According to MCWD internal records there is a
potential wetland straddling the northern property boundary, half on 1050 Edgewood Hills Road and half on 320
Woodhill Road. Independent of the City of Orono's wetland rule,the Minnehaha Creek Watershed District Erosion
Control and Wetland Protection rules are triggered because there is a proposed new single family home on a property
with a potential wetland.This potentia! wetland has not been delineated and we require a wetland delineation, which
cannot occur until the ground thaws in order to issue a MCWD permit. The City of Orono will not issue a permit until the
District issues a permit.The "Getting a Wetland Permit-MCWD Fact Sheet'°goes over the timeline for our Wetland
Protection rule process.

wetland appears to be Eocated within 150 feet of the proposed project. Because Orono City Code requires a
35-foot setback from any wet[and for structures or hardcover,the location of the wetland must be indicated

i�4.� Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal

Building height means the vertical distance between the highest adjoining ground
level at the building or ten feet above the lowest ground level, whichever is lower,
and the top of the cornice of a flat roof, or the deck line of a mansard roof, or the
uppermost point on a round or other arch-type roof, or the median height of the
highest gable of a pitched or hipped roof. Topographic changes which elevate the
adjoining ground level above the existing terrain shall not be considered in
determining building height. For a pitched or hipped roof situation, regardless
whether the highest living space in a building is a half-story or full story, if the
highest living space contains windows (excluding skylights) the upper measuring
point for defining building height shall be the median height of the top of the
highest window and the highest peak of the roof.

• The��armored slope"on the NE corner should be treated as a retaining wall and have an engineered design to ensure
it does not fail. If grading up to/on to neighboring properties, a written consent to do so from the affected neighbor
must be received with the building permit application.
• The driveway as depicted exceeds the City's standards. (Max width for the curb cut is 20ft.; min width is 8 ft.)
• Driveway entrance should be 100 ft from any road intersections.
• With the building permit we would want to see a comprehensive drainage plan to ensure roof and hardcover runoff is
not being directed onto the neighboring property.
• Extrapolated Contours through existing house site appear reasonable for basement calculation. They generally
conform to the extrapolated Lidar data from the Counry.
• The grading on the site should be set back at least 5'from property lines. If grading up to/on to neighboring
properties a written consent to do so from the affected neighbor must be received with the building permit
application.
• Soil density testing will be required in relation to the structural building permits (house, walls, etc) and/or for
engineered slopes. Soil testing will not be required for the other re-graded areas.
• Please see this LINK to the MN Department of Health's page for water supply well isolation distances.
• There is potentiaf to connect the new sewer line from the house to the existing line connection point within the
subject property (as opposed to the stub at the property line/trunk line). Specific inspections and testing may be
required to provide conclusive direction, Please contact Adam Edwards (Orono's City Engineer/Public Works Director)

• The pool equipment must be located behind the setback line. The Code does not allow for an encroachment of pool

A cornice (from the Italian cornice meaning "ledge") is generally any horizontal decorative molding
that crowns a building or furniture element—the cornice over a door ar window, for instance, or the
cornice around the top edge of a pedestal or along the top of an interior wall. A simple cornice may be
formed just with a crown molding.
The function of the projecting cornice of a building is to throw rainwater free of the building's walls. In
residential building practice, this function is handled by projecting gable ends, roof eaves, and gutters.
However, house eaves may also be called "cornices" if they are finished with decorative molding. In this
sense, while most cornices are also eaves (in that they overhang the sides of the building), not all eaves
are usually considered cornices—eaves are primarily functional and not necessarily decorative, and a
cornice has a decorative aspect to it.

The cornices of a modern residential building will usually be one A Classical cornice '
of three types: a box cornice, a close or closed cornice, or an

Box cornice
Box cornices enclose the cornice of the building with what is essentially a long narrow box. A box
cornice may further be divided into either the narrow box cornice or the wide box cornice type. A
narrow box cornice is one in which "the projection of the rafter serves as a nailing surface for the soffit
board as well as the fascia trim."�3�:p.63 This is possible if the slope of the roof is fairly steep and the
width of the eave relatively narrow. A wide box cornice, which is common practice on houses with
gentle roof slopes and wide eaves, requires the use of lookouts to give it support and to provide a surface
to which to securely attach the soffits. Box cornices often have ventilation screens laid over openings cut
in the soffits in order to allow air to circulate within the cornice.
Close cornice
A close, closed, or snub cornice is one in which there is no projection of the rafters beyond the walls of
the building, and therefore no soffit and no fascia. This type of cornice is easy to construct, but provides
little aid in dispersing water away from the building and lacks aesthetic value.�3�p�bs
Open cornice
In an open cornice, the shape of the cornice is similar to that of a wide box cornice except that both the
lookouts and the soffit are absent. It is a lower-cost treatment that requires fewer materials, and may

The term cornice may also be used to describe a form of hard window treatment along the top edge of a
window. When used in this context, a cornice represents a board (usually wood) placed above the
window to conceal the mechanism for opening and closing drapes. If covered in a layer of cloth and
given padding, it is sometimes called a soft cornice rather than a hard cornice.

a Minnesota municipal corporation ("City") and Barbara Steiner and Tom Rassieur("Owners").
Recitals
1. A building permit application has been filed for a new single family home located at
1050 Edgewood Hills Road the ("Subject Property"), legally described as Tract H, Registered Land Survey No.
1098, Hennepin County, Minnesota. The boundary lines of which have been established by judicial Landmarks as
shown on Plat of Survey and certification as to location thereof filed October 29, 1963 in Torrens Case No. 15271,
in District Court, Fourth judicial District, Hennepin County, Minnesota. (Per Certificate of Title No. 1389468).
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2016-00088, demolition permit
#2015-01109 and In-ground Pool Permit #2017-00098 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

Recitals

consultant legal and/or engineering review.
3. The City will commence its review of the application and incur costs associated with said review only if
the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement,
the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to reimburse the
City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all
out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal consultant
review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be
responsible for under a building permit application. The escrow will also guarantee reimbursement to the City for all
out-of-pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater
Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used
by the City to eliminate any hazardous conditions associated with the work and to repair any damage to public property
or infrastructure that is caused by the work (including planning, engineering, or legal consultant review) associated with
building permit#o�q/S-G//09 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send
a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the
City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced
pursuant to#3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for
eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners
when all requirements related to the project are complete. City Staff shall review the terms of this escrow agreement
two times per year to determine whether the requirements of the project have been successfully completed and
whether it is appropriate to return the funds. Owner may also request the release of the funds, and such funds shall be
released upon City Staff receiving the appropriate verification that all requirements of the project have been
successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance
to the subject property pursuant to Minn. Stat. §§ 415.01 and 366.012.

AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
