ORONO COUNCIL CHAMBERS 2780 KELLEY PARKWAY ORONO, MINNESOTA M ROLL CALL APPEALS Appeals will be heard in the order persons arrive and sign in at the Council Chambers When property owner's name is called please approach the Board and give the following information: • Name • Address of property (Mailing address if different) • The property identification number (PID number of the property being appealed) • Value of property on 2012 Notice of Valuation • Value you believe is appropriate and why ADJOURNMENT v MINUTES OF THE ORONO 2012 LOCAL BOARD OF APPEAL AND EQUALIZATION Wednesday, April 18, 2012 7:00 o'clock p.m. ROLL CALL The Orono Board of Appeal and Equalization met on the above - mentioned date with the following members present: Mayor Lili Tod McMillan and Council Members Cynthia Bremer, Doug Franchot and David Rahn. Representing Staff were City Administrator Jessica Loftus, Finance Director Ron Olson, and Recorder Jackie Young. Hennepin County Assessors Thomas Kunik and Michael Smerdon were present. . Mayor McMillan called the meeting to order at 7:03 p.m., followed by the Pledge of Allegiance. Kunik stated overall last year the City experienced an average drop in value of 7.9 percent over all property types. Lakeshore properties decreased in value an average of 8.6 percent and off lakeshore properties experienced a 6.8 percent decrease in value. The assessor's office looked at all sales within the . City, with the state deeming 71 percent of those as arms length transactions. McMillan asked what the time frame was that the assessor's office looked at for the sales. Kunik indicated they looked at the sales period from October 1, 2010, through the end of September, 2011, to determine the decline in the market for this year. APPEALS 1. BRIAN HEADON, 360 NORTH ARM LANE, PID #06- 117 -23- 24-0012 Brian Headon stated the valuation on his 2012 property statement was $636,000. Headon stated in his view the value of the property is more in the $500,000 range since he purchased the property on October 31 for $475,000 and had it appraised for $500,000 a couple of weeks before that. McMillan asked if he has spoken with the assessor. Headon indicated he has not. Kunik asked if he has a copy of the appraisal that the assessor's office can have. Headon indicated he does have a copy and will provide it. Kunik stated the next step would be to conduct an inspection of the property. Kunik indicated they would also like to see a copy of the purchase agreement. Kunik stated the assessor's office will look at the appraisal and make sure that the best comparable sales were used and that the value of the property is fair to Mr. Headon and his neighbors. Kunik indicated he will be in touch with Mr. Headon before the end of the week. 2. BETSY LABELLE, 539 KEENE AVENUE, PID #02- 117 -23 -31 -0028 Betsy LaBelle indicated she did speak with the assessor in November of last year. The estimated market value of the property was $648,000 for 2011 and in 2012 it is $607,000. LaBelle indicated she purchased is the property on December 18, 2009, and the taxes were $5,392. The taxes have increased 38.7 percent since that time. LaBelle indicated she is curious about the increase. LaBelle stated she was not told that in November and was instead told that because she did not contest it last year, she was out of luck. Kunik stated there apparently was some confusion as to whether she was speaking to them about valuation or taxes. LaBelle stated she was told that she had the option to hire a lawyer if she wanted to contest the increase. LaBelle indicated she does not understand the .process. Kunik asked if the property value for 2012 is incorrect in her view. Kunik noted there is not a direct correlation between the property valuation and the city taxes. LaBelle stated she believes her valuation and taxes are incorrect. Kunik noted he cannot deal with the taxes. The assessor's office sets the value of the property and the value is based on comparable sales during the one year time frame noted earlier. Kunik indicated he would be happy to review her property again and see what other sales might have occurred. LaBelle asked if she should discuss her taxes in November of this year. McMillan stated that is the time the City holds their truth-in- taxation meeting. LaBelle stated they did schedule a time to appear down at Hennepin County and then called the city assessor. McMillan asked if her valuation also increased at that time. LaBelle indicated it increased from $521,000 to $648,000. Loftus stated. if her value increased by 30 percent, this is the place to discuss the valuation of the property if she does not feel that is correct. Kunik indicated he would inspect her property and determine whether the valuation is correct given the comparable sales. Kunik indicated he will call Ms. LaBelle and set up an appointment to inspect the property., 3. WILLIAM AND NANCY BOCKMANN,1130 LOMA LINDA AVENUE, PID# 08- 117 -23 -23 -0012 Bockmann stated his 2010 value was $956,000 and his taxes were $10,071.54. The valuation for 2011 was $954,000 and the taxes were $11,325.58. Bockmann noted his taxes have increased 12.5 percent despite a flat property value. For 2012, the property valuation is $746,000, which means the assessed value has decreased by 21.8 percent. Bockmann stated it is not right to pay taxes based on an inaccurate property value and to pay higher taxes on something that has not increased in value. • Kunik asked if he has an appraisal that says the value is inaccurate. The property has been in the family since 1951. The house was constructed new and finished in 2000. Smerdon noted the last time they inspected the house was in 2000. Bremer asked if the valuation has decreased down to $746,000. Bockmann indicated it has. Bockmann commented he understands that lake front property has decreased but that there has been an uptick on properties not on the lake. Kunik stated every property type decreased in the City. Different neighborhoods experienced different decreases depending on the sales. Kunik indicated those numbers that he cited earlier were averages across the board for all of those property types. Kunik asked if they are located on the lake. Bockmann stated they have 95 feet of lakeshore. Kunik stated each bay is looked at in comparison to the other bays and what comparable properties sell for as well as the amount of frontage on the lake. Kunik noted there is some fluctuation in each of the neighborhoods from year to year and that the amount of decrease will depend on the age of the structure, the size of the lot, as well as other factors. • Bockmann indicated his property is .49 acre and is located next to a public landing with a gentle slope down to the lake. Kunik asked what Mr. Bockmann's issue is with the value. Bockmann stated it is the dramatic drop in valuation in relation to the amount of taxes he has to pay. Kunik asked if he feels the valuation dropped too much. Bockmann stated the taxes should be in line with the value. McMillan noted the assessor determines the house valuation and does not determine the taxes. McMillan asked if Mr. Bockmann feels the market value is correct on his property. Bockmann noted there have been two foreclosures on Loma Linda Avenue in the past year. Kunik indicated that will have an impact. Bremer commented it sounds like they probably did since his valuation dropped $208,000. Rahn stated another issue„is the assessor has n6t- inspected the house in 12 years. Kunik stated the biggest issue they have is whether they have inspected the property recently. The assessor's office goes around every five years and inspects properties in a certain area. Kunik indicated • they can look at the information the assessor's office has on the property and verify that it is correct. Kunik stated in the cases where they are unable to inspect the interior of the house, they have to assume the information they have on file is correct. Kunik stated they would be happy to inspect the property and that the biggest thing an inspector does is make sure that everybody is being treated equally. Franchot commented there is a chance that Mr. Bockmann's house valuation could increase rather than decrease since it has not been inspected for 12 years. Franchot stated the City's finance director, Ron Olson, could provide some information that explains how the actual tax is calculated and that in his view those sheets would be very helpful to Mr. Bockmann in understanding how his property valuation translates into taxes. Olson indicated he could send that information out to Mr. Bockmann and that it may also be on the City's web site. McMillan stated the percentage of increase or decrease is determined based on all the valuations within the City. Kunik indicated he will call Mr. Bockmann to see if he is interested in scheduling an inspection. LETTERS OF APPEAL 1. John Stavig, 780 Brown Road North, PID 34- 118 -23 -11 -0003 ADJOURNMENT McMillan noted the Orono Board of Appeal and Equalization will be recessed to allow the assessor time to contact each of the individuals. Kunik noted the next meeting must be held by the end of the 20 -day review period, which would be Monday, May 7`h. Loftus noted the next City Council meeting is scheduled for April 23, 2012. McMillan recommended April 30, 6:00 p.m., be scheduled for the reconvened meeting of the Local Board of Appeal and Equalization. Franchot moved, Rahn seconded, to adjourn the Orono Local Board of Appeal and Equalization at 7:43 p.m., and to reconvene the meeting on Monday, April 30, at 6:00 p.m. VOTE: Ayes 4, Nays 0. Kunik Date: March 05,2012 Re: 2012 Assessment/Local Board Meeting The 2012 Orono Local Board meeting has been scheduled for Wednesday, April 18th,at 7:00 P.M. As preparation for the upcoming Local Board of Review, please find the enclosed data to help you. An assessment fact sheet, a local board summary of duties, an alternative method to the local board meeting an information sheet explaining the "open book" meeting, a chart listing the amount of assessment '���::�;� growth for Lake Minnetonka communities, growth data from the Minneapolis Area � Association of Realtors on the city of Orono, and a book of sales with photos and characteristics from a sample of sales throughout the city. Summary of the 2012 Assessment Each year estimated market values are analyzed along with data from the market. Adjustments, as appropriate for each type of property are made. The results of those adjustments for Property Type Growth for the 2012 assessment are as follows: • Residential Lakeshore - 8.6% • Residential Off Lake -6.8% There are 3,968 taxable parcels in the city with a total market value of approximately $2,386,567,700. This value includes $18,525,500 in new construction improvements. The overall value decrease from Property Type Growth for the City of Orono is -7.9%. The County Board of Appeal and Equalization begins on June 18, 2012; application is required no later than May 23, 2012. ASSESSMENT FACT SHEET UPDATED 2/04 i'he purpose of this open book meeting is to review the Estimated Market Value and Classification for the 2012 Assessment, which will be reflected in taxes payable for 2013. Any questions regarding the taxes payable in 2012 cannot be addressed at this meeting because they are based on the assessment made in 201 L This Board has no authority to act on the 2012 taxes as per MN statute, Sec. 274.01. While we realize the MN Property Tax system is rather complicated and, at times, difficult to understand, it is hoped that the following information will help you when trying to communicate your questions and concerns with regards to your property's market value. State law requires that the value and classification of real estate be established as of January 2nd of each year. Market values are based on sales of properties within your market area. The MN Department of Revenue requires the overall level of assessment to be between 90% and 105% of market value. If the overall level of assessment is not at least 90%, the state may impose an aggregate increase on all properties within a city or classification. If sales indicated the market values have changed, the assessor must follow the trend indicated, whether it is to increase or decrease property values. Mass appraisal is the method used by assessors to estimate the market value of properties. Each property is physically viewed every five years. In addition, all new construction, alterations, or improvements will be appraised annually. COMMONLY ASKED QUESTIONS AT BOARD OF REVIEW MEETINGS 1. IS IT ILLEGAL FOR THE ASSESSOR TO INCREASE MY i�AL UE SO MUCH IN ONE YEAR? No. The assessor must value property at market value each year. Property values change continuously with changing economic conditions. There is no limit as to the amount of increase or decrease in property values in a given year. 2. WHEN WILL THE VAL UE INCREASES STOP? This is impossible to predict. The market dictates our values. If sale prices are increasing, our estimated market values will increase. If sale prices are falling, then our estimated market values must follow that trend. 3. WHAT DOES THEASSESSOR LOOKAT TO DETERMINEA PROPERTY'S MARKET VALUE? Each property is viewed to gather information on all characteristics that affect its market value such as location, size, age, quality of construction, amenities (i.e. walkout basements, fireplaces, and extra baths), and site characteristics. 4. AS A HOMESTEADING RESIDENT WILL I BE TAXED OFF MY PROPERTY, ESPECIALL Y IF I 4M ONA LIMITED INCOME? Homesteading residents are eligible for property tax breaks in Minnesota by use of the Homestead Classification. This decreases the property taxes on most residences. In addition to the Homestead Classification, residents of Minnesota are eligible to apply for the Regular Property Tax Refund or the Special Property Tax Refund. Both of these must be applied for using the M - 1 PR form issued by the State of MN. The Regular Refund is based on income so check the requirements stated on the form. You may qualify for the Special Refund if your property tax increased by more than 12% from 2011 to 2012 and the increase was $100 or more. There are specific guidelines for each refund, which are included with the instructions for the M - 1 PR. 5. WHENIS THE COUNTYBOARD OFAPPEAL AND EQUALIZATION? The Hennepin County Board of Appeal and Equalization begins meeting on: June 18th, 2012 All appointments for the County Board and Equalization must be scheduled no later than: May 23rd,2012 by calling: 612-348-7050 LOCAL BOARD OF APPEAL AND EQUALIZATION SLTNIlVIARY OF DUTIES AND RESPONSIBILITIES Most of the responsibilities listed under the Local Board of Appeal and Equalization are statutory, primarily found in Minnesota Statutes 274.01. • The first responsibility is attendance. The Local Board of Appeal and Equalization is an official public meeting similar to a City Council meeting and can not convene without a quorum. In addition to the local assessor, the county assessor, or one of his/her assistants is required to attend. • The valuation notices shall be in writing and be sent by ordinary mail at least ten calendar days before the meeting of the board. The valuation notice will include the dates, places and times set for the meetings of the Local Board of Appeal and Equalization as well as the Hennepin County Board of Appeal and Equalization. • The meetings must be held between April 1 and May 31 each year. The County Assessor shall fix a day and time when the Local Board of Appeal and Equalization shall meet. The board must complete its work and adjourn within 20 days from the time of convening stated in the notice of the clerk, i.e., calendar days -- original night is day one. • The clerk shall give published and posted notice of the meeting at least ten days before the date of the meeting. • Local Boards of Appeal and Equalization must see that all taxable property is properly assessed, valued, and classified for all current assessments. The board may consider both real and personal property. • If any property has been omitted,the board must correct the assessment by adding it to the list of assessments along with its market value. • The board may not increase or decrease by percentage all assessments in a district of a given class of property. Changes in the aggregate assessment by class are made by the county board of equalization. • Although the Local Board of Appeal and Equalization has the authority to increase or decrease individual assessments, the total of such adjustments must not reduce the aggregate assessment by more than one percent. If the total reductions would lower the aggregate assessments by more that one percent, none of the adjustments may be made. The assessor shall correct any clerical errors or double assessments discovered by the board without regard to the one percent limitation. • The local board does not have the authority to reopen former assessments on which taxes are due and payable. The board only considers assessments in the current year. • The board may find instances of undervalued properties. The board must notify the owner of the property that the value is going to be raised. The property owner may then appear before the board if they so wish. • It is the primary duty of each local board to examine the assessment record to see that all taxable property in the assessment district has been properly placed upon the list and valued by the assessor. The local boards do not have the authority to address exemption issues. Only the county assessor has the authority to exempt property. • A taxpayer may appear in person, by council, or written communication to present his or her objection to the board. The focus of the appeal should be centered on the factors influencing the estimated market value or classification placed on the property by the assessor. • All changes will be entered into the assessment books by the county assessor's office. • Before adjourning,the local board should prepare an official list of the changes. The law requires that the changes be listed on a separate form. All assessments that have been increased or decreased should be shown as prescribed on the form along with their market values. The record must be signed and dated by the members of the Local Board of Appeal and Equalization. Alternate Method of Appeal---Open Book Meetinq Open book meetings are an altemative to�the Local Board of Appeaf and Equalization. During "open book" meetings, the valuation and classification issues are handled by the assessor's staff on a one-on-one basis with the prope�ty owner. Typically, open book meetings are held by the county assessor's staff. However, larger cities with an appointed city assessor may hold their own open book meetings. � . The open book meetings are.held in locations that are convenient for property owners. Often open book meetings are held over several days during both day and evening hours. This allows property owners�to appeal when it best suits their schedules instead of having to rearrange their schedules to attend a local board meeting held at one place and time. The open book meetings provide a forum for property owners to meet with assessment staff on an informal basis to review information about their property and to ask questions about the assessment. This setting allows the assessor's office to resolve questions and reduce the number of property owners who feel the need to appeal to the County Board of Appeal and Equalization. Property owners do not need to make an appointment to meet with the • assessment staff. They can simply show up at the dates and times stated on the . Notice of Valuation and Classification, and an appraiser will discuss their assessment. Depending on the jurisdiction, the appraisers may have laptop computers to access information about the taxpayer's property. Some counties may be able to link directly to their computer-assisted mass appraisal (CAMA) system which allows the appraiser to obtain data on sales of comparable properties. When reviewing the details of the property with the owner, the appraiser can verify the accuracy of the county's data and correct any errors. The property owner can also schedule an appointment for the appraiser to view the property if needed. Benefits for the property owner Property owners often find that the open book meeting is less intimidating than presenting their appeal to the Local Board of Appeal and Equalization. They often appreciate the fact that they can have their questions answered in a more private setting, and not have to be apprehensive about making a presentation in front of their friends and neighbors. In this one-on-one setting, property owners may spend as much time with the appraiser as they need. They can compare the value of their home with the values of similar homes owned by their neighbors. The process is very efficient because concerns and questions are often resolved immediately. Property owners can see that the appraiser collects the same infoRnation on all properties, reassuring them that the process is the same for everyone, and they have not been singled out for a value increase. Property owners who are not satisfied with the "open book" approach may appea� to the County Board of Appeal and Equalization and/or appeal to Tax Court. It is only a,recommendation that the property owner attend the open book meeting to discuss concerns prior to the County Board of Appeal and Equalization. In a jurisdiction that does not have a Local Board of Appeal and Equalization, the property owner is not required to attend an open book - meeting in order to appeal to the County Board of Appea! and Equalization. Benefits for the local board The benefit for the local board is that an open book meeting save5 time for board members. It eliminates the need for the board to become familiar with and educated on the local real.estate market. Board members will be able to spe�� � this time concentrating on their other duties as town board or city council members. In addition, board members can avoid confrontational situations �v�;h constituents and will no (onger be put into difficult situations by having to maE:n decisions about the property values or classifications of property owned by friends and neighbors. . Benefits for the county While the number of appeals made at the open book meeting may not be less than the number of appeals to the local board, the benefit for the county is that the open book process allows for immediate consideration of issues, and in many cases, appeals are resolved before the County Board of Appeal and Equalizat'ion. The process is efficient for the county because it can often consolidate several jurisdictions into one meeting (or a series of rneetings) instead of holding at least one meeting in each jurisdiction.
