Following up on our conversation yesterday regarding the possibility of an accessory structure to be located behind (to
the south of) the principal structure, I have attached additional information for you.
The copy of the survey you provided is from 1982. There is an updated survey in the file from 1998 showing a different
boundary (also reflected on Hennepin County parcel annotations attachment).
The wetland map indicates a wetland on the property(copy attached); however the map does not depict the delineated
edge of the wetland. The survey from 1998 shows a drainage easement. This may or may not coincide with the actual
wetland. C� Code Section 78-1605(c) states any project within 150'of a wetland must be delineated. Please contact
the Minnehaha Creek Watershed District for more information on wetlands and hiring a wetland delinea�a+-�
l��c'.��
I have also included a copy of the as-built drawing of the current septic location from our file. -S�� "t7`��b„/

If you would be interested in placing the accessory structure forward of the principal structure (between the house and
the road) a variance would be required. Reference City Code Section 78-1435. A variance was granted in 1998 to allow
the placement of the current accessory structure. A copy of variance approval resolution number 4054 is attached.
Attached is a copy of the Zoning Permit Application for an accessory structure under 200 sf in size. If over 200 sf it will
require a building permit application, also attached. A revised survey will likely be necessary; the survey requirements
are listed in the Building Permit application.
Your property is located within Tier 3 of the Stormwater Quality Overlay District which allows 35%of the gross area of
the lot to be covered in hardcover. Hardcover calculations will be required with any application submitted, attached is
the City's Hardcover information packet.

Hello Jeremy.
We are finally moved into the home and I have a working PC. I've attached the completed hardtop calculation sheets,
escrow form and the updated survey. Ben was able to superimpose the wetland over the existing survey, per your
request. I also included the survey that showed the detached garage. Note the driveway calculation is not detailed on
the worksheet because I had to do it in segments due to length and curves. It is also not on the survey for some reason.
I will send you a check Monday for the escrow. Please let me know of any issues or concerns. It appears that my 8x12
shed is so insignificant to the hard-top calculation that it didn't even impact the percentage. Also, recall the shed will
not sit on the ground, so I do expect some grass/weeds to grow under it.

available electronically for us to simply insert our wetland linework into

On May 11,2016 the City received a zoning permit application for a 96 square foot accessory structure. Staff conducted
a preliminary review based on the information provided and requests the following items be submitted or revised in
order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. A survey was not submitted with the application. Please submit two full-size copies of
an updated survey showing the delineated wetland, including the 35 foot wetland setback and the location of
the proposed accessory structure.
2. Hardcover Calculations. The property is located in Tier 3 of the Stormwater Quality Overlay District. Please
have the surveyor prepare hardcover calculations, showing existing and proposed hardcover using the City's
Hardcover Calculation Worksheet. Enclosed is a copy of the City's Hardcover Information Packet.
3. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow
amount for this project is$700. The escrow agreement is enclosed. The property owner must sign the escrow
agreement and submit a check for$700.
4. Minnehaha Creek Watershed District (MCWD). A map created by Anderson Engineering shows an identified
wetland. Please contact the Minnehaha Creek Watershed District MCWD directly at 952-471-0590 regarding
your project. While we don't believe the proposed accessory structure will trigger their permitting
requirements,the MCWD is responsible for approving all wetland delineations.

a Minnesota municipal corporation ("City") and Stephen Kennedy ("Owners").
Recitals
1. A zoning permit application has been filed for a property located at 627 Ferndale Road North the
("Subject Property°), legally described as OY1 E1(hib, �- A, (1(-�B(.k.QA(
Hennepin County, Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $700 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering or legal consultant review) or will
incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible
for under a zoning permit application.The escrow will also guarantee reimbursement to the City for all out-of-pocket
costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution
Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used by the
City to eliminate any hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consuttant review) associated
with permit#2016-00507 if compliance with the approved zoning permit is not accomplished.
3. MONThLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'receipt
of bill.
4. DiSBURSEMfNT FROM ESCROW ACCOUNT. In the event that the Owne�s do not make paymerrt to
the City within the timeframe outlined in #3 above, sha11 issue a Stop Woric Order until the Owners pay a!I expenses
invoiced pursuant to#3. The City may draw from the escrow account without further approval of the Owners to reimburse
the City for eligible expenses the Ciry has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow,if any,shall be returned to the Owners
when aA requirements related to the project are complets. City Staff shall revievv the terms of this escrow agreement
1wo times per year to determine whether the requirements of the project have been successfully completed and
whether it is appropriate to retum the funds. Owner may also request the release of the funds, and such funds shal!
be released upon City Staff receiving the appropriate verification that all requirements of the project have been
successfully completed.
6. CERTiFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
