Sec.13.04 RIGHTS OF SUBJECTS OF DATA

Subd. 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself
shall be informed of: (a)the purpose and intended use of the requested data within the collecting state agency,political subdivision,or statewide
system;(b)whether he may refuse or is legally required to supply the requested data;(c)any known consequence arising from his supplying or
refusing to supply private or confidential data;and(d)the identiry of other persons or entities authorized by state or federal law to receive the data.
This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law
enforcement officer.
The commissioner of revenue mav vlace the notice reauired imder this subdivision in the individual income tax or oropertv tax refund
instructions instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsil�e aUtlioriry,an individual shall be informed whether he is[he
subject of stored data on individuals,and whether it is dassified as public,private or confidential. Upon his further request,an individuai who
is the subject of stored private or public data on individuals shall be shown the data without any charge to him and,if he desires,shall be informed
of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning,the data need not be
disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been
collected or creaCed. The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data.
The respopsible authoriry may,Fequire the requesting person to pay the actual cosu of making,certifying,and compiling the copies.
The responsible authoriry shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days
, of the date of the requ@st,exbluding-Saturdays, Sundays and ldgal}rolidays,9fimmedi2te compliance is not possible. If he cannot comply with
the request within that time,he shall so inform[he individual,and may have an additional five days within which to comply with the request,
excluding Saturdays, Sundays and legal holidays.
�ubd.4. Procedure when data is nok accprate or cqmplete. An individual may contest the,accuracy or completeness of public or
private data concerning himseif. To exercise this right,an individual shail.pbtify in writing the responsible authority describing the nature of the
disagreement. The responsibla authority shall within 30 days either. (a)correCt the data found[o be:inaccurate or incomplete and attempt to norify
past recipienu of inaccurate or incomplete data,including recjpients named by the individual;or(b)notify the individual that he believes the data
to be correcL Data in dispute shall be�disclosed only if the individual's sfatement of disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of the administrative procedure act relating
to contested cases.

A RESOLUTION GRANTING A VAR]ANCE

WfIEREAS, Timothy and Bonnie Johnson (herein�fter "the applicanu") are the
owners of the property located at 627 Femdale Road Nortr� within the City of Orono
(hereinafter "the City") and legally described as follows:
See Exhibit A for legal description (hereinafter "the proFerty"); and
W��AS, the applicants have applied to the Ciry for a variance to Municipal
Zoning Code Section 10.03, Subdivision 8(D) to permit consttuc�:ion of an accessory structure
on the property.
NOW, THEREF012L, BE YT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #2:�43.
2. The property is located in the RR-1B Single Faniily Rural Residential Zoning
District reyuiring two acres in area. The prope�ty consists of 90,265 s.f. or
2.07 acres.
3. The Orono Planning Commission reviewed this a��plication on March 16, 1998
and recommended approval of the proposed variances based upon the following
�ndings:
1. The lot configuration and location of tlie existing residence on the
property restrict locating an accessory structure behind or next to the
residence. �herefore, a variance is req iired to locate an accessory
structure in front of the residence.

2. The garage doors will not be visible from the street.
4. 1`he City Council finds that the conditions existin� on this property are peculiar
Eo it and do not apply generally to other propeny in this zoning district; that
granting the variances would not adversely affect traffic conditions, ]ight, air nor
pose a fire hazard or other danger to neighborin;; property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
pzopezty right of the applicants; and would be i�� keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
5. The City Council has considered this applicaticn including ihe findings and
recommendations of the Planning Commission, reports by City staff, comnnents
by the applicants and the effect of the proposed variance on the health, safety
and welfare of the community.
CONCLUSIONS, ORDE�t A1�iD COND[TIONS
Based upon one or more of the above findings, tlie Orono City Council hereby
grants a variance to Municipal Zoning Code Section 10.03, �ubdivision 8(D) to allow the
construction of a 736 s.f. garage located 227' from the front lot line where the principal
structure is located 329' from the front lot line and where no accessory structures are allowed
to be located nearer the front lot line than the principal structure.
Approval was subject to the following conditions:
1. Authorities granted by this variance run wit�� the property not with the
applicants, but are permissive only and must be exercised by application for a
building permit within one year of the date of Co�ncil approval, or this variance
will expire on that date (March 23, 1999).

2, Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoni�lg code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.

of this resolution and on behalf of themselves, their heirs, successocs and
assigns, hereby agree to the recording of this resoliition in the Chain of Title of
the property.
Adopted by the Ciry Council of the City of O�ono, Minnesota at a regulaz
