MINUTES FOR SEPTEMBER 13, 1999

The Council met on the above - mentioned date with the following members present: Mayor
Gabriel Jabbour, Council Members Charles Kelley, Richard Flint, Bob Sansevere, and Barbara
Peterson. Representing Staff were City Administrator Ron Moorse, Public Services Director
Greg Gappa, City Attorney Tom Barrett, Senior Planning Coordinator Michael Gaffron, City
Engineer Tom Kellogg,. Zoning Administrator/Planner Paul Weinberger and Recorder Lanette
Wolf. Mayor Jabbour called the meeting to order at 7:00 p.m.
( #1) RECOGNITION OF MIKE BYRNES, RESOLUTION NO. 4342
Moorse read a resolution of appreciation to Mike Byrnes for his efforts in support of the
community and the Orono Police Department.
Kelley moved, Peterson seconded, a motion to adopt Resolution No. 4342, a Resolution
of Appreciation to Mike Byrnes for his Support of Public Safety Activities in the
Community. VOTE: Ayes 5, Nays 0.
Jabbour presented a framed copy of the resolution to Mr. Byrnes and thanked him for his
support of public safety activities in the community.

APPROVAL OF MINUTES

Flint referred to the Mayor /Council Report on page 12 of the minutes. He said that the first
sentence of the second paragraph should read as follows:
"Jabbour reported that he and Mr. Flint met with Hennepin Parks; Peter Johnson, a resident of
Mound; and Al Vogal, Director of Waterways, Freight and Railroads for Mn/DOT, to gain a
better understanding of what might happen with the railroad."

PLANNING COMMISSION COMMENTS - Jay Nygard, Representative .
None
PUBLIC COMMENTS
John Winston, 144 Wear Lane North, and Jim Renckens, 3020 Watertown Road were
present. Winston said he and Mr. Renckens wanted to express their concern with the
relocation of the railroad and Highway 12 and the apparent decision of the State not to place a
berm or some type of sound/noise/light barrier between their neighborhood and the relocated
railroad and highway. It is their understanding that the State has made a decision that their
neighborhood is not impacted to such an extent that any kind of barrier will be installed. They
are concerned about the adverse impact this will cause to their property value. He said he does
not feel it will do any good for him and Mr. Renckens to plead their case with Mn/DOT unless
the City of Orono expresses a concern. He requested that the City Council express these
concerns before the Design Review Committee.
Renckens said he spoke with Tom O'Keefe from Mn/DOT who confirmed that because of
cost considerations and their properties do not immediately abut the roadway, Mn/DOT does
not feel it is warranted to protect their neighborhood. Mr. O'Keefe told him that the only way
to overturn that decision at this time is by the political process.
Jabbour briefed Winston and O'Keefe on the fact that the City's position has always been that •
Mn/DOT shall protect all the property, including present and future homes, along the road.
The Design Review Committee was formed so that each neighborhood could decide what
would be appropriate for them, but Mn/DOT has very strict guidelines. There must be at least
three homes within a specific distance before Mn/DOT will put in a barrier or protection.
Many places in Orono do not meet the guidelines because of the two -acre zoning. Mn/DOT
replied that they would not discuss it until the guidelines were met. Jabbour said that there
was a recent subdivision that created five additional homes and it was submitted to Mn/DOT.
He said the City's strategy has been to work closely with Mr. O'Keefe. He suggested that
perhaps some of the other lots in their neighborhood would have to be subdivided to meet
Mn/DOT's guidelines.
Kelley said that the lots belonging to Alan Carlson are almost landlocked and may need to be
subdivided.
Winston said he wants it on the record that they requested that the environmental impacts to
their neighborhood be minimized.
Jabbour said their concerns have been conveyed to Mn/DOT in the past. He said that their
concerns will be brought up again and he encouraged Winston and Renckens to voice their
opinions to Mn/DOT.

Renckens said he doesn't feel it should be as controversial for Mn/DOT as it apparently is to
provide protection for their neighborhood. He asked if the Mayor and the Council would be
willing to meet with them and Tom O'Keefe to discuss this issue.
Jabbour said he would be willing to meet with them, but it would be easier if more homes will
be affected.
Moorse said that funding for the right -of -way acquisition needed for the berms is an obstacle
for Mn/DOT.
Jabbour said he was told at the last meeting_ with Mn/DOT that this will be a difficult
acquisition because the right -of -way is very expensive and may take an additional year to
obtain.
Flint said that the latest communication from Mn/DOT states: "Mn/DOT will employ all
reasonably available noise mitigation measures. The Minnesota Pollution Control Agency is in
the process of rewriting rules including, the noise standards. Mn/DOT will construct noise
walls up to a height of 20 feet in an effort to obtain noise standards as defined by the MPCA if
the construction is a cost effective means of obtaining-noise standards. We cannot guarantee
that noise levels will not be increased. Mn/DOT is committed to continue working with the
• cities and neighborhoods to design the project in such a way as to minimize noise and visual
impacts to the greatest extent possible." He said that, in a general way, Mn/DOT expresses
full support for Mr. Winston's and Mr. Rencken's concerns. The Design Review Committee
has to keep pressing Mn/DOT on the specifics of the design.

Jabbour suggested that Mr. Winston and Mr. Renckens open a dialogue with Mr. Carlson
regarding his property because it is immediately adjacent to the highway.
John Mayer, Mayer Distributing, said he will be required to relocate his business due to the
Highway 12 project. He is having a problem finding property for his bulk plant storage facility
for gasoline and diesel fuels. He asked if the Council would consider amending the industrial
zoning code to permit a bulk petroleum storage plant. Mayer said that he has found a piece of
property that would be suitable, but he does not want to purchase the property if appropriate
zoning cannot be obtained. Mayer said that there are new rules that apply to bulk plants which
improve the safety. He said his company has a good track record for safety.
Jabbour said the Council would need to determine if the use is appropriate and that should be
addressed through an application.
Moorse said this is a first step to let the Council know what Mr. Mayer would like to do.

PARK COMMISSION COMMENTS Susan Wilson
Susan Wilson said the Park Commission has been discussing working with the Crystal Bay
residents on an ice rink. She suggested that the Council consider incorporating apiece of City
property in the park before final plans are made for the park in Crystal Bay and she asked
whether the road between the park property and the City .property.is still needed.
Jabbour asked about the progress on the environmental upgrade of the site.
Gappa said that everything is complete except the monitoring, wells must be pulled out.
Jabbour said that the Council would look into incorporating the City property in the park.

Jabbour said that the impact of the activities on Big Island has been extremely negative to
Spring Park. He received letters of concern from the City of Spring Park, Lord Fletcher's and
the Minnetonka Mist.
Jabbour reported that Rail America will cease operations on the Dakota Line on October
15th. Mn/DOT has decided that the track will stay in public ownership because it is identified
as a transportation corridor for light rail transit and other items. The Council is working
diligently with Mn/DOT and adjacent communities to make it a trail. Jabbour said that as Rail
America ceases to use and plow the track, it will become an automatic attraction for
snowmobile riders.
Kelley asked if Rail America would give the City permission to put up fences at certain
locations.
Jabbour said he would like the City Administrator and the Chief of Police to communicate the
Council's concern to the other cities and to work with Rail America to get their permission to
put up snow fences across the track bed. He does not feel that motorized vehicle traffic on the
track would be appropriate in Orono.
Jabbour stated that the City continues to work with Mr. Larson to acquire his land in Navarre
for a park. He said the City has also obtained the right -of -way for Saga Hill.
Gappa said the easement for the right -of -way will be recorded shortly.
Kelley suggested that the Council should think about design standards for buildings located in
the Highway 12 corridor. He said that other cities have design continuity from building to
building.
Sansevere and Flint agreed with Kelley.
Peterson raised a concern regarding the canopy at Orono Self Service. She does not feel the
existing lighting conforms to the conditions approved by the Council.
Jabbour said he understood that there would be down- focused lighting, no lighted canopy and
no spill over beyond the perimeter of the canopy.
Kelley said, in his opinion, the lighting does not meet those requirements.
Peterson said she does not believe those requirements were met.
Moorse said he understood that the lighting was to be focused down and it is not.

Jabbour said that if the City has not issued a certificate of occupancy, City staff should talk to
them about meeting the light requirements. If a certificate of occupancy has been issued, staff
should review the meeting minutes regarding this item and talk to them about it.
Sansevere said there is an interest on the part of the people involved in the Ice Arena to
acquire some park dedication fees in some way. He asked if park dedication fees could be
used to fund improvements at the Ice Arena.
Barrett said there is a provision in the Minnesota State Statutes that says that park dedication
fees can be used for certain kinds of projects including_ice arenas, but it requires an ownership
position by the City. The City does not have an ownership position in the Ice Arena.
Flint said the Council has concluded that the park dedication fees should be used for land
acquisition, not capital improvements.
Jabbour said the City does not want to have an ownership interest in the Ice Arena. He feels
that if the City makes it a policy to contribute to sports activities, there should be criteria
under which the groups would qualify for funding_ He said that all sports should have equal
right to compete for funds if there is a budget for sports activities.
Flint referred to Mark Engebretson's comments that the Ice Arena is doing fine from an •
operational standpoint, but they are having problems with the capital costs. He feels the City
should continue its position that these activities be funded privately.
ENGINEER REPORT
(#8) RECONSIDERATION OF "NO PARKING" SIGNS ON SHADYWOOD
ROAD
Gappa presented the staff report. He said the Council passed a resolution on the consent
agenda on June 28th to install "No Parking" signs along Shadywood Road north of the
Narrows Channel Bridge. Since Hennepin County installed the signs, staff has received several
letters from owners of Pheasant Lawn Dock Lots with concerns about the impact of no
parking restrictions on their lots. Gappa said he has studied this issue further and developed a
modified No Parking scenario for Council consideration. The first solution to post the entire
wide shoulder area for No Parking, was a conservative approach. He said the revised proposal
would keep No Parking restrictions in place for the entire northbound side of Shadywood
Road. This is necessary to provide a deceleration lane for vehicles entering the driveways
along this side of Shadywood Road. He stated that on the southbound side, the beginning of
the No Parking area could be moved 100 feet south to provide space for parking_ of five cars
in the dock lot area. This would provide 120 feet of space to be used as a deceleration lane for
vehicles turning into the driveway. This should provide adequate stopping distance for a .
vehicle speed of 30 mph when entering the deceleration lane. Gappa reviewed the distances

required for drivers traveling at certain speeds to recognize a hazard in the road and safely
stop a vehicle. The site distance for vehicles coming over the bridge is limited, which provides
insufficient time for traffic to react to vehicles attempting to pass turning_ vehicles. He said the
Council's options include taking no action, remove the No Parking signs, or move the
beginningof the No Parking_ area 100 feet south.
Jabbour asked why only the bridge area is a concern because the same situation applies to the
rest of County Road 19.
Gappa said that cars should not be parked on the rest of County Road 19 because the
shoulder is too narrow and no one has reported a parking problem in other areas. He said that
most of the County Roads near the lake are signed No Parking. He said there is no parking
allowed on any of the roads from 2:00 a.m. to 6:00 a.m.
Dick Ogle 2771 Shadywood Road, said he has been in contact with Don Lundstrom of
Hennepin County Traffic. Mr. Lundstrom told him that Hennepin County's position is that
they do not want parking_on county roads. He said that Tonka Bay, Minnetonka Beach,
Wayzata, Mound, and Orono have no parking on county roads. This is an extremely
dangerous road because it is a link of the Hennepin County Bicycle Trail. He said that Mr.
Rawlings, who was instrumental in the design and layout of the bridge when it was built, told
him that the bridge is wide so it can accommodate deceleration and turning lanes. He said that
on the Tonka Bay side, the road is posted No Parking and turn lanes are designated. Ogle said
the parking problem has developed in the last few years because some of the dock lots are no
longer owned by neighboring residents. He said that a condition of the resolution granting a
conditional use permit for the dock lots was that parking-would be allowed for one car. When
the lots were owned by local residents, they would unload their boat and drive to an area
where there is public parking_to pick up their passengers. He feels there has been a lack of
communication regarding the parking requirements between the former owners and the new
non - resident owners.
Ogle said there was a problem in the spring with people fishing from the docks and parking on
the road. This encouraged more people to park on the road. Ogle said bicycle riders will not
ride next to parked cars because there is a possibility of someone opening a car door and
causing serious injury to a bicycle rider. He said that Hennepin County is willing to post the
road with No Parking signs, but they leave it up to the cities to police it. Ogle said the
residents do not want parking allowed along County Road 19.
Sansevere asked if Mr. Ogle supports the amendment recommended by Mr. Gappa.
Ogle said he does not support the amendment because he feels it is not safe to have any
•parking_ along County Road 19.

Jabbour said this is a bad situation and it is non - conforming to Orono's standards. In Orono, if
you don't have a primary structure, you cannot have a secondary structure. The dock lots
were developed prior to the establishment of Orono's standards. He asked where these people
can park if parking is prohibited. He would like everyone to work together to solve the
problem.
Jim Zimmerman, 2745 Shadywood Road, said he knows the owners of the dock lots have the
right to park one car. He said the local homeowners have allowed the dock lot owners ingress
and egress over their properties. He said this is a residential area, not a marina. He does not
feel that additional parking should be allowed.
Sansevere asked if each dock lot has a parking space.
Zimmerman said they can clearly parallel park one car with room for a car to pass. He said
that is what was agreed to by the City.
Jabbour said that at that time they could park on County Road 19.
Zimmerman said he thought it was agreed that there would be no parking_ along the County
Road, they would be allowed one off - street parking spot and that if there were other people to
come, they. were to pick them up somewhere else where there was parking.such as the public
docks in Spring Park. He said that all the rest of the roads around the lake are "No Parking ".
He said safety is an issue and parking should not be allowed on County Road 19.
Jabbour asked if Zimmerman would approve enlarging the shoulder of the road to
accommodate parallel parking.
Zimmerman said he did not know if it would be appropriate to basically create a parking lot
along County Road 19 in a residential neighborhood.
Jabbour said he thinks people will park on the grass if they can't park on the road.
Zimmerman said there may be room along the service road to open up some space for
parking.
Sansevere asked if it would be possible to make room for parking along the service road.
Gappa said it would be difficult because of the topography.
Jabbour said that if it is resolved with parking along the service road, the Council should think
about allowing additional hardcover and grading. •

Gappa said it would require a retaining wall to widen the hill.
Jabbour said it would also require a curb cut to allow ingress and egress.
Zimmerman asked if there is a reason to void what was a logical solution at the time the lots
transferred from residents of the neighborhoods to nonresidents. He thinks there was a logical,
well thought out solution to say this is a neighborhood, it is not a marina, there should not be
cars parked all over, we will allow one car to be parked to try and maintain the character and
integrity of the neighborhood. He said he is hearing now that there is some feeling that we
must allow for more parking and that the original agreement is no longer valid. He said that
one of the docks is rental property and it is rented out to one or two boats at a time. He feels
that perhaps the parking restrictions were not communicated to the renters. He feels the "No
Parking" works fine. He asked that the Council review the original minutes concerning the
dock lots.
George Olson, 2775 Shadywood, said he lives in the neighborhood and owns one of the dock
lots. He explained that the first three lots are owned by neighbors so there is rarely a car
parked by those docks. He said the parking problem is by the lots on the far end. He said they
have access through the service road. He said they come over the curb on the other side. He
• said one of owners has put gravel on his lot and last weekend there were six cars parked there.
He said there is no parking allowed on the other county roads and he asked why all of County
Road 19 isn't consistent with the other roads. He feels there should be no parking all along
County Road 19.
Jabbour said that up. until two or three years ago, parking was permitted on all of the county
roads. He described all the areas where parking is allowed on county roads.
Olson asked why County Road 15 is all No Parking.
Jabbour said County Road 15 is very substandard.
Olson said the only spot where parkingis allowed is this stretch of County Road 19.
Kelley said the Mayor has pointed out other areas where parking is allowed along county
roads.
Olson said that Hennepin County's position is to have no parking along county roads, but they
have no way to enforce it and they look to the villages and cities where the county roads go
through to enforce the parking.
Kelley said he is not in favor of more regulation by government and he is only willing to look
at areas where there is a safety issue. He feels a safety issue does exist in this area.

Sansevere asked how many of the dock lots are owned by property owners from the
neighborhood.
Olson replied that there are eight lots and four are owned by local residents.
Richard Gay, 2735 Shadywood, said his primary concern is the safety issue for bicyclists. He
feels the dock lot owners have a right to some parking, but he does not feel they should be
allowed to park on the road. He said the cars are parking within one foot of a fire hydrant and
that is a problem. He said the cars could park off the shoulder of the road and a retaining wall
put in.
Sansevere asked Gay if Gappa's proposal would work.
Gay said it might be possible to get two cars parked off of the road, but he does not feel there
should be any parking, on the road. He said there should be off -road parking_ for the lots that
are not owned by neighborhood residents.
Donald Miegel, 683 Sullivan Drive, Columbia Heights, said he owns one of the lots. He said
they started parking on County Road 19 because some of the neighbors said they didn't like
him driving on the slip road. He said it is difficult to drive down by-the slip, because the road is •
grass and dirt. He rarely has more than one car there. He said the grass is mowed by the slips
on the north end, but not the south end and the slip road is barely wide enough fora car. He
would like to park by his slip, but if they bring two cars, there isn't enough room. He said if
they bring a lot of people out, _he picks them up _someplace else.
Sansevere asked if the City could widen the road for their access.
Jabbour said it is private property. He said that use of the land is different based on people's
life styles. He said there is no obligation on the City's part to see that everyone's life style is
accommodated. Just because someone has two cars does not mean the City has to provide
parking for two cars.
Kelley said his understanding is that there is a covenant in place that allows whoever owns the
lots to do whatever they want on this piece of property. They are allowed to park one car and
there should be no parking on County Road 19. He feels the City Council is caught between
the neighbors and the users of the docks.
Sansevere agreed with Kelley. He said the first priority should be safety. He said if restricting
parking on County Road 19 would prohibit the dock lot owners from getting to their boats, he
would be fighting_ harder to find another option, but they do have access and he is comfortable
with the resolution the way it stands. •

Peterson and Flint agreed with Sansevere.
Tom Huber, 2650 Shadywood Road, said he cannot get his vehicle by the cars that park there.
He said he drives up over the hill. He said they try to keep the property clean. He said in the
past Jeanne Mabusth told him that parking would always be allowed on County Road 19. He
said someone has actually put orange traffic cones down there to prevent cars from driving
through.
Jabbour said he feels the dock lot owners have to work together to figure out how to get in
and out of the property.
Zimmerman said it sounds like the issue is there is concern on their part that the access be
clear. He would be comfortable making sure that it is clear. He said he hasn't seen anyone try
to bar access to the property.
Jabbour said there has to be an ingress and egress and that the owners should work on it
together.
Sansevere asked what brought this matter up_ again.
Gappa said the non - resident owners were concerned about having adequate parking and
contacted him about it. He said the conservative approach is not to allow any parking on
County Road 19.
Sansevere suggested that the non - resident and residents owners work together to co- exist.
No action was taken on this item.

WARRANT STUDY
Moorse said this item is a follow -up to the County Road 15 traffic study, which suggested a
semaphore at the 15 and 51 intersection. Detailed traffic counts must be completed and a
signal justification report completed before a traffic signal can be installed. This is a proposal
from Bonestroo for completion of a signal justification report.
Jabbour said this will be a very emotional issue. He said this is one of many, many, issues from
the traffic study for the County Road 15 corridor.
Sansevere said one resident called him and asked that the Council place a moratorium on this
issue until after Highway 12 is done to see if there is a need for a fight at that time.
Flint said he talked with the same resident, Fred Puzak, who lives in that area. He said getting
onto 15 in the morning is not a problem because there is a pulse in the traffic caused by the
fight in Navarre. His concern is coming back in the evening because the traffic is solid and just
crawls along.
Kelley said that recently in the evenings, 15 has been backed up. all the way to 394. He feels a
fight will probably make it worse.
Jabbour said he told Mr. Puzak that the City Council is very aware of the intensity of traffic
and the limitations of County Road 15. As a result, the Council is trying to provide alternative
routes to County Road 15 in every segment of its planning, including the Highway 12 design. •

Jabbour asked about the traffic counts on County Roads 19 and 15.
Gappa said at the County Road 15/19 intersection, the traffic count on County Road 15 is
17,000 vehicles per day and 13,000 vehicles per day on 19.
Jabbour indicated there are 24,500 vehicles per day on County Road 15 at Orono Orchard
Road, so there is an increase of about 7,000 vehicles per day between County Road 19 and
Orono Orchard Road.
Moorse said that what the engineer said in the study is that even though there is a stop light at
15 and 19 that stops traffic, when you get a half mile away from that and there is traffic
coming_ on all the way, whatever gap that is created at that stop light a half mile away has
disappeared by the time you get to the County Road 15/51 intersection.
Kelley said he is not in favor of completing the signal justification report.
Peterson agreed with Kelley.
Flint said there are questions in his mind as to whether the report is necessary.

should wait and see how it goes.

( #19) PUBLIC WORKS LAND ACQUISITION OPTIONS
Moorse said that the City has a need for additional land for Public Works - related activities,
particularly a brush disposal site and a leaf composting site. The Council recently directed staff
to obtain an appraisal on a 12 -acre portion of the property located just east of the City's
Public Works facility. The cost of the 12 acres was substantially higher than the Council was
willing to spend. He said that staff has now developed a set of options for consideration by the
Council. Moorse reviewed the options which are to purchase a 3.4 acre parcel of land to the •
east of the Public Works facility, purchase land from the Orono School District to the north

and east of the City Public Works facilities, fill the existing wetland that is just west of the
Public Works yard area, or use City -owned land adjacent to McCulley Road for a brush
disposal site and leaf compost site. He said that Staff recommends pursuing the options that
are adjacent to the City's current facilities rather than having a satellite facility. on McCulley
Road. It would be difficult to maintain the security of that property and the site would have to
be at least partially fenced and gated. Staff would like to explore purchasing the land to the
east of the Public Works facility and the school property. He said the property to the east is
difficult for the current property owners to use because they can't get access to it because of
wetlands. It is guided for medium density residential and the homes could be located directly
adjacent to the existing Public Works site. If the City.purchases the property, it would provide
a buffer for the neighbors from the busier existing Public Works facility and give the City an
Opportunity to expand its site.
Sansevere asked if Moorse knows the asking price of the land.
Moorse said staff knows what the owner is asking for the 12 -acre portion, but not the smaller
area.
Sansevere asked if the City -owned wetland area was not wet, would it be sufficient room for
the site.
• Moorse said it yes, it would be sufficient room for a brush site and a compost site, but once
that land is used, there is no other City property available.
Kelley said he is in favor of trying to acquire additional property.
Peterson, Sansevere, and Flint agreed.
Moorse asked if that included approaching-the school district.
Kelley said no. He feels the school district has other projects to consider right now.
Jabbour told Moorse to pursue option 1 and keep option 2 on stand by.
