WHEREAS, Greg Malik (hereinafter "the applicant") on March 30,
1992 filed a formal subdivision application with the City for approval of
two-lot residential plat of property .legally described as follows:
Refer to Exhibit A, (hereinafter "the property" ) ; and
• WHEREAS, after due published and mailed notice in accordance with
Minnesota Statues 462.358 et. seq. and the City of Orono Zoning and
Subdivision Codes, the Orono Planning Commission held a public hearing� on
•April 20 , 1992 at which time all persons desiring to be heard concerning
this application were given the opportunity to speak thereon; and
WHEREAS, at their regular meeting held on May 11, 1992 the Orono
City Council considered the subdivision application of Greg Malik, noting
the following findings of fact:
l. The property is located within the RR-1B Single Family Rural
Residential Zoning District requiring a minimum of� 2 acres of
contiguous dry buildable land within each newly created lot. The
property contains a total of approximately 6.04 acres and .62
acres is designated wetland area.
2. The proposed plat contains two lots each meeting the required two
acres of dry contiguous area within each lot as follows:
� Lot 1 = 2.84 acres
Lot 2 = 2.00 acres �
3 . Hennepin County, in a report dated April 14, 1992, approved the
location of a new curb cut for a future shared drive that will
serve as a single access to both residential lots.
4. Each of the lots has been found to have � suitable area for both
principal and alternate on-site sewage treatment sytems per
• a report by S. Weckman dated April 14, 1992.

NOW, THEREFORE BE• IT RESOLV$D, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby approves
the preliminary plat application of Greg Malik for the property located at
3060 Sixth Avenue North per survey dated April 7, 1992 by Mark S. Gronberg
of Coffin and Gronberg, Inc., subject to the following conditions: �
1. Applicant shall retain residence structure and accessory
structure on Lot 2. The existing septic. system that serves
residence shall be abandoned at the time of shared drive
construction. Applicant shall install a conforming septic system
on Lot 2 within 6 months of the date the Certificate of Occupancy
is issued for new residence on Lot l. �
2. Applicant shall be allowed to use the existing driveway that
serves residence on Lot 2 during the construction of the new
residence on Lot l. Upon the issuance of a temporary Certificate
of Occupancy for new residence on Lot l, applicant shal 1 have 10
days to install shared drive within Outlot A and abandon existing
• septic system. Applicant is further asked to install shared
drive as close to the western boundaries of Outlot A in order to
minimize impact of shared drive upon existing residential
development along east lot line. The existing drive serving
residence on Lot 2 shal 1 be removed and ground cover restored at
the time the shared drive is installed.
' '�� 3. At the time of f ina 1 p lat� approva 1 the app licant sha 11 execute a
Developer's Agreement and a Letter of Credit in order to ensure
the following improvements are completed:
a. Installation of shared drive within Outlot A and the
abandonment of existing septic system that serves existing
� residence on Lot 2.
b. Existing drive that serves residence on Lot 2 to be removed
and ground cover restored.
c. Installation of new septic system to serve residence on Lot
2.

� FINAL PLAT SUBMITTALS
The following list of final submittals must be submitted to the Zoni.ng
Administrator two weeks prior to the regularly scheduled Council meeting on
the second and fourth Mondays of the month:
1. RECORD PLAT drawings in the form of two (2 ) mylar copies and one
(1) copy reduced to 1"=200'. Drawing to include:
a. Lot lines platted per preliminary survey.
b. Dedication of, drainage easements over designated wetland in
northwest portion of Lot l. � •
c. Dedication of 40' of right-of-way for County Road 6.
• d. Dedication of drainage and utility easements 10' wide along
all perimeter property lines and 5' each side of internal
property lines except omit at designated. wetland area.
2. LEGAL DOCUMENTS required: �
a. Title opinion addressed to the City. Al1 owners, mortgage
holders or others with property interest indicated therein
shall sign the plat and all other documents affected by such
interest. �
• b. The app licant must provide certified copies of al 1 recorded
� easements currently affecting the property.
c. Signed and executed Flowage & Conservation Easement over the
designated wetland (refer to sample enclosed). Legal
description can be written as fol lows: .
Shown as drainage easements on the plat,
( lat name ), Hennepin County, Minnesota.
� d. Signed and executed Developer's Agreement and Letter of
Credit for the completion of the required improvements.
Samples have been enclosed for your review and execution.

b. Legal review and filing fees = $200.00
c. Park Dedication Fee*
� The Park Commission shall review two-lot subdivision to
determine if portions of the land would be suitable for
acquisition by City for park or trail use. If the City has
no interest in acquiring lands, the City wil l ask for a cash
payment in lieu of land. At that point the property will be
referred to the City Assessor to determine the value of the
undeveloped land. The Park Dedication Fee would be based on
the value of 8� of the undeveloped land. Please contact
John Gerhardson (473-7357) for information pertaining to the
scheduling of your application before the Park Commission.
Park fees must be paid at the time of the filing of the
final plat.
. Applicant is hereby advised that preliminary subdivision approval
shall expire in one year from the date of Council's approval of the
pre I iminary p 1 at (May 11, 19 9 3).
Adopted by the City Council of the City of Orono, Minnesota at a
regular meeting held this llth day of May, 1992.
